CONSENT SCHEDULING ORDER

Petitioner, Palmetto Products Pipe Line LLC ("Petitioner" or "Palmetto"), filed its
Petition on June 17,2015. Following service of the Petition, Respondents, the Georgia
Department of Transportation and Russell R. McMurry, Commissioner ("Respondents" or
"GDOT") filed an answer and transmitted the agency record to the Superior Court on July 17,
2015. The record was later supplemented on July 28, 2015. Three different motions to intervene
have been filed. Millhaven Company, LLC, Mills Tract, LLC, Susan B. Moseley, Alan B.
Zipperer, Janis Zipperer Bevill, Kathy Zittrouer, Henry S. Morgan, Pine Hope Holdings, LLC,
and Pollard Lumber Co., Inc. ("Landowner Movants") filed a motion to intervene on July 17,
2015. Colonial Oil Industries, Inc. ("Colonial Oil") filed a motion to intervene on July 20, 2015.
The Savannah Riverkeeper, Ogeechee Riverkeeper, Altamaha Riverkeeper, Satilla Riverkeeper,
and Center for Sustainable Coast ("Environmental Movants") filed a motion to intervene on July
28,2015. The Landowner Movants, Colonial Oil and the Environmental Movants are hereafter
collectively referred to as the "Proposed Intervenors." Palmetto intends to oppose the Proposed

Intervenors' motions to intervene, although it has no objection to their submitting briefs as amici
cunae.
Counsel for Palmetto, GDOT, and the Proposed Intervenors have conferred regarding an
appropriate schedule for further proceedings in this case. They propose, and the Court hereby
adopts, the following schedule:
1.

Palmetto and GDOT will file any responses to the Proposed Intervenors' motions

to intervene on or before August 28, 2015.

2.

Palmetto will file an opening brief on the merits of the Petition on or before

September 3, 2015.
3.

The Proposed Intervenors will file any reply briefs in support of intervention on

or before September 18, 2015.

4.

GDOT will file any brief on the merits of the Petition on or before October 5,

The Proposed Intervenors will file any proposed brief on the merits of the Petition

6.

Petitioner will file any reply brief on the merits of the Petition on or before

The Court will hold a hearing to address the motions to intervene and the merits
