AN ACT MANDATING ALL RESTAURANTS AND OTHER SIMILAR FOOD
ESTABLISHMENTS TO PROVIDE FOOD LABELS TO ALL THEIR ITEMS IN THEIR
MENU
SECTION 1: MANDATORY FOOD LABELING. All restaurants or other similar food
establishments are required to disclose calories for each standard menu item directly on
the menu next to the item on the menu. Those which use an indoor menu board are
required to disclose calories only for each standard menu item directly on an indoor
menu board next to the item on the menu board.
If the standard menu item is a combination of at least two standard menu items, the
disclosure of calorie content information on a menu or menu board shall, based upon all
possible combinations for that standard menu item, include both the minimum amount
of calories for the calorie count information and the maximum amount of calories.
If there is only one possible total amount of calories, then this total shall be
disclosed. Also, for a standard menu item that is not an appetizer or dessert, but is
intended to serve more than one individual, the disclosure of calorie content information
on a menu or menu board next to a standard menu item must include the number of
individuals intended to be served and the calorie content per individual serving.
SECTION 2: DEFINITION OF TERMS. For the purpose of this Act:
A. A "restaurant or similar food establishment" would be an establishment that sells
restaurant or restaurant-type food whose primary business activity is the sale of
food to consumers.
B. Food Labels carry information such as total calories, calories from fat, total fat,
saturated fat, cholesterol, trans fat, sodium, total carbohydrates, sugars, dietary
fiber and protein.
SECTION 3.PENALTIES. Restaurants or other similar food establishments which will
be found guilty of violating the provisions of Sec. 3 shall be subject to fine of One
hundred thousand pesos but not exceeding one million pesos.
SECTION 4. SEPARABILITY CLAUSE. If any provision or part hereof is held invalid or
unconstitutional, the remainder of this Act or the provisions not otherwise affected shall
remain valid and subsisting.
SECTION 5. REPEALING CLAUSE. All laws, decrees, orders, rules and regulations or
parts thereof inconsistent with this Act are hereby repealed or modified accordingly.
SECTION 6. EFFECTIVITY. This Act shall take effect fifteen (15) days after its
publication in at least two (2) newspapers of general circulation.
