Short-term/One-Time:
The sale of the 12th Street Remainder Parcel is contingent on the Lake Merritt specific plan
being finalized, including the CEQA work
The LMSP is targeted to be complete/go to Council in October
The developer that the City has an ENA with for the land has been involved in the LMSP
process
The next step required would be for the developer to complete CEQA work on their specific
development proposal
o Staff is hoping it can be a supplemental CEQA, which would take 6-9 months
o If a full CEQA is needed, it would take 9-12 months
At the same time, staff will continue working with the developer on finalizing a DDA, which
is dependent on the CEQA approval
The DDA would then have to go to Council for approval before the sale could take place.
It is possible for this to happen by June 30th, but only if there are no hiccups, delays, etc., in
all of the above steps.
Gregory indicated that his staff are doing everything they can on the front end so the
process is as quick as possible once the LMSP goes through. I asked him to continue looking
for tasks that could be prepped or completed in advance to prevent delays on the back-end.
Gregory indicated he has spoken to Rachel about the urgency of the LMSP being complete.
Not sure if there is anything that can be done to speed it up at this point, but we should
continue to push for the October target.
Bottom line: Timeline is contingent on the LMSP and associated CEQA being complete and
approved AND bandwidth of limited CEQA consultants for the developers project.
Budget/CAO should prepare a contingency in case these steps are not met by June 30th
(Osborn and I spoke briefly after the meeting about this).

Discussed whether to allocate or appropriate the funds received from the Champion Street
Fire Station sale for this purchase to pay for a consultant and a LDA position to support the
work (to reside in Real Estate division).
The agenda item for Champion Street is being drafted now I advised to include a section
that suggested staff will come back to appropriate a portion of these funds for asset
management work, but there is concern that Council will be tempted to spend it on other
things if we dont recommend allocating to this project at the time of sale approval.

Please find attached the fully executed MASTER AGREEMENT FOR TAXING ENTITY COMPENSATION with the City of
Oakland (Compensation Agreement). Now that all of the taxing entities have signed the agreement, the City of Oakland
is able to fully implement projects on former Redevelopment Agency of the City of Oakland property. This was the final
requirement from the California Department of Finance for the Oakland Long Range Property Management Plan. If you

That is the full and complete legal description. The map contains all the courses and distances and this text
references exactly which map. That is the whole reason for a parcel map vs. a long and lengthy metes and bounds

I filled in some of the properties on the spreadsheet that I was able to recognize. I believe most of
the properties along the estuary are probably owned by the Port. Im copying James in Real Estate
since his section may recognize some additional parcels.

Take a look at this updated proposal. Please appraise the value of subsurface rights under the
park. They are looking into building a parking garage under the park. The city would sell
them and easement for either one time money or annual payments.
This is lower priority then the other things you are working on right now. Get to it when you
can.

Remainder Parcel and ways to appraise this.
Attached is their latest concept design for 24-story tower/265ft tall, 343 units, 167 parking. They are
proposing underground parking below the open space park parcel.

If City Council decides to go with Planning Commission recommendations, then, yes the Lake Merritt Blvd Apts
would be subjected to these new rules. This agenda item (i.e. approval of Lake Merritt Station Area Plan and
associated FEIR and related zoning changes) goes to the CED Committee on 10/28. Staff is finalizing that staff report
today. Staff will have to show in the report to Council how these tower regulations would apply to the Lake Merritt
Blvd Apts.
So, can you do me a favor and fill in what the measurements are for Lake Merrit Blvd Apts in table below?
Staff is also considering including data on the last 3 towers that were built downtown Essex Ellington, and 100
Grand to show howthose tower dimensions compare to the tower regulations that PC recommended.

These changes basically kill the financial feasibility of any towers for anywhere in Oakland. I am surprised
the Commission can be so naive.

