AGREEMENTCAREFULLY.BYUSINGTHESOFTWAREYOUACKNOWLEDGETHATYOU
HAVEREADTHETERMSANDAGREETOTHEM.IFYOUAREAGREEINGTOTHESE
TERMSONBEHALFOFACOMPANYOROTHERLEGALENTITY,YOUREPRESENTTHAT
YOUHAVETHELEGALAUTHORITYTOBINDTHELEGALENTITYTOTHESE
TERMS.IFYOUDONOTHAVESUCHAUTHORITY,ORIFYOUDONOTWISHTO
BEBOUNDBYTHETERMS,THENYOUMUSTNOTUSETHESOFTWAREONTHISSITE
ORANYOTHERMEDIAONWHICHTHESOFTWAREISCONTAINED.
1.DEFINITIONS."Software"meanstheidentifiedaboveinbinaryform,
anyothermachinereadablematerials(including,butnotlimitedto,
libraries,sourcefiles,headerfiles,anddatafiles),anyupdatesor
errorcorrectionsprovidedbySun,andanyusermanuals,programming
guidesandotherdocumentationprovidedtoyoubySununderthis
Agreement."GeneralPurposeDesktopComputersandServers"means
computers,includingdesktopandlaptopcomputers,orservers,used
forgeneralcomputingfunctionsunderendusercontrol(suchasbutnot
specificallylimitedtoemail,generalpurposeInternetbrowsing,and
officesuiteproductivitytools).TheuseofSoftwareinsystemsand
solutionsthatprovidededicatedfunctionality(otherthanasmentioned
above)ordesignedforuseinembeddedorfunctionspecific
softwareapplications,forexamplebutnotlimitedto:Softwareembedded
inorbundledwithindustrialcontrolsystems,wirelessmobile
telephones,wirelesshandhelddevices,netbooks,kiosks,TV/STB,Blu
rayDiscdevices,telematicsandnetworkcontrolswitching
equipment,printersandstoragemanagementsystems,andotherrelated
systemsisexcludedfromthisdefinitionandnotlicensedunderthis
Agreement."Programs"meansJavatechnologyappletsandapplications
intendedtorunontheJava2PlatformStandardEdition(J2SE)platform
onJavaenabledGeneralPurposeDesktopComputersandServers.
2.LICENSETOUSE.Subjecttothetermsandconditionsofthis
Agreement,including,butnotlimitedtotheJavaTechnology
RestrictionsoftheSupplementalLicenseTerms,Sungrantsyouanon
exclusive,nontransferable,limitedlicensewithoutlicensefeesto
reproduceanduseinternallySoftwarecompleteandunmodifiedforthe
solepurposeofrunningPrograms.Additionallicensesfordevelopers
and/orpublishersaregrantedintheSupplementalLicenseTerms.
3.RESTRICTIONS.Softwareisconfidentialandcopyrighted.Titleto
Softwareandallassociatedintellectualpropertyrightsisretainedby
Sunand/oritslicensors.Unlessenforcementisprohibitedbyapplicable
law,youmaynotmodify,decompile,orreverseengineerSoftware.You
acknowledgethatLicensedSoftwareisnotdesignedorintendedforuse
inthedesign,construction,operationormaintenanceofanynuclear
facility.SunMicrosystems,Inc.disclaimsanyexpressorimplied
warrantyoffitnessforsuchuses.Noright,titleorinterestinorto

anytrademark,servicemark,logoortradenameofSunoritslicensors
isgrantedunderthisAgreement.Additionalrestrictionsfordevelopers
and/orpublisherslicensesaresetforthintheSupplementalLicense
Terms.
4.LIMITEDWARRANTY.Sunwarrantstoyouthatforaperiodofninety
(90)daysfromthedateofpurchase,asevidencedbyacopyofthe
receipt,themediaonwhichSoftwareisfurnished(ifany)willbefree
ofdefectsinmaterialsandworkmanshipundernormaluse.Exceptfor
theforegoing,Softwareisprovided"ASIS".Yourexclusiveremedyand
Sun'sentireliabilityunderthislimitedwarrantywillbeatSun's
optiontoreplaceSoftwaremediaorrefundthefeepaidforSoftware.
AnyimpliedwarrantiesontheSoftwarearelimitedto90days.Some
statesdonotallowlimitationsondurationofanimpliedwarranty,so
theabovemaynotapplytoyou.Thislimitedwarrantygivesyouspecific
legalrights.Youmayhaveothers,whichvaryfromstatetostate.
