PETITION
PETITIONER, thru undersigned counsel unto this Honorable
Court, most respectfully alleges, that:
1) Petitioner is of legal age, Filipino, married and with
residence and postal address at Lot 17 Blk 6 Mabuhay
Street, Sampaloc, Manila City:
2) The Petitioner is the registered owner of a certain parcel of
land located in the above address and as evidence by
Transfer Certificate of Title No. 5479 of the Register of
Deeds of Manila City which is more particularly described
as follows:
A parcel of land (Lot 17 Blk 6 of the cons, subd. planPcu
13-00007, being a portion of the cons of Lots 1,2,3 Blk 9,
Pcu-09-000267, Lot 114-1, Rcd 2848, LRC Rec No. 1037)
situated in the Manila City.

of Title is hereto attached as AnnexesA and made integral
part hereof;
3) On September 6, 2012, herein, petitioner mortgaged the
above described real property with Banco De Oro in the
amount of P200,000.00. That the amount of mortgaged
was paid by petitioner as evidence by the attached copy of
cancellation of mortgage which is hereto attached as
Annex A hereof;
4) That by virtue of the full payment of the mortgaged
amount and the Cancellation of Mortgage duly executed by
the Mortgagee bank, petitioner wanted to have the
encumbrance to be cancelled at the bank of the title above
described real property.
PRAYER
WHEREFORE, premises considered, it is most respectfully prayed
of this Honorable Court that, in light of the foregoing consideration,
judgment be rendered after hearing, that;
a. Cancellation of encumbrance in the Certificate of Title No.
5479 be cancelled under Section 7 of R.A 26.
b. Ordering the Register of deeds of Manila City to cancel the
encumbrance on the said Certificate of Title.
OTHER REMEDIES that this Honorable Court may consider to be
just and equitable under the premises are likewise prayed for.
