A regular session of Troy City Council was held Monday, February 2, 2015, at 7:00 p.m. in Council Chambers.
Members Present:
Clark, Heath, Kendall, Oda, Phillips, Schweser, Snee and Twiss.
Upon motion of Mr. Kendall, seconded by Mr. Schweser, Mr. Tremblay was excused from this meeting by
unanimous roll call vote.

INVOCATION : The meeting began with the Pledge of Allegiance. An invocation was given by Mr. Heath.
MINUTES: The Clerk gave a summary of the minutes of the January 20, 2015, meeting of Troy City Council.
There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr.
Twiss, to approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS:
Community and Economic Development Committee: Mr. Twiss, Chairman, reported that Committee
recommends Ordinance No. 0-1-2015 be adopted to provide for the rezoning of the 40 parcels that make up the
site at and adjacent to 600 W. Main Street, known as the former Hobart Brothers/ITW factory site and two parking
lots, from M-2, Light Industrial District, to OC-1, Office-Commercial District.
Report signed by Kendall, Schweser and Twiss.
Recreation & Parks Committee: Mr. Heath, Chairman, reported that Committee recommends legislation be
prepared authorizing the Recreation Board to enter an agreement with Crossroads Consulting Services for a
feasibility study related to a second sheet of ice at the Hobart Arena, at a cost not to exceed $50,000.

CITIZEN COMMENTS:
-Cynthia Scheafer, 26 Y:! N. Short Street, was advised that Crossroads Consulting is located in Florida. She
commented that she has talked to people who support the second sheet of ice and who do not support closing
the Market Street Bridge (for the Strawberry Festival).
-Lester Conard, 1210 S. Clay Street, suggested the rezoning committee report could have said no one spoke for
the rezoning. He also gave his opinion that the City pays too much for consultants and staff could do the work
of consultants. Mr. Titterington advised that the consultants have expertise in specific areas and can advise the
City as to the economic feasibility of an investment such as a second sheet of ice, including partnerships to fund
the cost if that is the recommendation.

COMMENTS OF THE MAYOR:


Mayor Beamish commented that the new class of Leadership Troy members started their program the past
week.
COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY:
Mr. Titterington commented that City offices will be closed February 16 for the Presidents Day Holiday.
COUNCIL COMMENTS:
-In response to Mr. Phillips asking if there is an update on three traffic light locations identified for possible
removal, Mr. Titterington commented that the one at Cedar and Main is not now scheduled for removal, but two
others are still under consideration.
-In response to Mr. Phillips regarding the trial LED street lights, Mr. Titterington commented that information is
still being evaluated for the trial in Troy and a few other communities to determine if the lights are cost effective
and provide good lighting.
-Mr. Clark stated he was excited about the future development of the former Hobart Brothers/ITW factory site on
W. Main Street.

There being no further business, the meeting adjourned at 7: 18 p.m.

This Committee met on February 10. A petition has been filed with the County for the annexation of 1.243
acres in Concord Township to the City of Troy. This parcel, owned by S. Howard Chaney is located off Peters
Road. At least 20 days prior to the County's public hearing on an annexation, the City is required to adopt a
statement indicating what services the municipal corporation would provide to the territory proposed for
annexation. Such services are those provided to any parcel within the City. The County's hearing on the
annexation is April 7.
RECOMMENDATION: (To be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared approving the standard statement of
services related to the Cheney Annexation.

DETAILED REPORT:
This Committee met on February 10, 2015, to consider recommending approval of the standard statement of
services to be provided to the Miami County Board of Commissioners regarding the recently filed Cheney
Annexation. The meeting was also attended by Council President Baker, the Director of Public Service and
Safety, and members of the City staff.
A petition has been filed with the Board of Miami County Commissioners for the annexation of 1.243 acres in
Concord Township. The parcel is located off Peters Road. The petitioner/owner is S. Howard Cheney, and the
agent for the petitioner is William J. Fulker. The Board of County Commissioners is the entity that holds a public
hearing on a proposed annexation. The public hearing has been set for April 7. At least 20 days prior to that
hearing, the City is required to adopt a statement indicating what services the municipal corporation will provide to
the territory proposed for annexation. Such services are those provided to any parcel within the City. Adopting
the statement does not provide consent to the annexation. The standard statement of services is attached to the
report.
If the County proceeds to approve the annexation, documents would then be forwarded to the City.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared approving the standard statement of
services related to the Cheney Annexation.

