A RESOLUTION AUTHORIZING THE EXECUTION OF A PROPOSAL, FROM K-PLUS ENGINEERING FOR THE STONY CREEK EAST BRANCH DRAINAGE BASIN STUDY WHEREAS, Section 6(a) of Article VII of the 1970 Constitution of the State of Ilinois provides that any municipality which has a population of more than 25,000 is a home rule unit, and the Village of Oak Lawn, Cook County, Illinois, with a population in excess of 25,000 is, therefore, a home rule unit and, pursuant to the provisions of said Section 6(a) of Article VII, may exercise any power and perform any function pertaining to its government and affairs, including, but not limited to, the power to tax and to incur debt; and WHEREAS, the President and Board of Trustees believe and hereby declare that it the best interest of the Village and its residents to approve the Proposal from K-Plus Engineering, for the Stony Creek East Branch Drainage Basin Study (“the Proposal”) in substantially the form attached hereto as Exhibit 1; and NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK LAWN, COOK COUNTY, ILLINOIS, IN THE. Raymond Avenue Oak Lawn, TL 60453 Re: Proposal: Stony Creek East Branch Drainage Basin Study Dear President Bury: K-Plus Engineering is pleased to submit to the Village of Oak Lawn a proposal for an in depth analysis of stormwater and drainage impacts and solutions for addressing stormwater for areas tributary to the Stony Creek East Branch, Historically this area has been prone to flood conditions that have affected the health and well being of the community. ‘The purpose of this investigation is to take regional drainage studies and apply them at the local level to provide an in depth analysis of impacts at the local level, value engineer and determine alternatives to alleviate the stormwater drainage concerns providing immediate benefit to the Village, and provide a basis to carry the project into design then eventually construction. Scope of Work The project would entail several steps from start to finish assuring that all aspects are covered. The initial steps would be meeting, gathering information, analyzing data, determining local economic and safety impacts, establishing alternatives to address drainage, preparation of a report of findings, meeting with entities outside the Village that are impacted, and ultimately final delivery of the report. A detailed breakdown is as follows. + Kickoff Meeting: The kickoff meeting would entail Village staff meeting with K-Plus Engineering staff to discuss base information that is needed to fully evaluate the conditions and the additional items that will be needed to carry out the drainage report. The first meeting would be with the Village to obtain historical Village records, access to GIS data, and historical plans and documents that are pertinent to the success of the project. A second meeting would be setup with the MWRDGC with the desire of obtaining computer modeling from the regional study during the development of the Detailed Watershed Plan for the Calumet-Sag Channel Watershed. The next step will be obiaining the necessary files and examining the data collected, The data would be filed and reviewed to determine where additional resources may be necessary. The review process would include examining Village atlas’s, flood damage records, historical reports, plans, and field visit to verify findings. © Preliminary Hydraulic Analysis: This would be an analysis of previous stormwater ‘models. This would be used to determine the detail that was used and establish the base needs for the area to alleviate the concems. Basic information would be added to the model that would provide the beginning of the development of the alternatives that could be used. The analysis would examine stormwater conveyance modifications and addition of detention areas. This will be addressed by examining multiple alternatives that could be implemented © Alternative Analysis: During the development of the alternatives we would take the initial preliminary hydraulic baseline information and determine the best locations to apply the means and methods to reduce stormwater impacts. ‘The alternatives would develop the 3 best alternatives for addressing stormwater drainage taking into account local infrastructure, areas of excessive flooding and economic impact, safety, and costs associated with the alternatives, ‘© Property Impact Analysis: The property impact analysis will be a thorough detailed ‘examination of flooding in locations and the costs, concerns, and impacts it has on the ‘community. The impact analysis will compare the existing conditions with the alternative options illustrating the benefits to be realized for each alternative. ‘© Meetings & Coordination: Throughout the project communication with the Village will be vital. K-Plus views projects as a partnership with our clients and we will keep the Village informed of the progression of the project at all times. K-Plus will provide the Village with formal monthly updates of the project status along with regular informal emails, calls, and meetings. In these updates there will be an overview of upcoming events and/or needs for the projects so that a steady flow of information is occurring between the Village and K-Plus. We anticipate there will be public and private meetings with the Village. Meetings will be necessary with other entities directly involved that may include the MWRDGC, IDOT, Village of Alsip, City of Chicago, the Archdiocese, and residents or business owners. Page: 63 President Sandra Bury May 5, 2015 Page 3 of 5 + Final Hydraulic Analysis: The final analysis will entail the merging of the alternatives property impacts, costs, information gathered from meetings, records, and reports. The information will be used as the basis for the report. © Preliminary Report: ‘The preliminary report will discuss the findings and results from the Final Hydraulic Analysis. The report will have charts, images, exhibits, associated costs, summary of the hydraulic analysis and impacts. As with the earlier steps in the development of findings K-Plus will regularly run through the project with Village staff. During the preliminary report phase K-Plus will