As you have said, you are a public civil servant and by law
per the Voter Registration Code Book-Section, you are
required to provide us with the information requested.
Please let us help you help us to find the information, tell us
where you are looking to find it and we can research it there,
as it is in public domain.
Our previous research and conversations for information
with the Voter' s Registrar Office in Salinas, have resulted in
several unanswered calls and emails with Mark Silvia, and
Chuck Cassinelli, Elections Analysts, which is very
frustrating and unnecessary. Mr. Claudio Valenzuela, Acting
Registrar of Voters, Monterey County Elections in Salinas
has only provided the following information. He provided
us with the number of registered voters in Carmel between
the years of 2010 and 2014.
Mr. Valenzuela and the associates at the Monterey County
Bar Association stated that you are required as a civil
servant to give us this information
1. What was the total population of Carmel By The Sea for
each year from 2006-2014?
2. 2. What was the total population of registered voters in
Carmel for each year from 2006-2014?
3. what was the population of registered voters that
physically voted at the polling stations in Carmel from
2006-2014?
4. How many people in Carmel physically voted at each
polling station in each district from 2006-2014? What are
or what were the locations of each district from 2006-
2014?
5. What were the number of votes counted at each station
during the hours of operation from 2006-2014?
6. How many poll workers were at each station from
2006-2014? How many officials at each station? What were
the duties of each official? What were the duties of the
poll workers? Who were they? How were they contacted?
7. How many registered voters in Carmel voted in absentia
as in mail in ballot from 2006-2014?
8. Who are they, and where did they mail their ballots from
2006-2014? What are the requirements for voters/residents
in Carmel for voting by mail-in ballot?
9. Can a second home-owner who does not live in the
home year round, vote in a Carmel election? What are
the requirements for a second home-owner to vote in a
Carmel election? How long must they live in the
residence to be able to vote in the election?
10. Will valid voters in Carmel be allowed to vote
electronically in 2014? What is that process of voting
electronically? Where do they go to vote, to the City of
Carmel website? Where can they find this information?
11. How many polling stations will there be for the
election in Carmel in 2014? What are the addresses and
locations for all of these stations? What will the layout
or process be? Please describe in as much detail as
possible.
12. How many people will be able to vote at one time
in a polling station? Who will be counting/ validating
the votes at the polling station?
13. As previously requested/ we will need a copy of
the ballot format so we can help our voters prepare and
fill out the ballot for a write-in candidate correctly/
during several of our voter registration presentations in
the coming weeks.
14. We also need to know the physical addresses/
parcel and block numbers of the population in Carmel
that are not

cannot, have not or will not be registered
voters. Where are they?
15. Will people be allowed to vote electronically?
16. What is the petition process to repeal the mail-in
and electronic voting process? Do you have those
forms? How do you file a complaint with the Secretary
of State and District Attorneys Office?
Some of the following information could have been obtained
from Mark Wienie, Senior Planner, but he has refused to
respond to several requests for information and help. We
have personally gone in several times to the City Hall Office
to leave messages and his secretary's that we have spoken to
have said, "He' ll respond to your requests when he has time.
He is either busy, at a meeting or unavailable." It has now
been two weeks.

