Preface
Ragging in educational institutions has been a matter of concern for everyone in the
country. It is not a new phenomenon. Early references are found in Everyman
Encyclopedia (1938). It is mentioned as racking, ducking, teasing etc. In England the
credit/ discredit to introduce the practice of ragging goes to the Duke of Exeter. Racking
was another form of ragging in which a special instrument called rack was used to
torture the victim. Gradually it mixed up with the term ragging. Egyptian, Romans and
Greeks were also not lagging behind. Some form or the other was found in their society.
Ragging is a systematized form of Human Rights abuse as embodied under the
Constitution of India as well as other Constitutions of the World. Over the years, all over
the World and especially in South Asia, the practice of Ragging has come to be meant as
an extreme harassment, terror and even physical and mental torture of the new students.
The incidents of ragging have increased over the past few years. Lacks of moral values
and discipline have been the main reasons for this spurt. Increased use of alcohol has also
contributed to this menace.
Various regulatory have spelled out measures to contain the menace of ragging in the
educational institutions, and the Apex court of the country has also given guidelines for
preventing this practice in the educational institutions.
Dr. RP Government Medical College has resolved to make the college a Zero Ragging
Campus We have initiated various measures for the prevention of ragging in and outside
the campus. This document contains the regulatory measures that will be followed in the
college. All efforts have been made to include the recommendations of all committees,
regulatory bodies and the recommendations of the Apex court in spelling out the
measures against ragging.
I sincerely thank my faculty colleagues for their valuable contribution to this
manuscript and firmly believe that with their help and cooperation we will
implement it in letter and spirit.

1. Introduction
Ragging is widespread menace in higher educational institutions including medical and
engineering colleges. Media has been reporting the incidences of ragging in these
institutions resulting in suicides, violence, physical injuries, sexual abuse and
psychological disorders. Many more students are subjected to this inhuman and barbaric
behavior which usually goes unreported.
Various regulatory bodies have given their recommendations to curb the menace of
ragging in educational institutions. The Apex court of the country has also issued
instruction based on the recommendations of the Raghvan Committee. Separate
guidelines have also been issued by the Medical Council of India and the University Grant
Commission in the country in this regard.
The government of Himachal Pradesh has also discussed this matter at length in a high
powered committee on March 20, 2009 and directed the authorities to take measures
based on the guidelines that flows from the Honble Supreme Court or otherwise to curb
the increasing menace of ragging in academic institutions.
The state of Himachal Pradesh has also promulgated an ordinance called The Himachal
Pradesh Educational Institutions (Prohibition of Ragging) Ordinance No. 1 of 2009 to
provide for the prevention of the evil practice of Ragging in educational institutions in the
state of Himachal Pradesh. (Details are annexed)
Based on these instructions and the guidelines, Anti Ragging Measures have been
proposed in this institution to be followed by one and all.

2. Objectives
2.1

General Objective

2.1.1 To make Medical College Tanda Campus Zero Tolerance for Ragging and Ragging
free Zone by weeding out ragging in all its forms.
2.2 Specific Objectives
2.2.1 To absolutely prohibit ragging within or outside the college campus.
2.2.2 To prevent the occurrence of ragging by following anti ragging measures in the
institution.
2.2.3 To provide punishment to those indulging in ragging as per the guidelines.
2.2.4 To sensitize students, staff and parents to adopt measures that will prevent
ragging

3.

Definitions
For the purposes of these Regulations:-

3.1

Educational Institution means Dr. RP Government Medical College and


affiliated hospital Kangra at Tanda, affiliated to HP University Shimla imparting
Medical Education as notified by the Himachal Pradesh government in the Official
Gazette.

3.2

Officer-in-Charge means and includes persons appointed as:


i.

Principal of the college

ii.

Head of the hostels

iii.

Dean of faculty

iv.

The college Council

v.

Heads of teaching departments

vi.

Chief warden and other wardens

vii.

Hostel Manager

viii.

Advisor Central Student Association

ix.

Librarian of the college.


Ragging means the following:
Any act, conduct or practice by which dominant power of senior students, former
students or outsiders, is brought to bear on students freshly enrolled or students
who are in any way considered junior by other students and includes individual or
collective acts or practices which:

i.

Involve physical or psychological assault or threat or use of force or wrongful


confinement or restraint; or

3.4

ii.

Violate the status, dignity and honor of such students; or

iii.

Expose students to ridicule and contempt and affect their self-esteem; or

iv.

Entail verbal abuse and aggression, indecent gesture and obscene behavior.
Appropriate Authorities means the following:

i.

4.

Causes and locations of Ragging

4.1

Causes of ragging
The main causes for indulging in ragging are:

4.1.1 Eagerness of seniors to show off their power, authority and superiority.
4.1.2 An attitude of backlash: a "do-unto-others what others did to you."
4.1.3 Importance the seniors get in the initial stages of admission by helping and
guiding the new comers for various things in the absence of or ineffectiveness of
institutional mechanism to help them at that point, resulting in their getting
indebted to seniors and thereby feeling compelled to do their biddings.

4.2

Causes for the increase in the incidence of ragging


Among the main causes, one can cite the following:

4.2.1 Lack of morality, erosion of values and discipline.


4.2.2 External pressure of power that hinder enforcement and action against students
with powerful connection.
4.2.3 Lack of authorities on the part of teachers.
4.2.4 The powers and moral authority of the Wardens and other functionaries have
eroded over the years, as many of them may not be committed to their work, but
take up such responsibilities for the sake of perks attached to those offices.
4.2.5 Lack of interest and involvement in such matters among majority of faculty
members.
4.2.6 Fear among students subjected to ragging that the Head of the Departments and
others may be pressurized later on for withdrawal of complaints or for revocation
of the orders of punishment.
4.2.7 Fear that they and/or their family members may be harassed and victimized by
the perpetrators of this menace.
4.2.8 Indulgence of parents with too much money to students leading to incidence of
drinking, drug abuse etc.
4.2.9 Easy access to Alcohol and other psychoactive substances in the campus.
4.2.10 Hushing up or downplaying of the reported cases by the authorities.