The Ohio Revised Code requires that a municipal corporation shall adopt, by ordinance or
resolution, a statement indicating what services the municipal corporation will provide, and an
approximate date by which it will provide them, to the territory proposed for annexation, upon
annexation. Under the ORC Section that the Cheney Annexation was filed, the statement of
services must be approved by Council and filed with the County not later than 20 days prior to
the public hearing before the Board of County Commissioners.
Such statement is as follows:
That immediately upon the effective date of the annexation of the 1.243 acre territory,
the City of Troy, Ohio will provide to the entire annexed territory such services as are
otherwise provided to incorporated areas under the Code of Ordinances of the City of
Troy, Ohio in accordance with applicable contemporary law, practice, custom,
regulation, rates and resources. The services of the City of Troy currently include, but
are not limited to: police, fire, emergency medical service, refuse collection, repair and
maintenance of publicly dedicated streets, access to existing municipal sewer and water
lines, municipal zoning, municipal parks, municipal recreation, and general municipal
government.

This Committee met on February 2 to consider recommending the Resolution of Necessity for the Streetscape 3B project. This
project includes both sides of E. Main Street from Walnut Street to Mulberry Street. The current estimated cost of the project is
$575,000, and includes sidewalk and curbs, the paver brick design to the extent possible, underground utilities, light poles, and
other aesthetics identified as part of streetscape. $300,000 of the project cost will be funded by an ODOT grant. Estimated to be
assessed to property owners related to the sidewalk work is approximately $64,000. Those property owners will also be able to
present issues or questions related to the sidewalk work to an Assessment Equalization Board.
RECOMMENDATION: (To be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared authorizing the Resolution of Necessity for the
Streetscape 3B project.

Streets & Sidewalks Committee
DETAILED REPORT:
This Committee met on February 2, 2015, to consider recommending the Resolution of Necessity for the Streetscape 3B project.
The meeting was also attended by Mayor Beamish, Council President Baker, Council Members Clark and Kendall, the City
Auditor, members of the City staff, and a citizen .
Streetscape 3B includes both sides of E. Main Street from Walnut Street to Mulberry Street. Project elements include
replacement sidewalk and curbs, the paver brick design to the extent possible, underground utilities, light poles, and other
aesthetics identified as part of this program. The current estimated cost of the project is $575,000. $300,000 of the cost will
be funded by an ODOT/MVRPC grant. Some of the cost will be paid through the City's utility funds, approximately $64,000 will
be assessed to the benefitting property owners for sidewalk related work, and the balance of the project paid from the fund
balance of the Capital Improvement Fund.
With the design nearly completed and submitted for ODOT approval, the next step is for Council to approve the Resolution of
Necessity for this project, so that the property owners can be advised of the estimated sidewalk assessments. We were advised
that Council may also need to establish an Assessment Equalization Board (AEB) in the future to hear issues raised by the
property owners, with any recommendations of the AEB provided to Council for consideration . These are steps that must be
accomplished ahead of bidding the project early in May so that the City can meet the ODOT requirement that a contract is
awarded in June (with construction after the Strawberry Festival).
It was noted that the property owner portion has increased, but that estimate was made prior to the design being nearly
completed . Because of all the elements of this project, and the need for a finished streetscape with common appearance, a
property owner is not permitted to contract with other than the successful bidder to do the work. However, the property owners
may also present concerns to the AEB. Once the project is completed, and property owners advised of the final assessments,
those owners may either pay the entire amount or have it assessed to taxes over five years, plus any fee included by the County
for handling the assessment.
John Wilson, one of the property owners in the project area, commented that property owners have recently been improving this
area and he encouraged Council to consider some other way than assessing property owners for the sidewalks.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared authorizing the Resolution of Necessity for the
Streetscape 3B project.

.--r---RESOLUTION DECLARING THE NECESSITY


OF CONSTRUCTING SIDEWALKS IN THE CITY
OF TROY. OHIO

WHEREAS, the Council of the City of Troy has previously determined that sidewalk repair is a
priority item for the City has had determined to proceed with this continuing project; and
WHEREAS, this Council has endorsed the proposed plan for the sidewalks and streetscape
renovation on East Main Street between Walnut Street and Mulberry Street in Troy, Ohio, known as the
Downtown Sidewalk Program , Phase 38.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City ofTroy, Ohio as follows:
SECTION I:

That this Council declares the necessity for such improvement.

SECTION II:

That the Downtown Sidewalk Program, Phase 38 shall consist of a sidewalk

renovation and streetscape renewal on East Main Street between Walnut Street and Mulberry Street,
located in Downtown Troy, Ohio and that the attached Exhibit A stated the lots of land to be assessed
for the improvement.
SECTION Ill:

That the costs paid by the City of Troy shall be the cost of handicap ramps,

strain poles, traffic signals, public electrical supplies, public utilities, curbs, intersection improvements,
pavement improvements, street lighting, pedestrian signals, landscaping, benches, and comer parks.
which is equal to or greater than one-fiftieth of the cost of the Downtown Sidewalk Program, Phase 38
project.
SECTION IV: That the cost that shall be assessed to be paid for by special assessment to the
adjacent property owners shall be the cost of sidewalks (less the cost of Intersections), downspout drain
connections, private water services, and subspaces filled or renovated with private subspace access
doors.
SECTION V:

That the method of levying the special assessment shall be in proportion to the

benefits which may result from the improvements.