5.DISCLAIMEROFWARRANTY.UNLESSSPECIFIEDINTHISAGREEMENT,ALL
EXPRESSORIMPLIEDCONDITIONS,REPRESENTATIONSANDWARRANTIES,INCLUDING
ANYIMPLIEDWARRANTYOFMERCHANTABILITY,FITNESSFORAPARTICULAR
PURPOSEORNONINFRINGEMENTAREDISCLAIMED,EXCEPTTOTHEEXTENTTHAT
THESEDISCLAIMERSAREHELDTOBELEGALLYINVALID.
6.LIMITATIONOFLIABILITY.TOTHEEXTENTNOTPROHIBITEDBYLAW,INNO
EVENTWILLSUNORITSLICENSORSBELIABLEFORANYLOSTREVENUE,PROFIT
ORDATA,ORFORSPECIAL,INDIRECT,CONSEQUENTIAL,INCIDENTALORPUNITIVE
DAMAGES,HOWEVERCAUSEDREGARDLESSOFTHETHEORYOFLIABILITY,ARISING
OUTOFORRELATEDTOTHEUSEOFORINABILITYTOUSESOFTWARE,EVENIF
SUNHASBEENADVISEDOFTHEPOSSIBILITYOFSUCHDAMAGES.Innoevent
willSun'sliabilitytoyou,whetherincontract,tort(including
negligence),orotherwise,exceedtheamountpaidbyyouforSoftware
underthisAgreement.Theforegoinglimitationswillapplyevenifthe
abovestatedwarrantyfailsofitsessentialpurpose.Somestatesdonot
allowtheexclusionofincidentalorconsequentialdamages,sosomeof
thetermsabovemaynotbeapplicabletoyou.
7.TERMINATION.ThisAgreementiseffectiveuntilterminated.Youmay
terminatethisAgreementatanytimebydestroyingallcopiesof
Software.ThisAgreementwillterminateimmediatelywithoutnoticefrom
SunifyoufailtocomplywithanyprovisionofthisAgreement.Either
partymayterminatethisAgreementimmediatelyshouldanySoftware
become,orineitherparty'sopinionbelikelytobecome,thesubjectof
aclaimofinfringementofanyintellectualpropertyright.Upon
Termination,youmustdestroyallcopiesofSoftware.
8.EXPORTREGULATIONS.AllSoftwareandtechnicaldatadeliveredunder
thisAgreementaresubjecttoUSexportcontrollawsandmaybesubject
toexportorimportregulationsinothercountries.Youagreetocomply
strictlywithallsuchlawsandregulationsandacknowledgethatyou
havetheresponsibilitytoobtainsuchlicensestoexport,reexport,or
importasmayberequiredafterdeliverytoyou.
9.TRADEMARKSANDLOGOS.Youacknowledgeandagreeasbetweenyouand
SunthatSunownstheSUN,SOLARIS,JAVA,JINI,FORTE,andiPLANET

trademarksandallSUN,SOLARIS,JAVA,JINI,FORTE,andiPLANETrelated
trademarks,servicemarks,logosandotherbranddesignations("Sun
Marks"),andyouagreetocomplywiththeSunTrademarkandLogoUsage
Requirementscurrentlylocatedat
http://www.sun.com/policies/trademarks.AnyuseyoumakeoftheSun
MarksinurestoSun'sbenefit.
10.U.S.GOVERNMENTRESTRICTEDRIGHTS.IfSoftwareisbeingacquiredby
oronbehalfoftheU.S.GovernmentorbyaU.S.Governmentprime
contractororsubcontractor(atanytier),thentheGovernment'srights
inSoftwareandaccompanyingdocumentationwillbeonlyassetforthin
thisAgreement;thisisinaccordancewith48CFR227.7201through
227.72024(forDepartmentofDefense(DOD)acquisitions)andwith48
CFR2.101and12.212(fornonDODacquisitions).
11.GOVERNINGLAW.AnyactionrelatedtothisAgreementwillbe
governedbyCalifornialawandcontrollingU.S.federallaw.Nochoice
oflawrulesofanyjurisdictionwillapply.
12.SEVERABILITY.IfanyprovisionofthisAgreementisheldtobe
unenforceable,thisAgreementwillremainineffectwiththeprovision
omitted,unlessomissionwouldfrustratetheintentoftheparties,in
whichcasethisAgreementwillimmediatelyterminate.