18. How many wine bars are pending? What are the
addresses, occupancy and owner names for each
establishment?
19. How many bars are there total that serve alcohol
and wine? What is the occupancy rate on these? What
are the addresses, occupancy and owner names for
each establishment?
20. How many liquor stores are in Carmel? What are
the addresses, occupancy and owner names for each
establishment?
21. What and how many types of businesses are there
in Carmel retail and commercial? We need the owner's
names and addresses as well. How many serve wine
and or alcohol? How many are pending? What are the
addresses and owner names for each business?
22. How much revenue does the city actually receive
from the
winebarsjbars/ restaurant/ retail/ commercial/liquor
stores that also serve and sell alcohol? What are the
addresses, and owner names for each business?
23. How many hotels and rooms are there? What are
the costs seasonally per room? How much does the city
receive for each hotel and each room? We need the
occupancy rate and tax for each room for each hotel by
name. (They are all different)
24. How many hotels serve or provide wine and or
alcohol in the rooms?
25. How many retail stores are there with wine bars in
them? How many are pending? What are the addresses
and owner names?
26. How much revenue does the city of Carmel By
The Sea receive each year from the wine bars?
27. What are the current city
maintenance/ construction projects and cost of such in
Carmel? Where are these projects? What is the total
number of people's names and positions and number of
new hires in all of city of Carmel Government? Time on
the job, recent fires/leaves/ terminations. How many
people are working these jobs? Where are they from?
The Elections Code book does not specify requirements in
the municipality of Carmel and we want to make sure we
have as much of the correct information as possible in our
research. As City Clerk, the municipality of Carmel By The
Sea is the only one who knows the information and we need
it to complete our research and agenda asap!
This process is extremely time consuming and frustrating. It
is imperative that we have the correct information for the
write-in candidate so we can run a successful campaign for
Mayor of Carmel. "The time is of the essence" and time is
our only true resource that we share, if we waste our time
we waste our life and therefore it makes us losers, and we
are not losers, we're winners and in fact, we may have
already won!!
Please help us to make the adjustments to the injustice that
has corrupted our system (or so it seems) and help restore
the faith in our democracy.

2014 responding to your three letters seeking voting and business related statistics
("Information Requests"). As previously stated, the City does not collect and record the
type of data that is required to answer your questions and must reserve its limited resources
to obligations to which it is legally bound. Notwithstanding the foregoing, City staff had an
opportunity to briefly look into your questions and created the attached documents that
contain related information that may be helpful to your search. Please note, the paragraph
numbers of the attached document correspond to the questions in your letter of February 3,
2014.

Department of Finance. Although, the current city population is roughly 3,750 residents. The
City does not keep these type of statistics/metrics

statistics primarily because some elections have been consolidated (meaning run by the county
as a contractor to the city, and some elections are run exclusively by the city itself). What we
can say is that: (there are two sheets that appear to be responsive)

Dear Mr. Stilwell:
On January 14, 2014, I met with the City Clerk at City Hall to inspect records
responsive to our various publ ic records requests to the City. After reviewing a portion
of the records, the Clerk came in to check on me and see how my inspection was
going. I told him that I had a few questions about the records, and he quickly
responded that I needed to put my questions in writing because he was in the middle of
an election and very busy. I asked if there was anyone else I could speak with, perhaps
you, but I was told you were "with Sue," and were unavailable.
It would have been much more efficient for all parties to discuss my questions
during my inspection. However, because the City was unable to take the time to assist
me in person, I am providing my questions in writing.
October 16. 2013 Public Records Request
It appears that the City did not produce any documents in response to request 2
for "Resumes, or equivalent records for employees hired to fill positions that are
management level or above and the person was hired by the City at any time during
that last five years."
The City's response stated that it has responsive records, but it does not appear
that any responsive records were produced by the City. Please tell us whether the
records were withheld, and if so, under which claim of exemption or privilege. If the
City's position is that it did produce responsive records, please tell us which records are
responsive to request 2.
October 22, 2013 Request Regarding John Hanson
The City's November 15, 2013 response to our request for records regarding
John Hanson stated "the City believes that you already have a copy of all disclosable
public records in the City's possession that would be responsive to your October 22,
2013 request for documents related to John Hanson's personnel records and,
therefore, will refrain from providing a duplicate copy unless requested to do so."

When we inspected records on January 14, 2014, it appeared that the City
produced many documents regarding Mr. Hanson, a stack nearly an inch thick. Were
these documents duplicative or produced for the first time? The City stated it would not
be producing Mr. Hanson's personnel records. If they are new records, we would like to
review them.
October 22. 2013 Reguest - Employee Contracts and Status
Request 1 sought "All employee employment contracts and/or employment
agreements with the City in effect any time in the last 10 years." In response, the City
produced multiple employment agreements, however, the signatures of the employee,
City Administrator and City Clerk were redacted for most of the agreements. Please
produce a complete, unredacted copy of each of the employment agreements.
Request 3 sought:
Resumes of applicants, job applications and job offers for
the following positions, including when an employee was
hired or promoted or placed on temporary or ongoing leave,
if at all, at any time in the last five years.

