hereunder herein after called the Schedule Mentioned Property.
Whereas the VENDOR

Whereas the Vendor above named offered to sell vacant housing site

more fully described in the schedule hereunder for a total sale consideration of

and Seventy Five only) free from all encumbrances, claims & Charges on the
terms and conditions set out in detail in this deed of absolute sale and
conveyances, and the PURCHASER has agreed to purchase the same for

and Seventy Five only) free from all encumbrances, claims & Charges on the
following terms and conditions

WITNESSETH:
That in pursuance of the aforesaid presents and in consideration of the
sum Rs.1,68,875/= (Rupees One Lakh Sixty Eight Thousands and Eight

Hundred and Seventy Five only) paid by the purchaser to the Vendor in the
Manner Following.
In all amounting to Rs.1,68,875/= (Rupees One Lakh

aforesaid the vendor do hereby admit, acknowledge and release the
purchaser from further payment thereof and the vendor do hereby sell,
convey, grant, assign and transfer to and unto the Purchaser by way of
Absolute Sale of the Vacant housing site situated in Plot No.________ an
extent of 965 Sq.ft., Named as PLACE NAME

No.___, New survey No._____, Situated in [ADDRESS], SRO of [REGISTER


OFFICE PLACE NAME] more fully described in the schedule hereunder
together with all ways, passages, drains, water, water courses, forming part of
or attached or reputed to form part of the property with all the legal, customary
rights, easements, licences, advantages, amenities and benefits appurtenant,
incidental or necessary for the enjoyment of the said property with all right,
title, interest, claim and demand of the vendor to the schedule property.

TO HAVE AND TO HOLD THE SAME UNTO THE USE OF THE


PURCHASER to be possessed, used and enjoyed by the purchaser, his legal
heirs, legal representatives, executors, administrators and assigns for ever
and from generation to generation freely and absolutely with full right of
enjoyment and possessing the schedule mentioned property free of all
encumbrances, charges, lien, right or demand of any kind whatsoever:
The Vendor hereby covenant with the Purchaser that notwithstanding
any act, deed or thing whereby the said vendor or their predecessors in title
done or executed or knowingly suffered to the contrary, vendor herein have full
and absolute rights, title, and interest and power to grant, sell, convey, transfer
and assign TO and UNTO the purchaser under this Deed of Sale, the said
immovable property morefully described in the Schedule hereunder and the
purchaser from the date of this sale in their favour may quietly posses and
enjoy and receive all benefits and profits from the said property absolutely with
full power of alienation without any hindrance, let, eviction, demand,
interruption, disturbances, claims whatsoever from the vendor or any other
person lawfully or equitably claiming for or in trust for the vendor.
The vendor hereby further declare and assure the purchaser that the
property hereby conveyed to the purchaser is not the subject matter of any
encumbrance and that the vendor have not at any times hereinbefore done or
knowingly suffered or been party or privy to any act, deed or thing whereby the
vendor is in any way prevented from conveying the said property morefully
described in the schedule hereunder conveyed to the purchaser;
The vendor hereby further fully and truly assure the Purchaser that the
schedule mentioned property is not the subject matter of any charge,
indemnity, agreement to sell, court attachment, civil or criminal or revenue
recovery proceedings, testamentary disposition, distraint, maintenance, right
of residence or any mortgage or any kind or form of encumbrances,
proclamations or court order on the property which in any way prevents its
alienation and the same free from any other claim or proceedings or LIS, the
vendor solely and absolutely entitled to the schedule property have full and
absolute right and power to sell, convey and assign the same unto the
purchaser absolutely and declare that there are no impediments for the
absolute sale of the schedule mentioned property.

The vendor further declare that they have not done any act or omitted
to do any act and have not entered into any agreement or arrangement or
offered the Schedule mentioned Property as security for the performance of
any agreement or arrangement whereby the Schedule mentioned Property will
be in any way affected in title, estate, possession or enjoyment by the
purchaser.
The Vendor further covenant with the purchaser that there are no
material defects in the title of the vendor and that the vendor have not
knowingly or willfully failed to disclose any material defects in the vendors title
to their predecessors-in-title to the schedule mentioned property and that the
vendor have not done any act or deed or thing whereby they are in any way
prevented from conveying the schedule mentioned property to the purchaser
herein;
The vendor hereby covenant with the purchaser that for breach or
failure of any other conditions, covenants, stipulations, declarations in this
indenture, the vendor agrees to indemnify the purchaser to the extent to which
the purchaser may suffer by reason of such breach or failure.
The vendor hereby covenant with the purchaser that should there be
any clog or cloud over the schedule mentioned property, the vendor, shall at
the request of the purchaser and at the cost of the vendor take steps to clear
the same and further covenant with the purchaser to save harmless and
indemnify them against all encumbrances, charges and equities whatsoever in
respect of the schedule mentioned property.
The vendor hereby further assures the purchaser that they have paid
all taxes and other out-goings of public nature in respect of the schedule
mentioned property and that in case the purchaser shall be required to pay all
or any other arrears, the vendor hereby undertake to reimburse the purchaser.

The vendor hereby further covenant with the purchaser that they,
the vendor and all persons lawfully or equitably claiming under them

shall and will from time to time and at all times hereafter do, execute and
register all such acts, deeds and things at their costs and expenses for
further and morefully assuring the schedule mentioned property or
every part thereof TO AND UNTO THE PURCHASER as may be
reasonably required.
The vendor hereby declares that he or anybody claiming through or
under them has henceforth no manner of right, title or interest in or to or over
the schedule mentioned property hereby conveyed.
The vendor further declare that the purchaser is entitled to obtain
Transfer of Property Ownership of the schedule mentioned property in their
name in all public records (i.e.) Permanent land Register and Municipal
Records on the strength of this Deed of Sale executed by the Vendor in favour
of the Purchaser and vendor hereby give their consent for effecting such
transfer by the authorities concerned.
The vendor have delivered this day the vacant possession of the
schedule mentioned property and also all title deeds relating to the schedule
mentioned property to the purchaser available with them and the purchaser
have taken possession of the same.