4.3

Vulnerable locations for ragging


Ordinarily, places which are most vulnerable for ragging are:

Prohibition of Ragging
Ultimate objective of these regulatory measures will be to make this campus
Ragging free and Zero Tolerance for Ragging Campus.

5.1

No person shall practise ragging in any form, within or outside the premises of the
college.

5.2

Any person who contravenes the provision listed above shall, on conviction, be
punished with imprisonment for a term which may extend to 3 years or with fine
which may extend to fifty thousand rupees or with both. The erring student shall
also be punished in other form as mentioned in the annexure XIII.

6.

Roles and Responsibilities


Preventing the menace of ragging in the college and making the campus Zero
Ragging Zone will be the moral responsibility and accountability of the entire
institution starting from the principal to the lowest level employee. Such person
shall be bound to take immediate action if any case of ragging is noticed or
brought to the notice or reported to any staff of the institution.

6.1

Every person who is the Officer- in - Charge of the college or who is in the service
or pay of or remunerated by the college to do any work assigned to him/ her in
connection with the maintenance of discipline therein, shall be bound to take
immediate action on the occurrence of any incidence of ragging and to report it to
the anti ragging squad, the principal or the Officer-in-Charge defined at para
3.2 above. The report will also include the identity of those who have engaged in
ragging and the nature of the incidence.

6.2

This will include teaching as well as non teaching staff. Non Teaching staff has to
be incorporated in Anti Ragging Squad of the college.

6.3

Anti ragging complaints, in whatever form or from whatever source these may
emanates, shall be dealt with immediately and appropriately. The action will also
be conveyed to the appropriate authorities. The identity of the complainant will be
kept confidential.

6.4

In all cases a First Information Report (FIR) will be filed without exception by the
college authorities with the local Police authority.

6.5

Any decision of the parent/guardian to file their own FIR directly will not absolve
the college authorities from filing their own FIR.

6.6

Such incidents will also be reported to the district administration like, SDM,
Deputy Commissioner, the media and the state authorities.

6.7

Any person who contravenes the above provisions shall, on conviction, be


punished with imprisonment for a term which may extend to one year or a fine
which may extend to ten thousand rupees, or with both.

6.8

Every offence shall be cognizable, non bailable and compoundable with the
permission of the court.

6.9

The head of the institution or an officer, directly or primarily in-charge of


supervision for the proper maintenance of discipline in the college, if knowingly
omits to check and report or connives or abets the commission of the offence
(Para 3.3), shall be punished for a term which may extend to two years or with
fine which may extend to twenty five thousand rupees, or with both.

6.10

Whenever any student or, as the case may be, the parents or guardian or a teacher,
the non teaching staff or an Officer-in-Charge makes a complaint, in writing, of
ragging to the principal, the principal shall, without prejudice to the foregoing
provisions, within 24 hours of the receipt of the complaint, enquire into it and, if,
prima facie, it is found true, suspend the student found guilty.

6.11

Where, on enquiry by the principal, it is proved that prima facie there is no


substance in the complaint of ragging; he shall intimate the fact, in writing, to the
complainant.

6.12

The anti ragging punishment will vary from:

Anti Ragging Regulations will also be got printed in the form of booklet and will be
given to the students and the parents at the time of admission. It will also form an
important part of any information given to students before admission, during
admission and after admission.
They will give their informed undertaking in the form of an affidavit based on
these regulations.

7.

Formation of committees
To assist authorities in curbing the menace of ragging, various committees have
been formed in the college. These committees and associations will support the
college authorities in deciding all matters relating to ragging.

7.1

Anti Ragging Committee


There will be an Anti Ragging Committee with members from various segments of
the society.

7.1.1 This committee will have the following members:

7.1.2 This committee will decide and finalise Anti Ragging Regulations for the
institution. It will also be an advisory committee for all anti ragging measures that
will be finalized at College Council Level.
7.1.3 This committee will meet monthly from August to October. After that it will meet
quarterly from November to July. In all there will be 6 meetings in one year.

7.2

Anti Ragging Squad


There will be two Anti Ragging Squads, one for the girls and another for
boys hostels and other hostels.

7.2.1 This squad for boys hostels will have the following members:

7.2.2 The squad for girls hostels will have the following members:

7.2.3 This squad will conduct regular and surprise checking at various places, hostels
and class rooms, from time to time and will appraise the principals office.
7.3

Mentoring Cell

7.3.1 There will be a Mentoring Cell in place in the college before the next Academic
session each year to involve senior students as mentors and guides for the 1st year
students. This cell will be constituted and be in place each year at the end of
academic session. Senior students will be encouraged to join this cell.
7.3.2

One faculty member will be the in charge of this mentoring cell.

7.3.3

Mentors will be in four tier format starting from the new batch.

7.3.4 There will be 12 mentors from immediate senior batch of first year students
(Freshers). One Mentor will look after 4 students.
7.3.5 There will be 6 mentors from senior batch of second year students. One Mentor
will supervise 2 mentors from the batch below.
7.3.6 There will be 4 mentors from senior batch third year students. One mentor will
look after the work of 2 mentors down below.
7.3.7 There will be 2 mentors from senior most batch to coordinate with the mentors
from their junior batch and down below.

7.3.8 Selection of the mentors from immediate senior batch will be the responsibility of
the principal and the college council.
7.3.9 There will be a faculty advisor for each batch of mentors.
7.3.10 Proportional representation will be given to the girl students at all level.
7.3.11 Functions of the mentors will be as follows:
I.

Warden and other faculty will interact with senior level of mentors directly
and other mentors indirectly.

