Re:

Whether or not the previous service of an


optionally retired government employee shall be
considered in the computation of the retirement
benefits when he compulsorily retires after his
reinstatement in the government service.

Dear Atty. Panes:


In reply to your above-captioned query, this level is of the
considered view that the previous service of LGOO V Juan Jayme may
be considered in the computation of his retirement benefits due to
compulsory retirement for as long as he refunds in full all the benefits
he received under RA 6683 (Early Retirement/Voluntary Separation
Law).
The payment in full of all the benefits received under the said
retirement program is further clarified under Item 8.1 of the Joint DBMCSC Circular No. 89-1 dated 31 January 1989 (Civil Service Resolution
No. 90-]879, 30 September 1990, copies of which are hereto attached
for reference.].