13.INTEGRATION.ThisAgreementistheentireagreementbetweenyouand
Sunrelatingtoitssubjectmatter.Itsupersedesallprioror
contemporaneousoralorwrittencommunications,proposals,
representationsandwarrantiesandprevailsoveranyconflictingor
additionaltermsofanyquote,order,acknowledgment,orother
communicationbetweenthepartiesrelatingtoitssubjectmatterduring
thetermofthisAgreement.NomodificationofthisAgreementwillbe
binding,unlessinwritingandsignedbyanauthorizedrepresentativeof
eachparty.
SUPPLEMENTALLICENSETERMS
TheseSupplementalLicenseTermsaddtoormodifythetermsofthe
BinaryCodeLicenseAgreement.Capitalizedtermsnotdefinedinthese
SupplementalTermsshallhavethesamemeaningsascribedtotheminthe
BinaryCodeLicenseAgreement.TheseSupplementalTermsshallsupersede
anyinconsistentorconflictingtermsintheBinaryCodeLicense
Agreement,orinanylicensecontainedwithintheSoftware.
A.SoftwareInternalUseandDevelopmentLicenseGrant.Subjecttothe
termsandconditionsofthisAgreementandrestrictionsandexceptions
setforthintheSoftware"README"fileincorporatedhereinby
reference,including,butnotlimitedtotheJavaTechnology
RestrictionsoftheseSupplementalTerms,Sungrantsyouanon
exclusive,nontransferable,limitedlicensewithoutfeestoreproduce
internallyanduseinternallytheSoftwarecompleteandunmodifiedfor
thepurposeofdesigning,developing,andtestingyourPrograms.
B.LicensetoDistributeSoftware.Subjecttothetermsandconditions
ofthisAgreementandrestrictionsandexceptionssetforthinthe
SoftwareREADMEfile,including,butnotlimitedtotheJavaTechnology

RestrictionsoftheseSupplementalTerms,Sungrantsyouanon
exclusive,nontransferable,limitedlicensewithoutfeestoreproduce
anddistributetheSoftware,providedthat(i)youdistributethe
Softwarecompleteandunmodifiedandonlybundledaspartof,andfor
thesolepurposeofrunning,yourPrograms,(ii)theProgramsadd
significantandprimaryfunctionalitytotheSoftware,(iii)youdonot
distributeadditionalsoftwareintendedtoreplaceanycomponent(s)of
theSoftware,(iv)youdonotremoveoralteranyproprietarylegendsor
noticescontainedintheSoftware,(v)youonlydistributetheSoftware
subjecttoalicenseagreementthatprotectsSun'sinterestsconsistent
withthetermscontainedinthisAgreement,and(vi)youagreetodefend
andindemnifySunanditslicensorsfromandagainstanydamages,costs,
liabilities,settlementamountsand/orexpenses(includingattorneys'
fees)incurredinconnectionwithanyclaim,lawsuitoractionbyany
thirdpartythatarisesorresultsfromtheuseordistributionofany
andallProgramsand/orSoftware.
C.JavaTechnologyRestrictions.Youmaynotcreate,modify,orchange
thebehaviorof,orauthorizeyourlicenseestocreate,modify,or
changethebehaviorof,classes,interfaces,orsubpackagesthatarein
anywayidentifiedas"java","javax","sun"orsimilarconventionas
specifiedbySuninanynamingconventiondesignation.
D.SourceCode.Softwaremaycontainsourcecodethat,unlessexpressly
licensedforotherpurposes,isprovidedsolelyforreferencepurposes
pursuanttothetermsofthisAgreement.Sourcecodemaynotbe
redistributedunlessexpresslyprovidedforinthisAgreement.
E.ThirdPartyCode.Additionalcopyrightnoticesandlicenseterms
applicabletoportionsoftheSoftwarearesetforthinthe
THIRDPARTYLICENSEREADME.txtfile.Inadditiontoanytermsand
conditionsofanythirdpartyopensource/freewarelicenseidentifiedin
theTHIRDPARTYLICENSEREADME.txtfile,thedisclaimerofwarrantyand
limitationofliabilityprovisionsinparagraphs5and6oftheBinary
CodeLicenseAgreementshallapplytoallSoftwareinthisdistribution.
F.TerminationforInfringement.Eitherpartymayterminatethis
AgreementimmediatelyshouldanySoftwarebecome,orineitherparty's
opinionbelikelytobecome,thesubjectofaclaimofinfringementof
anyintellectualpropertyright.
G.InstallationandAutoUpdate.TheSoftware'sinstallationandauto
updateprocessestransmitalimitedamountofdatatoSun(orits
serviceprovider)aboutthosespecificprocessestohelpSununderstand
andoptimizethem.Sundoesnotassociatethedatawithpersonally
identifiableinformation.Youcanfindmoreinformationaboutthedata