II.

Immediate senior Mentors (first level) to 1st year will visit their hostel along
with faculty adviser and introduce themselves to the freshers.

III.

They will also help new students in the college to settle down.

IV.

They will also be like their local guardian at the time of need of any kind.

V.
VI.

They will also act like peer counselors for these students.
Mentors of the senior most batch along with the faculty in charge will
oversee the working of the mentoring cell of the college.

VII.

The cell will report to the principal weekly in the first three months of the
academic session and thereafter monthly.

7.3.12 Mentoring cell for the session 2009-10 is given in annexure I.


7.4

Parent Teacher Association

7.4.1 Parent- Teacher association will be constituted at the start of each academic
session in the institution to discuss various issues pertaining to the students and
give recommendations to the college authorities.
7.4.2 This association will have members from both parents and teachers.
7.4.3 President will be from among the parents. One of the faculty members will be the
secretary of this association.

7.4.5 The association for the year 2009-10 is as per the annexure II.
7.4.5 This association will also advocate to the parents for promptly bringing to the
notice of the principal any incident of ragging.

7.5

Central Student Association

7.5.1 Central Student association can play an important role in curbing ragging and
other activities of indiscipline in and out side the college campus.
7.5.2 Student union election will be held during the second and third week of the
academic session. This has been approved by the Honble Supreme Court on the
recommendation of the JM Lyngdoh committee whereby the election should be
held democratically within first 15 day of the academic session. Since no senior
student will be there during first week of the academic session, these are
accordingly proposed in the institution.
7.5.3 This will also help in controlling ragging as the desirous contesting candidate,
mostly senior, will protect 1st year students from ragging for the sake of their
votes.
7.5.4 The election will be held in democratic way and the institution will not have
nominated association at all.

8.

Measures for prevention of ragging

8.1

The brochure of admission/instruction booklet for candidates shall print in block


letters these Regulations in full (including Annexure).

8.2

The application for admission shall be accompanied by a document in respect of


the School Leaving Certificate/ Character Certificate which shall include a report
on the behavioral pattern of the applicant, so that the institution can thereafter
keep intense watch upon a student who has a negative entry in this regard.

8.3

A primed leaflet detailing when and to whom one has to turn for information, help
and guidance for various purposes, addresses and telephone numbers of such
persons, etc. will be given to each fresher at the time of admission, so that the new
students need not look up to the seniors for help in such matters and get indebted
to them and start doing things, right or wrong, at their behest. This will reduce
their dependence on their seniors and the latter will loose the moral authority to
command.

8.4

The leaflet mentioned above will also make these students aware about their
rights as bona fide students of the institution. They will be communicated through
this leaflet that should desist from doing anything against their will even if
ordered by the seniors, that they have nothing to fear as the institution cares for
them and will not tolerate any atrocities against them.

8.5

The institution through the leaflet mentioned above shall explain to the new
entrants the arrangements for their induction and orientation which promote
efficient and effective means of integrating them fully as students.

8.6

The leaflet mentioned above shall contain a calendar of events and activities laid
down by the institution to facilitate and complement familiarization of juniors
with the academic environment of the institution.

8.7

The community at large and the students in particular will be made aware of the
dehumanizing effect of ragging inherent in its perverse forms. For this, big posters,
preferably multicolored, will be prominently displayed on all Notice Boards of all
departments, buildings/hostels as well as at all vulnerable places. A few of them
will be of permanent nature in the campus.
These posters will also be used to send the message across that ragging is a
cognizable offence and the institution means business and shall not fail to take
strict action against the offenders. The posters will also (optionally) include the
names of those punished for ragging during the previous year and the nature of
punishments.

8.8

The media will be requested to give adequate publicity to the negative aspects of
ragging mainly during the months of July and August every year so that public
awareness and aversion can be built up against ragging.

8.9

A letter from the Controller of Principal will be sent at the end of the academic
year to the parents/guardians of the students who are getting promoted to the
2nd/3rd year informing them about the law regarding ragging and the
punishments, and appealing to them to impress upon their wards to desist from
indulging in ragging when the new academic session starts.

9.

Measures for prohibition of ragging

9.1

Gap between Academic session of Junior and senior students

9.1.1 It will be ensured that there would be a clear gap of one week between the date of
Joining of 1st year students and the older students, ensuring that classes for the
seniors shall commence later, so as to enable the freshers to familiarize
themselves with the campus environment and adjust to the sudden changeover
from schools to the professional education.
9.1.2 After the arrival of senior students, there will be joint sensitization session for all
students by the professional counselor and/ or department of Psychiatry.
9.1.3 Joint orientation program will also be arranged which will be addressed by the
principal. All members of Anti Ragging Committee will also attend this orientation
session.
9.1.4 Freshers welcome party will be organized within 15 day from admissions by
senior students and the faculty together, where they will be properly introduced
to one another. This will also provide a platform for the new students to interact
with their seniors in the presence of faculty members. Such parties can bring out
the talents in the new students without the elements of indecency normally
occurring during ragging. Mass participation has its own built-in checks, as an
over zealous person could often be prevailed upon by sober elements. In the
presence of the faculty, even the miniscule of misguided students, who are
otherwise compulsive raggers, will be forced to behave properly and not cross the
limits of decency. Exhibiting their talents in the open will help these students to
shed their inferiority complex, remove their inhibitions and bring out the best in
them.
9.1.5

The student-faculty interaction will be increased by involving the students in all


student related matters of the institution. Such involvement will make the
students feel that they are responsible partners in managing the affairs of the
institution, and the credit to the institution for good work performance is due to
them as well.

