Kindly refer to the orders passed by the Hon’ble Supreme Court of India in CWP No. 309 of 2003 and Hon’ble Punjab and Haryana High Court orders in CWP No. 6384 of 2001 read with the Govt. of Haryana constituted State and District level Committees for Slaughter Houses and Haryana Municipal Corporation Act, 1994, Haryana Municipal (Regulation of sale of meat) Bye-laws, 1976 with Haryana Municipal Corporation (Regulation of Slaughter Houses) Bye-laws, 2008, Solid waste management in slaughter houses, Food Safety and Standards Authority of India (FSSAI) instructions dated November 14, 2014, where as undersigned is a non official member of the State Committee for Slaughter Houses, Department of Urban and Local Bodies (Govt. of Haryana), received complaints that illegal meat shop cum slaughter houses are working in Gurgaon, slaughtering animals without compliance of the Prevention of Cruelty to Animals (Slaughter Houses) Rules, 2001, violating section 3 and 11 of the Prevention of Cruelty to Animals Act. 1960 read with the FSSAI guidelines and animals and birds are being brought to the illegal slaughter houses, violating the Cattle Transport Rules, 1978 amended in 2001 read with the section 94 of the Haryana Motor Vehicles Rules, 1993. It would also be pertinent to mention here that Hon’ble Supreme Court of India passed orders dated 27-8-2013 about animal transportation read with observations about stunning process of slaughtering and Food Safety and Standards Authority of India (FSSAI) also endorsed same process in their instructions dated 14-11-2014.
Whereas Today we have received complaint that many illegal slaughter houses are functional, local police assistance was called by Sudershan Kaushik, Honorary Animal welfare officer of AWBI, in the presence of local Additional SHO, Labour Inspector was also called to check child labour and FSO to check cooked meat in the hotels.
Following person were found along with their poultry birds at their illegal meat shop cum slaughter houses:
1. Irshad son of Ajeej, Shakeel Halali meat shop, Naharpur birds rescued 4.
2. Jaan Mohammed son of Shabir Ali, 10 birds.
3. Khaleel Khan son of Abdul Haq, 4 birds.
4. Mustafa son of Harun, 11 birds at Mustaffa Malik Halai Meat shop.
Above animals and poultry birds are not fed well, ill-treated and sick, not fit to slaughter, died due to cruelty, hence the custodians of these animals and birds are violating the section 3, 11, 38 of the Prevention of Cruelty to Animals Act, 1960 read with the 188, 428-429 IPC, section 338 (4) of Haryana Municipal Corporation Act, 1994 and FSSAI directions dated November 14, 2014 with the FSS (Licensing and Registration of Food businesses) Regulation, 2011 and FSS (Prohibition and Restriction on sales) Regulation, 2011 / Rules and Regulations framed by the Govt. of Haryana, as stated above along with different sections of the Prevention of Cruelty (Slaughter Houses) Rules, 2001, where as naturally dead fish also been offered, for human consumption, which is prohibited.
The Deputy Director of Animal Husbandry, to be informed for medical examination and then these animals can be handed over to any Infirmary, as per section 35 of the PCA Act, 1960 for further treatment, care and shelter during court trials. It would also be pertinent to mention here that SPCA, Gurgaon also be asked to look after these rescued animals and poultry birds.