SECTION VI:

That payment of such assessment shall be made in a lump sum payment to the

City of Troy within thirty (30) days of the published notice of the passage of the Assessing Ordinance in
accordance with the law.

If payment is not made within such time as stated for lump sum payment,

such assessment shall be certified to the Auditor of Miami County for concurrent collection with property
taxes as assessed by said Auditor (total number of payments not to exceed ten over a five year period .
SECTION VII:

That securities will not be issued by the City of Troy in anticipation of the levy

or collection of these special assessments.


SECTION VIII:

That the Director of Public Service and Safety of the City of Troy, Ohio, is

hereby authorized to cause to be prepared an estimated assessment in accordance with the method of
assessment against each lot or parcel of land to be assessed and shall be filed in the Office of the Clerk
of Council upon its completion, and kept available for public inspection.
SECTION IX:

That upon the filing of the estimated assessments, the Clerk of Council is

hereby directed to cause notice of the passage of this Resolution and of the filing of the estimated
assessment to be served on the owners of all lots and lands to be assessed, as provided by law.
SECTION X:

That this Resolution shall be effective at the earliest date allowed by law.

Major Project Update:


o Sidewalk Program 8 - work will continue through the winter and is slated
for completion in the spring of 2015.
o North Market Street/Piqua-Troy /Troy-Urbana Intersection Realignment the roadway is open; however, the reconstruction of Troy-Urbana Road
will be completed in the spring of 2015.
Please be careful when
traversing the intersection.
o Barnhart Road, Arthur Road, Oak Street, Scott Street & Frank Street
Waterlines - restoration is complete along Scott and Frank Streets. Oak
Street and Barnhart/SR-718 work will begin in the spring of 2015.
o Adams Street Phase 2 - stone portion of the Community Park wall is
complete, and the railing will be installed in the spring. The bike path
modification of a new bike path access ramp, which is being added to the
west side of Adams Street, received approval from the Miami Conservancy
District.
o Finsbury Lane, Riverside Drive and Race Drive Waterline - Finsbury Lane
directional drill was completed. The waterline north of Finsbury is
installed and being tested, and the waterline from Governors Road to west
of the CSX railroad is installed. The jack and bore went well.
o Sewer Lining Project - contractors are lining the SW Interceptor between
Peters Road and Southview subdivision. Manhole replacements and
various lining work will occur at the Public Square beginning on February
23rd. Public Square traffic will be maintained, but quadrant parking will
be limited. Businesses and residents were notified of the proposed work.

Attached is a copy of the Snow and Ice Removal Expenses report through
February 10, 2015. To date the City has used 481 tons of the salt supply and
the total cost is $48,767.71.

As a reminder, City Offices will be closed on Monday, February 16 in


observance of the Presidents' Day holiday. Trash collection and curbside
recycling will be on schedule. Council will meet on Tuesday, February 17 at
7:00 p.m.

Fire Chief Christopher Boehringer has announced his retirement effective


March 7 after over 24 years of service. Chief Boehringer began his career with
the City of Troy in July of 1981 as a Police Officer. He resigned in August of
1984, and then came back to the Fire Department as a Firefighter in January of
1994. He was promoted to Assistant Fire Chief in July of 2000, and Fire Chief
in December of 2006.

Recreation Director Ken Siler reports that the Tesla Concert on February 7 was
a sellout. Ticket sales for both the February 13 and February 14 concert are
going quite well.

As a reminder, spring clean-up at Riverside Cemetery begins on March 1. All


old, deteriorated, or noncompliant decorations (either on the ground or on
monuments) will be removed by cemetery personnel. New decorations may be
placed starting April 1, 2015.

The annual Spring Neighborhood Clean-up Week will take place April 13
through April 1 7. This will be when residents are permitted to exceed the five
container /bag limit.