9.1.6 Each student will be put under the local guardianship of faculty and senior
student. New batch of students will be divided into small group of 5 students. This
group will be assigned to a member of faculty and also to the senior students. Such
members will interact with each member of the group individually for
ascertaining the problems or difficulties faced if any and will provide necessary
help.
This will infuse confidence in the new students and will make them feel at home.
This will also enable them to report incidents of ragging or indiscipline in the
institution. Each group in charge will maintain a diary of his/ her interaction with
the new students.
9.1.7 The faculty in charge/ local guardian will also coordinate with the warden of the
hostel and will make surprise visit to the rooms of the students belonging to his/
her group.
9.2

Undertakings in the form of Affidavit by students and parents

9.2.1 Each student and his/her parent whether fresher or senior will have to sign an
undertaking that he/she has read the relevant instruction/regulations against
Ragging, as well as punishment, and if the ward has been found guilty, he/she shall
be proceeded against.
9.2.2 Such an undertaking shall be furnished at the beginning of the academic session
by each student and his/her parent (Annexure III).
9.2.3 Such an undertaken will also be required in the form of an Affidavit at the time of
admission. (Annexure IV and V)
9.2.4 This affidavit will be in addition to the requirement under the college prospect.
9.2.5 An undertaking will also be obtained from each of the employee of the college
including teaching and non teaching members of the staff (Annexure VI), all
contracted staff of the canteen or any watch and ward staff or the staff engaged in
the maintenance work that he/ she would report promptly any case of ragging
which comes to his/ her notice.

9.3

Pledge against Ragging

9.3.1 At the commencement of the academic session the principal will address a
meeting of various agencies like Wardens, representatives of students,
parents/guardians, faculty, police and other law and order machinery with an
appeal to help eradicate the menace of ragging in the institution completely.
9.3.2 During second week of the new academic session, a joint Pledge (Annexure VII)
will be taken by each student of the college to make the college zero tolerance

ragging campus and maintain this throughout the year. Faculty as well as the
parents will also join during this oath ceremony.
9.4

Movement of students

9.4.1 ID card will be mandatory for each student. They will also have to carry it all the
time.
9.4.2 A movement Register for students will be maintained at the main gate of all
hostels from 10 PM to 6 AM.

10.

Anti Ragging Survey among 1st year Students

10.1

To know the knowledge and attitude of new entrants regarding ragging in the
college, a base line anonymous survey (Annexure VIII) will be conducted amongst
them.

10.2

After this baseline, fortnightly anonymous surveys will be undertaken in the


college for first three months of the academic session to get the feed back from
these students. Thereafter this survey will be conducted monthly till the next
academic year.

10.3

The responsibility of such survey has been entrusted to the department of


Community Medicine of the college. This department has developed the Performa
for baseline as well as fortnightly survey (Annexure IX). They will conduct this
survey regularly.

10.4

Survey data will be analyzed and reported to principal.

10.5

This information will further be disseminated to the members of the anti ragging
committee, government and the Medical Council of India on regular basis

11.

Security

11.1

There will be a dedicated security staff under the control of Chief Warden for the
hostels.

11.2

Security will be tightened in the premises of the institution, especially at the


vulnerable places. If necessary, intense security arrangements will be resorted to
at these points at odd hours during the first three months of the academic session.

11.3

Roster of the security personnel will be displayed on the notice board of the hostel
as well of the principal. Copies of this roster will also be circulated to all hostel
wardens.

11.4

Office of the ASO will be open round the clock with at least one person on duty.

11.5

Closed Circuit Cameras will be installed on the main entrance and residential area
of juniors hostels.

11.6. Hooters with switches at different places will be installed in juniors hostels which
can be used by the students in emergency.
11.7

A police post has been opened in the campus.

12.

Hostel Administration

12.1

Wardens should preferably have accommodation within the hostel premises.


Government will be requested in this regard

12.2 A Dedicated Hostel warden should be recruited who should have


accommodation inside the respective hostel premises. Case will be taken up with
the government.
12.3

One room in the hostel will be reserved as the office for the Warden and the
manager. Number of hostel managers will be increased.

12.3

Wardens will be accessible at all hours on telephone and other mean of


communication. The details of their telephone numbers will be displayed in the
hostel as well in the brochure that will be handed to the students at the time of
admission.

12.4

The details and telephone numbers of the principal, members of Anti Ragging
Committee, Anti Ragging Squad, district and Sub division authorities and the

SUPREMECOURTOFINDIA
UPON hearing counsel the Court made the following O R D E R
We have perused the Report of the Committee constituted pursuant to this Courts order
to suggest remedial measures to tackle with the problem of ragging in educational
institutions.
An elaborate report has been submitted by the Committee headed by Dr.R.K. Raghavan.
According to the Committee, the following factors need to be focused to tackle with the
problem:
(a) Primary responsibility for curbing ragging rests with academic institutions
themselves.
(b) Ragging adversely impacts the standards of higher education.
(c) Incentives should be available to institutions for curbing the menace and there
should be disincentives for failure to do so.
(d) Enrolment in academic pursuits or a campus life should not immunize any adult
citizen from penal provisions of the laws of the land.
(e) Ragging needs to be perceived as failure to inculcate human values from the
schooling stage.
(f) Behavioral patterns among students, particularly potential raggers, need to be
identified.
(g) Measures against ragging must deter its recurrence.
(h) Concerted action is required at the level of the school, higher educational
institution, district administration, university, State and Central Governments to
make any curb effective.
(i) Media and the Civil Society should be involved in this exercise. The Committee has
made several recommendations.
For the present, we feel that the following recommendations should be implemented
without any further lapse of time.
(1) The punishment to be meted out has to be exemplary and justifiably harsh to act
as a deterrent against recurrence of such incidents.

