Registration of Trade Union


Under the Trade Union Act 1926, only seven or
more members of a trade union can be registered by
subscribing their names to the rules of trade union and
otherwise complying with the provision of this Act, apply for
registration. The application has to be made to the
Registrar of trade unions.

Particulars to be accompanied in the


application

The name, occupations and address of the members


making the application.

The name of the trade union and the address of its head
office.

The titles, names, ages, address and occupations of the


office bearers of the trade union,

Rules of the union provide for the


following matters

The name of the trade union

The whole of the object for which the trade union has
been established

The whole of the purposes for which the general funds of


the trade union shall be applicable

The maintenance of a list of the members of the trade


union and adequate facilities for the inspection thereof by
the office bearers and members of the trade union,

The admission of ordinary members who shall be persons


actually engaged or employed in an industry with which
the trade union is connected

The payment of subscription by members of the trade


union which shall be not less than 25 paise per month per
member

The manner in which the rules shall be amended, varied


or rescinded.

The manner in which the trade union may be dissolved.

Rights of a registered trade union

A registered trade union is a body corporate having a


perpetual succession and a common seal. It acquires a
legal personality separate from its members.

A registered trade union has a right to maintain general


funds and spend them for specified purposes.

A registered trade union can constitute a separate fund for


political purposes.

A registered trade union can represent workmen to the


works committee.

Liabilities of a registered trade union

To appoint only those persons as office bearers who do not


suffer from the disqualification prescribed under the Act.

To maintain books of accounts and the list of members.

To keep books and the list open for inspection by


members.

To submit annually to the Registrar of trade unions duly


audited statements of receipts and expenditure and assets
and liabilities.

To furnish correct information to persons intending to


become members.
