and, COUNTII based upon a series of acts connected together and constituting parts of a common scheme and plan, said Eddie Devine, being a male human being above the age of eighteen (18) years, whose date of birth is January 10, 1998, did, on and about the 13" day of April, 2014, in the county aforesaid and within the jurisdiction of this Cour, wilfully, unlawfully, and feloniously take the personal property of Destin Bedford, an adult male human being, to-wit, a 34” Phillips flat screen television, a Playstation 3, a silver HP laptop computer, Apple I Pad., a brown wallet, Galaxy cell phone and a piggy bank with a star emblem on it, by putting him in fear of immediate injury to his person by the exhibition of a deadly weapon, a gun, while both he and the said Eddie Devine, along with his Co- Defendant, Joseph McDougle and fellow victim, Ashia Kendricks, were in Destin Benford’s 2009 silver Ford Fusion automobile, located in Jackson, Mississippi, all occurring within the jurisdiction of this court, in violation of Mississippi Code Annotated Section 97-3-79(1972, as amended); and COUNTIV based upon a series of acts connected together and constituting parts ofa common scheme and plan, said Eddie Devine, being a male human being above the age of eighteen (18) years, whose date ofbirthis January 10, 1998, did, on and about the 13* day of April, 2014, in the county aforesaid and within the jurisdiction of this Court, willfully, unlawfully, feloniously and without lawful authority forcible seize and confine Destin Bedford, an adult male human being, against his will, by forcibly confining him in his, Destin Benford’s, 2009 silver Ford Fusion automobile, and driving him around inJackson, Mississippi, by threatening him with serious bodily injury through the exhibition of agun, all within the jurisdiction of this coun, in violation of Mississippi Code Annotated Section 97-3- 93(1972, as amended); and COUNT V based upon a series of acts connected together and constituting parts ofacommon scheme and plan, said Eddie Devine, being amale human being above the age of eighteen (18) years, whose date of birth is January 10, 1998, did, on and about the 13" day of April, 2014, in the county aforesaid and within the jurisdiction of this Court, willfully, unlawfully, feloniously and without lawful authority attempted to cause or purposely or knowingly caused bodily injury to Ashia Kendricks, an adult female human being, with a deadly weapon, to-wit: a gun, by striking her in the head with such gun, which deadly weapon was likely to produce death or serious bodily harm to Ashia Kendricks, all ‘occurring at Destin Benford’s residence located in, Jackson, Mississippi, all within the jurisdiction of this cour, in violation of Mississippi Code Annotated Section 97-3-7(2)(1972, as amended); and COUNT V) based upon a series of acts connected together and constituting parts of acommon scheme and plan, said Eddie Devine, being a male human being above the age of eighteen (18) years, whose date of births January 10, 1998, did, on and about the 13" day of April, 2014, in the county aforesaid and within the jurisdiction of this Court, willfully, unlawfully, feloniously and without lawful authority attempted to cause or purposely or knowingly caused bodily injury to Destin Benford, an adult male human being, with adeadly weapon, to-wit: a shoe, by kicking him in the head with such shoe, which