(2) Every single incident of ragging where the victim or his parent/guardian or the
Head of institution is not satisfied with the institutional arrangement for action, a
First Information Report must be filed without exception by the institutional
authorities with the local police authorities. Any failure on the part of the
institutional authority or negligence or deliberate delay in lodging the FIR with the
local police shall be construed to be an act of culpable negligence on the part of the
institutional authority. If any victim or his parent / guardian of ragging intends to
file FIR directly with the police, that will not absolve the institutional authority
from the requirement of filing the FIR.
(3) Courts should make an effort to ensure that cases involving ragging are taken up
on a priority basis to send the correct message that ragging is not only to be
discourages but also to be dealt with sternness.
(4) In addition, we direct that the possibility of introducing in the educational
curriculum a subject relating to ragging shall be explored by the National Council
of Educational Research and Training (NCERT) and the respective State Council of
Educational Research and Training (SCERT). This aspect can be included in the
teaching of the subjects Human Rights.
(5) In the prospectus to be issued for admission by educational institutions, it shall be
clearly stipulated that in case the applicant for admission is found to have
indulged in ragging in the past or if it is noticed later that he has indulged in
ragging, admission may be refused or he shall be expelled from the educational
institution.
(6) The Central Government and the State Governments shall launch a programme
giving wide publicity to the menace of ragging and the consequences which follow
in case any student is detected to have been involved in ragging.
(7) It shall be the collective responsibility of the authorities and functionaries of the
concerned institution, and their role shall also be open to scrutiny for the purpose
of finding out whether they have taken effective steps for preventing ragging and
in case of their failure, action can be taken; for example, denial of any grant-in-aid
or assistance from the State Governments.
(8) Anti-ragging committees and squads shall be forthwith formed by the institutions
and it shall be the job of the committee or the squad, as the case may be, to see
that the Committees recommendations, more for particularly those noted above,
are observed without exception and if it is noticed that there is any deviation, the
same shall be forthwith brought to the notice of this Court.
(9) The Committee constituted pursuant to the order of this Court shall continue to
monitor the functioning of the anti-ragging committees and the squads to be
formed. They shall also monitor the implementation of the recommendations to
which reference has been made above.

ORDINANCE No. 1 of 2009
THE HIMACHAL PRADESH EDUCATIONAL INSTITUTIONS (PROHIBITION OF
RAGGING) ORDINANCE, 2009
Promulgated by Governor of Himachal Pradesh in the Sixtieth Year of the Republic
of India.
An Ordinance to provide for prevention of the evil practice of ragging in
educational institutions in the State of Himachal Pradesh.
WHEREAS the Legislative Assembly of Himachal Pradesh is not in session and the
Governor of Himachal Pradesh is satisfied that circumstances exist which render it
necessary for her to take immediate action;
NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213
of the Constitution of India, the Governor of Himachal Pradesh is pleased to
promulgate the following Ordinance:1.
Short title- This Ordinance may be called the Himachal Pradesh Educational
Institutions (Prohibition of Ragging) Ordinance, 2009.
2.

Definitions- In this Ordinance, unless the context otherwise requires-

(a) Educational Institution means any University, any College affiliated to or


maintained by the University, any school imparting secondary education, any
school, Polytechnic or institution imparting technical education and includes such
other institutions as may be notified by the State Government in the Official
Gazette;
(b) Officer-in-Charge means and includes person appointed as the Principal of
College, Head of Hostel, Dean of Faculty, Head of Teaching Department or the
Institution, the authority of the College, Warden or Manager (by whatever name
called) of Hostel or Canteen, the Student Welfare Officer or the Librarian of the
College and University Library, Principal, Headmaster, Warden, Manager or
teacher of the educational institution;
(c) Ragging means any act, conduct or practice by which dominant power of
senior students, former students or outsiders, is brought to bear on students
freshly enrolled or students who are in any way considered junior by other
students and includes individual or collective acts or practices which(i)

involve physical or psychological assault or threat or use of force or


wrongful confinement or restraint; or

(ii)

violate the status, dignity and honour of such students; or

(iii)

expose students to ridicule and contempt and affect their self-esteem; or

(iv) entail verbal abuse and aggression, indecent gestures and obscene
behaviour.

3.

Prohibition of ragging-

(1) No person shall practice ragging in any form, within or outside the
premises of an educational institution.
(2) Any person who contravenes the provisions of subsection (1) shall, on
conviction, be punished with imprisonment for a term which may extend to 3
years or fine which may extend to fifty thousand rupees or with both.
4.

Duties of certain persons to check and report incidents of ragging-

(1) Notwithstanding anything contained in any law for the time being in
force or in any contract, every person who is the Officer-in-Charge of the
educational institution or who is in the service or pay of or remunerated by the
educational institution to do any work assigned to him in connection with the
maintenance of discipline therein, shall be bound to take immediate action on the
occurrence of any incident of ragging and to make report to the Vice Chancellor or
to any other officer authorized by him, in case of the University, or the head of the
educational institution, in case of the institution other than the University, the
identity of those who have engaged in ragging and the nature of the incident;
(2)
Every single incident of ragging where the victim or his parents or guardian
or the Head of educational institution is not satisfied with the institutional
arrangement for action, a First Information Report shall be filed without exception
by the institutional authorities with the local police authorities.
(3)
Any failure on the part of the institutional authority or negligence or
deliberate delay in lodging the First Information Report with the local police shall
be construed to be an act of culpable negligence on the part of the institutional
authority.
(4)
If any victim or his parent or guardian intends to file First Information
Report directly with the police that shall not absolve the institutional authority
from the requirement of filing the First Information Report.
(5)
Any person who contravenes the provisions of subsection (1) or subsection
(2) shall, on conviction, be punished with imprisonment for a term which may
extend to one year or a fine which may extend to ten thousand rupees, or with
both.
5.
Abetment of offences under section 3- Whoever being a head of educational
institution or an officer, directly or primarily in-charge of supervision for the
maintenance of discipline in the educational institution, knowingly omits to check
and report or connives or abets the commission of the offence under section 3
shall be punished for a term which may extend to two years or with fine which
may extend to twenty five thousand rupees, or with both.
6.
Offences to be cognizable, nonbailable and compoundable- Every offence
under this Ordinance shall be cognizable, nonbailable and compoundable with the
permission of the court.

