PROBABLE CAUSE STATEMENT
I, Det. Paul Barish-276, with The St. Peters Police, a law enforcement agency, state the facts
contained herein are true to my best knowledge and belief and that any false statements made are
punishable by law.
1. On 11-22-14, ataé Forrel Tree Court, in St. Charles County, MO, Devin M. Gesell Dob: 11-03-
97 did commit the crimes of: 2" Degree Burglary and Stealing Over $500.00.
During a custodial interview, Gesell admitted to being with two juveniles as they unlawfully
entered into a residence. Entry to the residence was gained by one of the juveniles breaking the
lass out of a rear door, unlocking it, and entering into the residence. While inside, Gesell stated
that he acted as a lookout while the two juveniles acquired items. He stated that he witnessed
them steal jewelry, prescription medications, an Xbox 360 game system, and Xbox One game
system, cash, and the ashes/remains of the victim’s father.
Victim D.M. reported jewelry (necklace valued at $500.00), an Xbox One game system (valued
at $499.00), and Xbox 360 game system (valued at $250.00), a Microsoft Surface Pro tablet
(valued at $800.00) 3 prescription bottles containing Oxycontin pills, 2 prescription bottles
containing Oxycodone pills, One prescription bottle containing morphine pills, $825.00 in cash,
and the ashes/remains of her deceased father.
‘The Xbox 360 was recovered while in the possession of Gesell and that he received $90.00 of the
stolen cash, He stated that the bag of ashes/remains was discarded after they realized that it was
not cocaine. He was unsure about the location of the remaining stolen items.
2. DRUG CASES ONLY: The lab report confirmed the substance to be N/A and weighed N/A.
3. have reasonable grounds to believe that the defendant will not appear upon the summons or
is a danger to the crime victim, the community or any other person because:
