We agree with former Victorian Premier John Cains comments, and we refer you to the attached
graph about fines on foreign corrupt payments imposed by the US SEC/DoJ/IRS/FBI. We think
your review should recommend retrospective fines on banks and individuals, remove privilege
and expand offences to ensure that, as the SECs Kara Stein recommended, auditors and lawyers
and other gatekeepers are penalized. As John Cain notes, the RBA acted on legal advice: we
thing the time has come to have crimes that charge all concerned with hampering or obstruction
or blindness.