7.

Expulsion of the student-

(1) Any student convicted of an offence under this Ordinance shall be


expelled from the educational institution.
(2)
Student expelled under subsection (1) or expelled otherwise on
account of ragging shall not be admitted in any other educational institution for a
period of three years from the date of order of such expulsion.
8.

Suspension of student-

(1) Whenever any student or, as the case may be, the parents or guardian
or a teacher of an educational institution or an Officer in-Charge makes a
complaint, in writing, of ragging to the head of the educational institution, the
head of that educational institution shall, without prejudice to the foregoing
provisions, within twenty four hours of the receipt of the complaint, enquire in to
it and, if, prima facie, it is found true, suspend the student found guilty.
(2) Where, on enquiry by the head of the educational institution, it is
proved that prima facie there is no substance in the complaint received under
subsection (1), he shall intimate the fact, in writing, to the complainant.
9.
Power of the State Government to give directions- The State Government
may, in public interest, by order in writing for reasons to be stated therein, give to
the educational institutions general instructions to be followed by such
institutions and such instructions may, notwithstanding anything contained in the
Himachal Pradesh University Act, 1970 (17 of 1970) and the Himachal Pradesh
Universities of Agriculture, Horticulture and Forestry Act, 1986 (4 of 1987), the
Jaypee University of Information Technology Act, 2002 (14 of 2002), The Chitkara
University (Establishment and Regulation) Act, 2008 (2 of 2009), the Eternal
University (Establishment and Regulation) Act, 2008 (3 of 2009), any University
established by Law in the State in private and public sector, the Himachal Pradesh
Board of School Education Act, 1968 (14 of 1968) Himachal Pradesh Board of
Technical Education Act, 1986 (14 of 1986), the Societies Registration Act, 1860
(21 of 1860) and the Himachal Pradesh Societies Registration Act, 2006 (Act No.
25 of 2006), includes directions to make or amend any Ordinances, Statutes,
Regulations, Rules, bye-laws relating to the prohibition of and the punishment for
ragging, in such form and within such period as may be specified in such order.
10.
Provisions not to be derogatory in certain laws- The provisions of this
Ordinance shall be in addition to and not in derogation of the Indian Penal Code,
1860 (45 of 1860), the Code of Criminal Procedure, 1973 (2 of 1974) and the

(14 of 2002), The Chitkara University (Establishment and Regulation) Act, 2008 (2

11.
Power to make rules- The State Government may, by notification, make
rules for carrying out the purposes of this Ordinance.
12.
Laying of rules and orders- Every order issued under section 9 and rules
made under section 11 shall be laid, as soon as may be after it is issued or made,
before the Legislative Assembly while it is in session for a total period of not less
than fourteen days which may be comprised in one session or in two or more
successive sessions, and if before the expiry of the session in which it is so laid or
the session aforesaid, the Assembly makes any modification in the rule, or as the
case may be, in the order, or decides that the rule or the order, as the case may be,
should not be issued or made, the rule or as the case may be, the order, shall
thereafter have effect only in such modified form or be of no effect, as the case
may be, so, however, that any such modification or annulment shall be without
prejudice to the validity of anything previously done under that rules or as the
case may be, under that order.

Hostel Rules and Regulations

HOSTEL RULES
Hostel Administration
1.

There shall be one Chief Warden, who shall be in charge of all the hostels. Every

hostel shall have a Warden and one or more Assistant Wardens with preferably one
staying in the hostel. Chief Warden, Warden and Assistant Wardens will be responsible
for the administration of the hostel, for enforcement of the hostel rules and for
prevention of ragging.
2.

The Chief Warden will be appointed by the Principal in consultation with College

Council and Wardens/ Assistant Wardens in consultation with Chief Warden from
amongst the teachers, normally for a period of two years. The duties, responsibilities and
authorities of Wardens and Assistant Wardens will be same and they shall work in
consultation with each other. In case of dispute, the decision of Warden shall be final. In
case of dispute amongst wardens the decision of Chief Warden shall be final.
3.

There shall be one committee of wardens with Chief Warden as Chairperson and

Wardens and Assistant Wardens as members to deliberate upon the issues related to
hostel administration, indiscipline and ragging. Meeting of Wardens Committee shall be
held at least once every month or more if necessary under intimation to the Principal.
4.

For the proper and democratic functioning of the hostels, several committees such

as Hostel committee, common room committee, Mess committee, sports committee,


discipline committee etc. will be formed in each hostel. Faculty members may also be
associated with these committees. These committees will also be concerned with the
making of new suggestions to the administration for further improvement in the hostels
and to ensure proper discipline and decorum.
5.

In addition to other duties the Chief Warden shall

Make arrangements for the residence, messing supervision and discipline

of students residing in the college hostels or any other duty assigned to him by the
Principal.
5.2

Make arrangements to make it sure that no ragging takes place in the

hostels and/ or by the inmates of the hostels.

5.3

Be responsible for deployment and activities of security personnel for

hostels.
5.4

Be responsible for allocation of accommodation/ seats to the students in

consultation with the Wardens in accordance with the rules


5.5

See that the hostels are kept in good condition and that the job of repair

and maintenance is being conducted smoothly and without any delay.


5.6
Keep in touch with the parents/ guardians of the students concerning their
behavior in the hostels.
5.7

Keep the Principal informed of all acts of indiscipline, misbehavior and ragging

and the action taken by him/ her.

Be responsible for the medical fitness of hostel/ mess workers.

In addition to other duties the Wardens/ Assistant Wardens shall

See that no unauthorized person stays in the hostel and a proper record of

visitors is maintained.
6.10

Check the unauthorized use of electrical appliances.