Street - Including Solid Waste - Jerry Mullins, Foreman
Collected and transported 199 tons of residential trash since the last report of
222 tons.
Collected over 803 Christmas trees and transported them to the Miami County
Transfer Station for free disposal/recycling. The free disposal ended on January
30, 2015.
Delivered recycling bins as requested.
Salted and plowed for snow and ice events. We currently have around 550 tons
of salt left for the winter season.
Sign shop worked on various sign projects.
Installed the new solar powered Big-Belly trash/recycling receptacles on the
Public Square.
Cleaned and maintained snow equipment.
Brined for the weekend snowstorm.
Replenished the brine storage tanks. We currently have 10,000 gallons of brine
ready for distribution.
Assisted Hobart Arena with stage set-up for weekend concerts.
Swept the street during the warming trend.
Electrical - Brian Ferree, Foreman
Completed Ohio Utilities Protection Service requests as needed.
Repaired several outside lights at the Maintenance Facility.
Made several repairs at Hobart Arena which include:
o Repaired the light at the front of the building.
o Repaired several lights on the roof.
o Replaced two electrical outlets in the hallway.
Repaired the inverter outlet on Water Distribution's step van.
Replaced a couple of GFCI outlets at Fire Station 1.
Continued to repair the mini-lights on the trees in the downtown area.
Water Distribution/Sewer Maintenance - Tom Parsons, Foreman
Marked numerous Ohio Utilities Protection Service tickets.
Investigated numerous high consumption alerts.
Completed a number of work orders for Billing and Collection.
Shut-off non-payment customers and reconnected as payments were made.
Repaired main breaks on Mayfield Court, North Road, and also on Maple Street.
Upgraded water service at a residence on Peters Road.
Filled and flushed a new line from North Market Street to Shaftsbury Road.
Investigated sewer lines at the old Hobart Brothers site on West Main Street.
Checked a sewer backup at a residence on West Ross Street.
Cleaned and salted downtown sidewalks in front of City facilities in the
downtown area.

Water Treatment Plant - Jeff Monce


For the period of January 2015, the WTP pumped a total of 117.8 million gallons
(MG) to our distribution system and customers in West Milton and parts of
Miami County (avg. 3.80 MG/day). Total precipitation recorded at the WTP for
January was 2.38". Respective totals for January in previous
years are:

Well 17 cleaning has been completed, and the pump and motor have been taken
to our vendor for evaluation and repairs. The spool piece and drop piping were
found to be deteriorated, and have been identified as the cause of control cabinet
flooding that occurred at this site on January 22. Faulty steel column piping will
be replaced with 73' of flexible, long-lasting Boreline hose. A new pitless adapter
spool piece has been ordered. Cleaning, inspection and maintenance on
production wells is usually performed every five years. Well 17 has been in
operation since 1992.
A five hour Electrical Safety - Arc Hazards training seminar was conducted at the
on February 3. Six staff members attended, along with three electricians and the
WWTP staff.
Automatic controls for the C0-2 tank vaporizer failed on Sunday February 1.
Operator Kenny Morgan detected critically low tank pressure at 10 a.m. City
electricians were able to bypass the control system and restore manual operation
of the tank by late afternoon. A new automatic control system is being quoted
through several vendors. The defective control system was original equipment
that had been in service for over forty years.
New 6" and 8" plug valves for the wash water tank supply lines have been
received and will be installed next week by WTP maintenance and Water
Distribution staff. These valves will replace the original valves that were installed
in 1971.
A total of 8, 186,767 gallons were pumped to the Extra High Service pressure
zone during the month of January, for an average daily consumption of .2729
MG.
6 bulk water account holders withdrew a total of 27, 190 gallons during the
month of January, total revenue was$ 333.75.
Periodic problems with the Air Stripper transfer pumps continue, and are being
investigated.
Wastewater Treatment Plant - Tim Snider
Forwarded response to OEPA concerning the Annual MIPP onsite inspection.
Staff working on the installation and setup of the Senexus software for industrial
pretreatment data management.
Vendor was on site to replace a faulty seal on the primary sludge #1 actuator
valve.

Vendor investigated replacement for faulty central command module on teacup


#2 actuator valve.
Staff attended Arc Flash Training on February 3.
Worked on the Request for Proposal (RFP) for biosolids management agreement.
Working on the RFP for engineering services for screw pump #1 - #4
replacement.
Staff completed the required preventive maintenance work orders.
Average Daily Effluent Flow for January was 4.62 MGD.
Average Daily Effluent Total Suspended Solids for January was 6.9 MG/L with
94.52% removal efficiency.
Average Daily Effluent C-BOD5 for December was 8 .25 MG/L with 95.72%
removal efficiency.

I have attached two reports which summarize concerns that are being
addressed by the Planning Division from January 28, 2015 to February 11,
2015. The first report shows all permits that were issued by the Planning
Division. The report contains the address and type of permit and separates
the information by each ward. There were 20 permits issued during this
time period.
The second report contains the address, type of concern, and a summary of
the current status of on-going issues. Both open and closed concerns are
listed and are separated by each ward.
As in the past, all costs associated with the removal of trash and elimination
of noxious weeds will be invoiced to the property owner. If the property
owner does not pay the invoice, the cost will be assessed to the property
taxes.
