Greetings,
Please find attached here with all relevant documents along with the order passed by the
Hon'ble Jaipur Bench of Rajasthan High Court read with the guidelines issued by the
MoEF in 2008 and Elephant presence banned in the Mumbai etc as ready reference.
It is humbly submitted that:
1. Crime against wild animals are try and decide by the Hon'ble Special Environment
Court at Faridabad instead of Civil and Police Administration, where as RO cum SDM at
Nuh doesn't have authority to decide the crime against wild animals, at his own, hence I
don't agree with the findings of the RO because complainant was never heard, while
deciding the complaint. It would be pertinent to mention here that proof of burden on the
accused before the court of law.
2. INLD candidate admitted that he used the male elephant to ride towards filling his
nomination, in fact male elephant belongs to Delhi and this wild animal is a National
heritage animal of India and can not be used as vehicle of pride, publicity tool and for
entrainment, there are no doubt that male elephant can be aggressive due to handled with
prohibited iron ankush and thorn bits, noise and crowd etc because Haryana is not a
natural habitat for Elephants, guidelines issued by the Ministry of Environment and Forest
were also violated read with the advisory issued by the Election Commission of India
because transit permit for shifting of this elephant to Haryana was not for the purpose, on
which this animal was abused.
3. Elephant custodian was neither a trained Mahavat nor a owner of this elephant and this
animal was hired by some private persons for personnel gain and profit.
4. Male Elephant can create public nuisance, harmful for public life and property.
5. FIR was also lodged against this male elephant with Hodel Police Station in past, copies
attached.
6. This male Elephant was not registered with the AWBI as performing animal.
7. Section 38-H of the Wildlife Protection Act, 1972 was also violated, no proper housing,
treatment and care facilities are available with his custodians and they are not financially
sound to up keep the elephant.

Prayers:
1. FIR may kindly be lodged against all abusers, custodians along with promoters.
2. Private ownership may kindly be cancelled and abused male elephant may kindly be
rescued and rehabilitated immediately.
3. As per CZA orders, no zoo's are permitted to keep elephants, hence this male elephant
may kindly be rehabilitated in the rescue centers approved by the Government for this
purpose.
4. Hon'ble Delhi along with Punjab and Haryana High Court may kindly treat this mail as
PIL for further consideration because reply of the INLD candidate is not satisfactory and it
seems that Civil and Police Administration are trying to hush up the crime against
scheduled one protected wild animals, declared as National heritage animal of India.
5. Election Commission of India may also take appropriate legal action against the abuser
candidate and RO at Nuh.