6.11

Be responsible for proper organization and conduct of hostel functions,

festivals etc.
6.12

Be responsible to the Chief Warden for the maintenance of discipline and

good behavior in the hostel and will communicate to the Principal through Chief Warden.
6.13

Have the authority to enter the room of any student and also make a search

of the room, when necessary. He will also have the authority, when the need arises, to
break open the lock of any room and also to shift the belongings of a student to any other
place.
6.14

Have the authority to confiscate any unauthorized electric or other

appliances or gadgets being used by a student and also to impose or recommend the
imposition of a fine for such un-authorized use.
7.

The powers of disciplinary action of the Warden, Chief Warden and Principal shall

be as under, the punishment depending on the nature and severity of the offence.
7.1

Warden/ Assistant Warden

8.

All matters related to indiscipline shall be resolved by the wardens. In case a

warden feels that the quantum of punishment should be more than what he/ she is
competent to award, he/ she shall refer the case to the Chief Warden in writing with
recommendations of punishment. If Chief Warden also feels that the quantum of
punishment should be more than what he/ she is competent to award, he/ she shall
consult the Committee of Wardens and if the committee decides then the matter shall be
sent to the Principal with specific recommendations of quantum of punishment.

Admission of students to hostel and allotment of rooms


9.

At the time of admission, all students who wish to reside in the college hostel shall

apply, in the prescribed form, to the Chief Warden, for admission to a hostel. These
applications shall be accompanied by the receipt of the hostel fee deposited in the office
of the Principal. If for any reason, it is not found possible to admit the student in any of
the college hostels he will be entitled to a refund of all the hostel fees paid by him. But if a
student after having paid the hostel fees and after having been offered accommodation in
the hostel seeks and obtains permission of the Principal, not to stay in the hostel, he shall
be entitled to refund of hostel security only.
In the event of seat(s) falling vacant during the currency of the semester, desiring
students may apply for admission to the hostel according to the procedure laid down
above.
Parents shall submit the names and address of the local guardians and a list of
authorized visitors on the Performa to be prescribed by the Chief Warden.
10.

Allotment of cubicles and dormitories will be made on a date to be announced by

the Warden. When the allotment is made to the dormitories, the concerned students shall
be present so that the choice of partners may be decided in their presence. The wishes of
students in the matter of partners will be given due consideration.
11.

Except in case of brothers and other close relatives, room mates in dormitories

shall normally belong to the same class.


12.

No hostel resident will be allowed to change his room without written permission

of the Warden. Normally, no change of room will be permitted after the general allotment.
13.

After the general allotment and at the beginning of each subsequent semester, the

Warden shall send to the Chief Warden and Principal a complete list of the students
staying in his hostel, mentioning against each name, the number of room and also stating
whether it is a dormitory or a cubicle.
14.

The Chief Warden reserves the right of refusing admission to any student whose

admission in his/ her opinion, is not in the interest of hostel discipline. However, the
student has right to appeal to the Principal.

Appointment and duties of Prefects


15.

Prefects will be appointed every year by the warden from amongst the senior

students of good standing to assist him in the administration of the hostel. There shall be
one prefect for each floor/ wing of the hostel, subject to a maximum of four prefects per
hostel.
16.

The Prefects shall perform the following duties


16.1

Take the roll call of the hostel residents in his/ her block/ wing, as

prescribed in these rules and report to the warden about the absentees at the time of the
roll call as well as about absentees during the whole night. Failure of prefect to report
such cases to the warden will amount to a gross negligence on his/ her part for which he/
she will be removed immediately from his prefect ship and further action will be taken as
per rules.
16.2

Ensure that all hostel rules are observed by the students of his/ her block/

wing and bring to the notice of the Wardens any breach of these rules by any student
resident in his/ her block/ wing.
16.3

Look after the sanitation of his/ her block/ wing and bring to the notice of

the Warden any failure or negligence of the sanitary staff of the hostel in the performance
of their duties.
16.4

Report to the Warden and Medical Officer every case of illness and ensure

that students who fall ill are taken care of promptly.


16.5

Be available to and approachable to the students of his/ her block/ wing

and show interest in their welfare and activities.


17.

The prefects of the hostel shall be exempted from the payment of hostel room

rent.
18.

In the performance of his/ her duties, the prefect shall use persuasive and not

coercive methods and shall not, under any circumstances take law in to his/ her own
hands.

Common Room Secretary


19.

Every hostel shall have one common room secretary elected unanimously from

amongst the hostel inmates who shall be responsible for making provisions of and
maintaining facilities in the common room like news papers, magazines, indoor games
etc.
Hostel Committee
20.

Every hostel shall have a hostel committee with warden as chairman and

consisting of assistant warden(s), prefect(s), common room secretary and chairman of


mess committee.
21.

The hostel committee shall meet at least once every month or often if necessary,

on dates to be approved by the warden.


22.

The warden shall consult the committee on all matters relating the welfare of the

hostel residents, maintenance and management of the common room, kitchen and
canteen (if any), purchase of news papers and magazines, organization of function etc.
23.

Hostel committee shall make it sure that no hostel or mess worker carries any

communicable disease and maintain hygiene.


24.

The warden will communicate to the Chief Warden under intimation to the

Principal, the proceedings of all such meetings, drawing his attention to the grievances or
difficulties experienced by students and to their complaint or suggestion so that these
may be attended to promptly.
Utilization of hostel funds
25.

Hostel funds will be utilized by the Principal on recommendation of Wardens

committee.
Conduct and Discipline
26.

Students shall maintain discipline and a peaceful atmosphere in the hostel. A

student may be fined or expelled from the hostel or rusticated or expelled from the
college or subjected to other suitable punishment, depending on the circumstances, by
the authority, competent to impose such penalty for the following reasons

26.1

Misbehavior of any kind including disrespectful conduct towards officials

and fellow residents.