c. Chief of Police
d. Human Resources Manager (or equivalent position)
In its November 15, 2013 response, the City stated that it had responsive

December 5. 2013 Public Records Request
Request 1 sought the resignation letter of Heidi Burch, the former City
Clerk, which the City produced for inspection. However, Ms. Burch's signature

In its December 20, 2013 response, the City stated that it had records
responsive to request 2 which sought Government Code claims filed with the

The City of Carmel-by-the-Sea ("City") is in receipt of your letter of March 25,
2014 ("Letter") that proposes to resolve all outstanding issues regarding the records
requests included in the above-referenced demand. The City has reviewed your
proposal and provides the following response:
1. You were advised on March 20, 2014 that public records responsive to your
request were available for pickup. To date, you have elective not to retrieve those
public records. Regardless, and notwithstanding the fact that the City is not
legally obligated to send such public records to you via First Class Mail or hand
delivery, the City will, in a show of good faith and to ensure that this matter is
resolved promptly, send (i) all responsive public records as described in the
City' s email dated March 20, 2014 and (ii) all responsive public records regarding

provider access to public rights of way ("ROW") in Carmel. Specifically, we are
requesting copies of all of the following:
1. Any agreement, contract or other arrangement granting a communications carrier
(including but not limited to incumbent local exchange carriers, competitive local
exchange carriers, interexchange carriers, wireless carriers, VoiP providers) rights
to attach to or use city infrastructure including but not limited to utility poles,
conduit, street lights and traffic signals;
2. Any franchise, attachment, or right-of-way agreement (including any settlement
agreements or letters of understanding or_intent in lieu of such agreements) for, or
related to, the provision of communications services or construction of
telecommunication facilities or infrastructures used for telecommunications
between Carmel and any carriers or providers, including but not limited to
(incumbent local exchange carriers, competitive local exchange carriers,
interexchange carriers, wireless carriers, VoiP providers).
All of the requested materials meet the definition of "public records" in Section 6252( e),
and that none of the exemptions set forth in Section 6254 apply. Further, the City of
Carmel meets the definition oflocal agencies in Section 6252(a) and (d) subject to the
requirements of CPRA. Therefore, the City is obligated to make these documents
available. If the requested documents are maintained in an electronic format, I am hereby
requesting that the City make them available in that same format, pursuant to Section
6253.9. If the requested documents are maintained in paper form, I am requesting that
copies be made available to me.

For our press contacts log ... I had a call and an email from Mary Schley asking about two issues: the posting as Unsafe to
Occupy of the La Rambla Building on the West side of Lincoln between Ocean and th, and the Planning Commission's
approval of Da Giovanni Cellars Tasting Room proposed for Dolores between 5

I informed her that the La Rambla Building was posted for public safety reasons by our Building Official. I noted that
there were structural issues as well as electrical issues. She asked for more details, and I indicated that I would send her
our letter to the owner. This letter has the details from engineering and electrician reports.
For Da Giovanni, I clarified the condition of approval that was approved by the Commission and noted that this item has
been requested for reconsideration with this (reconsideration) action scheduled for the Commission's next meeting on
March 11

She asked about the Building Official position, and I indicated that I was hopeful that the new BO would be in place
sometime in March. She asked how many applications we received and I noted that this was a personnel issue.

I am writing to request the specific documents and records as indicated below, pursuant
to the California Public Records Act 6250 et seq.
The requested docwnents and records are as follows:
The Claims Center, LLC is representing AT&T for the purpose of damage claim
resolution. We are attempting to locate information concerning a street in Carmel-
by-the-Sea: 3rd Ave, between Junipero St and Torres St.
During a project done at this location, a buried communication line was damaged.
We are working with AT&T to resolve this issue.
We are requesting copies of Right of Way, Street Cut, Excavation, Construction,
Driveway, Encroachment, Utility, and Sidewalk permits that would have been
issued to allow excavation at this location that would have been in force and valid
on August 30, 2013. Please provide copies of any permits and applications found,
along with the Certificate of General Liability insurance if one was required to
obtain the permit.
This request includes copies of every document related to the matter, regardless of the
format in which the information is stored.
I request copies of these records provided, either by mail, facsimile, or email, whichever
is most prudent for your office.