provide an electronic copy and 4 draft copies of the report (o Village staff to review. © QA/QC Review: Accuracy of findings is extremely important to K-Plus, as well as to our clients, We implement a system of regular project checks and reviews during the project examining the data to ensure that it is practical and will provide the intended results. The project will have a thorough review during the analysis phases, and during the preliminary and final report. Along with weekly and in some cases daily smaller calculation checks. © Property Appraisal: The project will also include a property appraisal for land acquisition purposes for approximately 110 acres of potential archdiocese property. © Finalization of Report: The report will be finalized after review with the Village, During this step the report will go from 30-50% to complete. Preparation of presentation materials will be prepared and summary of findings for project delivery. * Project Delivery: Project delivery will include a paper copy of the report for all Village Board Members (7), 5 copies for staff, and an electronic copy of all documentation wi be provided on CD’s at the end of the report for Village records. K-Plus will present the results of the report and provide a presentation to the Village at a designated Village Board mecting, Schedule Upon receiving authorization and notice to proceed from the Client, K-Plus will begin services immediately. Attached is a copy of our standard terms which are an integral part of this Agreement. Page: 66 e Terms & Conditions January 2015 K-PLUS ENGINEERING, LLC The following Terms and Conditions are incorporated into this AGREEMENT made and entered ino by and between K-Plas Engineering, LLC, an Ilinois limited liability company, hereinafter refered to as "K-Plus", and the party identified in the proposal and hereinaler refered to as "Client" WITNESSETH: ‘+ WHEREAS, Client desires K-Plus t perform the Service as hereinafier defined in accordance withthe terms and conditions set forth herein ona going forward basis; ‘+ WHEREAS, the parties desire to enter into this Agreement to allow for K-Plus to perform Services for Client with the scope of such services determined as the parties agree after this Agreement but incorporating the terms of this ‘Agreement; and ‘s WHEREAS, each party hereto represents that itis ready, willing and able to undertake the responsibilities set forth in this Agreement, NOW, THEREFORE, in consideration of the premises ‘and the mutual covenants herein contained and other good ‘and valuable consideration, the receipt and sufficiency of, which is hereby acknowledged, the parties agree as follows: 1. Definitions. As usod in this Agreement, the following terms shall have the meanings hereinafter set forth: ‘A. “Agreement” means this document, together with all documents attached hereto and Work Orders as, issued after the date of this Agreement. The ‘Agreement and all documents incorporated therein fare intended to be construed consistently and as a whole, and anything that is required by one document shall be deemed tobe required by all. B. "Fee Schedule" means K-Plus charges for professional services and reimbursable expenses, which shall be updated ftom time to time and deemed incorporated, as revised, into this Agreement, C. "Services" means those services to be performed by K-Plas pursuant to the ferms and conditions of this Agreement. D._ "Site" means the site upon which Services ae to be performed as designated in the Work Onder. Ifall or a pottion of the work required by a Work Order required work upon more than one (1) location, the lcations upon which the work is to be performed shall bo collectively refered to as the “Site”. E. "Work Order” means a document or proposal describing work requested of K-Plus by Client that identifies the Client and the ite, defines the specific scope of Services, and includes, as appropriate, cost estimates, plans, and drawings. F. “Work Product” — means all opinions, correspondence, notes, reports or other documentation created by K-Plus pursuant to this Agreement 2, Services ty be Performed. Al Services performed under this Agreement shall be detemined by a Work Order, K-Pls, a an independent contactor, shal furnish all necessary supervision, labor, materials, and equipment and shall perform the Services as defined in each Work Order. A Work Order, when accepted by K- Pius, shall be binding upon the parties hereto, shall detail the scope of Services to be performed by K-Pls and shall be deemed to incorporate all the tems and conditions of, this Agreement, Where the scope of Services is nat suiciently denied allow K-Plus to complete « Work Oréer or is deemed by K-Plus to require additional information, K-Plus stall have the right but not the obligation to infer such services as reasonably necessary to complete the Work Order and shall be ented to reasonable compensation for any additonal consideration required, ll Work Orders shall be executed and dated by both K-Plus and Client, and K-Plus shall eommence the Services as stipalated and agred upon inthe Work Order. ‘Any Work Orders issued following the execution of this ‘Work Order associated withthe soope of work in tis Work (Order shall incorporate the tems and conditions of this Work Onder even if said proposal, estimate, or contact makes no specific reference to these rms and conditions. 3. Term of Agreement. This Agreement shall become cffective upon the above mentioned date and continue in full force and effect unless written notice of termination is tiven by either party. However, at the option of K-Plus, termination of this Agreement by Client shall not be ‘effective with respect to Work Orders accepted by the K- Plus prior to the termination of this Agreement. Further, if termination is for cause, the party seeking to terminate the Agreement shall specify in detail the basis forthe alleged default and the party accused of such default shall have seven (7) days to cure the default, If the default is not ccured then the party seeking termination shall have the right, to terminate the Agreement immediately upon issuance of a second written notice, CHICAGO .