First I want to thank you for the pace of your presentation. I presume you were going through
things at a slow, even pace so that the translators could follow your presentation but I also
appreciated it. I was able to follow everything you said whereas frequently the staff presentations
are delivered with such speed it strains the brain to keep up. I also thought the content was right
on, clear and just the right amount of detail. Perfectly presented. Thank you.
With regard to the Tower Design Standards I was referring to the October 5, 2014 communication
from OHA which had an attachment dated June 11, 2012 written by the Coalition. The table with
comparison data from Vancouver and San Francisco was in the Coalition letter and the
recommended heights I read into the record were actually in the OHA letter under item 2. on page
2.
I have a hard copy of Chris Buckley's wordsmithing comments on the Design Guidelines. see
attached for reference documents. If any of this does not come through clearly you could ask
Naomi or Chris for their originals. I meant to include Chris' piece under the category of No. 4
"authorize staff to make minor ongoing revisions ....." If you have a problem with some of what

We can prepare the deeds and have them delivered to you for signature in a couple of days once we
have the go ahead.
If we are preparing the deeds and PCORs as an accommodation only and Old Republic is not asked to
insure title the charge will be $545.00 which will include recording the deeds.
We will ask that the City send us instructions that Old Republic Title is recording the deeds as an
accommodation only and that no title insurance is to be issued.

Not sure if this is relevant. The site was used for storage and demo of concrete (affectionately
known as Mt. Crushmore) during 12th street construction and DD funds were used to fund those
operations. Additionally, the adjacent area was improved with the installation of the water quality
basin.

There are some issues regarding the 12th Street Remainder brought up by Counclimember Guillen
today, one of which impacts the land sale proceeds. Based on the strong community concern for
affordable housing, the Councilmember is proposing to allocate approximately $2 million of the land
sale proceeds to the Citys Affordable Housing Trust Fund. But we wont know if any funds are set
aside for affordable housing until the project is approved in Late April or May.

We should set a time, date and place for your community meeting in January.
I can help send out the meeting announcement to City listservs like last time. Announcement should
start going out at least 10 days before. I am thinking to prepare, we will probably need to have one
pre-meeting with your team and staff to strategize on flow of community meeting and anticipate any
difficult questions that might come up and maybe which City staff should be there to support you.
But for now, lets just figure out a good date in January. Note Jan 19th is a holiday and I am not
available January 22nd.

fence corresponds with points 13 and 14
at both pathways under the center of the vehicle bridge already covered by
points 38 and 39
(d) at the center of the north and south topside sidewalks of the vehicle bridge
points 36 and 37 cover the south topside but not the north side.
(e) at the center of the bicycle-pedestrian bridge yes, covered by point 40
(f) at the easterly portion of the passive park area adjoining the project yes,
covered by points 16 and 17
(g) at the public sidewalk fronting the project along E 12th Street
yes, covered by points 1, 2, 3, 4, 5

1. Is my above assessment about the wind points accurate? Which of the wind points
that DD is interested in, if any, do you think are not already covered by your study?
2. I know for CEQA review purposes, the standard for wind is that the building under
design not increase likelihood of winds exceeding 36 mph at a given point for more
than one hour during daylight hours. The DD Coalition is asking for exact wind speeds
before project and after project is this kind of information something the wind
consultant can provide?
3. Do you agree the shadow study already addresses what the shadow issues the DD
Coalition wants studied.
I would like to get your response to report to the DD Coalition at their Monday night
meeting (on the 17th). Basically, if what the Coalition is asking for are things that can
be studied but are not already adequately covered under our existing Scope and if the
DD Coalition insists on these items being studied, then I will recommend that
UrbanCore increase this Scope of work to ensure the final environmental report
addresses DDs concerns.

Tidal Marsh is a requirement of the City's permits with the U.S. Army Corps and the State

A record request can be made in any way (I.e. by phone, in writing, verbal, or Recordtrac system).
We recommend requesters use the Recordtrac system, but is is not mandatory. Once a request is
received, you have 10 calendar days to respond. If you need additional time, you may request if by
notifying the requester more time is needed and the reason why. At that point you have 10
additional calendar days added to the timeframe.

Thanks very much. If you have a copy of the appraisal and can easily provide it to him, please do so
right away without requiring a formal records request to be filed. Amber, if you want to put it in
RecordTrac for tracking purposes, thats fine. Technically we have 10 days to respond to public
records requests, but I always try to give the media the information they ask for at the absolutely
first opportunity I have to do so (the public, too whenever possible!).

The City of Oakland currently only has one Appraisal firm under contract. The
Company is Yovino Young Inc. out of Berkley. The appraisers were Peter Overton and
Michael Yovino Young.
I do not know what questions he has about the appraisal. If you want I can answer the
facts specifics like date of appraisal an conclusion.

