Question 1

Faruk, an auctioneer has made an advertisement regarding an auction on number of items


including offices furniture to be carried out on a specified date and place. Hanim who
intended to purchase offices furniture went to the place on that particular day but she
found that Faruk has withdrawn the items from the auction. Hanim then claimed damages
for breach of contract. She argued that the advertisement was a proposal of which she has
accepted.
Advise Hanim.

Question 2
Balkis entered into a contract with UITM to be a part time lecturer during a period of 12
months. As part of the contract, she also undertook not to teach at any other education
institution, without the written authorization of Pengarah UITM. However, she then
breached the contract by teaching at UUM. UITM ask your consultation to know whether
there is any remedy for them regarding this matter.

Question 3
Aiman wrote to Samy offering to sell his car at RM 55 000 cash, and indicating that he
would hold the offer open until Sunday. On Sunday morning, at 9.15 a.m Samy sent a
telegram to Aiman saying, I would like to buy your car for RM 50 000 but by
installment. Samy received no response from Aiman. Aiman upon receiving the
telegram from Samy, sold his car to another purchaser and only at 1.25 p.m sent a
telegram to Samy telling him about the sale. At 1.34 p.m before Aimans telegram was
received, Samy sent Aiman a further telegram accepting the original offer.

Advise Samy regarding this matter.