I am looking for the date when the Redevelopment Agency purchased the following properties and
the purchase prices. Unfortunately most of these properties were mostly purchased with different
addresses and APNs and the Agency reconfigured the sites for development. Many were purchased
in the 1970s and 1980s. What ever information you can provide will be helpful.
City Center Address is 11th Street; 3 parcels, APNs are: 002-0097-038, 002-0097-039 & 002-0097040. This site was purchased a long time ago as various other parcels and then reconfigured into the
current parcels over 20 years ago.
822 Washington Street APN 001-0201-010-00. Surface parking for Victorian Row/Old Oakland. I
think the Agency has owned the parcel for over 30 years. I dont think it has been reconfigured but I
dont know for sure.
8th & Filbert Address 8th Street; APN 004-0007-001-01. I think this is a remainder from earlier

I am working on the long range property management plan and our files are missing some of the

Project Implementation was created from Neighborhood Investment, which in turn was created from
the remainder of the Redevelopment Division when redevelopment was dissolved by the State of
California. Project Implementation is principally tied to several post Redevelopment activities,
including 1) completing Oakland Redevelopment Successor Agency projects that are on the
Recognized Obligation Payment Schedule (ROPS); 2) implementing projects on future
development sites from the Long Range Property Management Plan; and 3) implementing projects
and programs from the Bond Expenditure Agreement/Bond Spending Plan in the
Broadway/MacArthur/San Pablo, Central City East, Central District and Coliseum Redevelopment
Areas. In addition, Project Implementation provides real estate service for all City departments.
The Challenges for Project Implementation are to continue implementing the various projects and
programs from limited funding. As the ROPS projects are completed, staff will be no longer
eligible to draw on the Redevelopment Property Tax Trust Fund and will need to obtain other
funding sources. Staff has identified the restricted revenue from the sale or lease of property under
the Long Range Property Management Plan and bond funds from the Bond Spending Plan as
potential future sources for staff costs.

Of the records this requester is asking for, I am only in possession of the RFP and 2 proposals
for the "12th St Remainder". I provided these records to requestor on Monday, including a list
that included two other RFPs (for development proposals on City Owned land) issued in 2014
- those are online.
However, she seems to be asking for other RFPs (for development on City-owned land) issued
between July 2011 and December 2014. I am not aware of those or in possession of those
records.

street deal but the buyer may not be able to close.

We met with the developer and investor for the 12th Street Remainder Project today. They have
committed to purchasing the site by the end of June if the project continues on its current schedule
This seems like a real possibility of happening this fiscal year. But we need to make sure that
everything moves according to this tight schedule and that the DDA is ready to sign soon after it is
approved.

Please note Plannings proposed delay in the approval of the Lake Merritt Specific Plan. If this delay
is allowed to occur it will undoubtedly delay the sale of the 12th Street remainder parcel past the
point that the City could not count on any revenue from this sale for FY 2014-15. Factoring in the
delay, the developer would have to conduct their CEQA review, have the property appraised,
schedule hearings for DDA, negotiate price and close the transaction in 4-5 months.
Ive also heard that an advocacy group is requesting that the developer not receive condo credits for
the project. Please not that any restrictions we place on the property will impact land value.

I wanted to make sure you were aware that at tomorrows Planning Commission hearing on the final
Lake Merritt Station Area Plan (and zoning), Rachel will be recommending extension of the public
hearing to a future date (yet to be determined). We are doing this, because we heard many
concerns from the community that they needed more time to review documents. This will mean
that final adoption hearings at City Council will also be bumped out, probably to sometime between
November and December, depending on the exact date selected for the continued Planning
Commission hearing.
Let us know if there are any timing considerations related to the Lake Merritt Blvd Apartments ENA
that we should keep in mind as we are making our recommendation for a new public hearing date.

Attached please find the revised write-up for the properties currently available to balance
budget. Please note that three of the properties were taken off the Excel list and the writeup. However, I have inserted the write-up for the three deleted parcels below for future
reference. The parcel at 1148 71st Avenue was taken off the list because it was not circulated
for the Surplus Land Circulation. Both the 615 High Street and 3801 East 8th Street parcels
were taken off the list because they were purchased through the 42nd /High Street Project
and will not be available until at least after 2018 when construction is finished.
Please also note that the write-up for the Champion Street parcels remains unchanged until
you hear back from City Council for further instructions. The Remainder parcel near 2nd
Avenue that is being sold to the developer had two different appraisal values. On the Excel
sheet, it was listed as $6,000,000 (I confirmed with the appraisal) and the information from
ORSA is $2,500,000. I put $6,000,000 in the write-up. Thank you.