26.2

Teasing or otherwise harassing other students and/ or the use of violence.

26.3

Stealing or pilfering hostel/ college property or the property of other

students.
26.4

Unruly conduct or rowdism.

26.5

Writing on the walls or other parts of the hostel building or sticking of

posters or distribution of unauthorized hand bills or notices.


25.6

Making noise and/ or creating other disturbances, including the use of

audio devices etc. in such a manner as to disturb others.


26.7

Participating or causing others to participate in strikes, demonstrations or

disturbances of any kind or behaving or causing others to behave in such a manner as to


bring the hostel/ college in to disrepute.
26.8

Convening/ organizing/ attending unauthorized meetings within the

If a student is found guilty of having grossly misbehaved with a member of the

faculty or other employee of the college the minimum punishment shall be expulsion
from the hostel.
28.

No student shall keep gold, costly jewellery or cash in his/ her room.

29.

No meeting other than those authorized by the warden shall be held in the hostel

premises.

30.

While visiting the common room, dining hall and the canteen, the student shall be

in a proper dress and presentable.


31.

Students shall use or handle with care all property belonging to the hostel. When a

student is found guilty of wanton damage to hostel property, the warden may recover the
cost of repair or replacement and in addition, also impose a fine or recommend the
imposition of a fine depending on the circumstances. The amount thus realized shall be
credited to the Hostel Maintenance Fund.
32.

All the rooms in the hostel shall be open for inspection, by the Wardens/ Chief

Warden/ Principal at any time during the day or night.


33.

Students shall not abuse, maltreat or assault hostel employees, including mess

servants and employees of the canteen, if any.


34.

Students shall not under any circumstances take the law in their own hands, but

report any quarrel or dispute with fellow inmates in writing to the warden.
35.

Students shall not in any way interfere in the duties of the security personnel, who

shall have the right to enter and inspect corridors, toilets, bathrooms and common rooms
etc any time during day or night.
36.

Students can appeal to higher authorities but this will not be about the

authenticity of facts but only about the quantum of punishment.


Mess
37.

Mess will be run cooperatively by the hostel inmates.

38.

Mess Committee shall be formed by the hostel inmates in the beginning of every

semester headed by Chairman. Chairman and Members shall be elected unanimously


from amongst the hostel inmates by the hostel inmates under intimation to the Principal
and Chief Warden.
39.

Number of mess workers will be decided by the Chairman of Mess Committee in

consultation with the Principal and Chief Warden and the permission for the same will be
taken from Chief Warden after submitting the details of the workers.
40.

If any inmate leaves the hostel he/ she will have to clear the bills and take NOC

from the Chairman of Mess Committee.

41.

Mess will open at fixed times notified by the chief warden. Every body will have to

abide strictly by the mess timings as no eatables will be served at any other time.
42.

Mess bills shall be paid by 10th of every month. Mess Committee shall have the

right to deny food to habitual defaulters.


43.

Cooking food in rooms is not allowed and taking food outside the mess without

written permission of the warden will be considered an act of indiscipline and punished
accordingly.
44.

There shall be internal audit of mess accounts by the office of the principal, at least

once every year.


Electricity
45.

No body is allowed to use any electrical appliance except those fitted in the room.

The use of electric rods, kettles and other appliances without prior written permission of
the hostel warden concerned is strictly prohibited. Unauthorized use is punishable by
confiscating the appliance/ gadgets and/ or a fine.
46.

Electric rods/ bulbs will be provided only once at the time of allotment and will

not be replaced.
47.

Light and other appliances shall be switched off when not in use. No student shall

at any time, lock his room with the light or any other appliance on.
48.

Tempering with the electric installations shall be treated as a serious offence.

When there is need for carrying out a repair, a trained electrician should be called with
the permission of the warden.
Furniture and Equipment
49.

Inmates shall keep their rooms neat and tidy and shall be responsible, jointly and

individually, for the furniture issued to them and for the fittings present in their rooms at
the time of occupation. If a student observes any damage or defect in the furniture issued
to him/ her or in the permanent fitting in his room or finds anything at the time he
occupies the room, it will be his duty to bring it to the notice of the warden failing which
it will be presumed that everything was in order at the time of occupation.

50.

Furniture shall not be removed from one room to another. The furniture belonging

to the common room or the dining hall or hostel officer or the hostel visitors room shall
not be taken out or brought in to the living rooms.
51.

When a student vacates his room after completion of his course or because of any

other reason including expulsion from the hostel or college, he shall return to the warden
all hostel furniture and other property issued to him, failing which he shall be liable to
pay the entire cost of such furniture, fixture or other property. A register to this effect
shall be maintained in the chief wardens office detailing all furniture, fixture, appliances
or other property issued to the inmate.
Night Roll Call
52.

The night roll call will be taken by the concerned prefect at the time notified by the

warden. Every student must be present in his room to avoid inconvenience to the prefect
at the time of roll call.
53.

A student found absent at the time of roll call without making an entry in the

register, shall be liable to a fine of Rs. 10 per absence. The fine list shall be put up on the
notice board at the end of each month.
54.

No hostel resident shall stay outside the hostel for the night without the written

permission of the warden. However, the student who wishes to go out of the hostel after
the roll call or if a student wishes to go out for a few hours in the evening and knows that
he/ she will not return in time for the roll call shall do so after making the following entry
in the register

55.

If a student goes out in the evening and is unable to return at the time of roll call

because of unavoidable circumstances, shall contact and convince the warden


telephonically. If the warden is not convinced of the reason he/ she will have the right to
take suitable action.

56.

Absence from the hostel during the night without the permission of the warden

will be deemed to be an act of indiscipline and punished accordingly. Where a student is


found to be guilty of such an offence for too often, the warden may recommend his
expulsion from the hostel.
57.

Night roll call shall not apply to those students who are on night duties, provided

they produce a certificate, in the prescribed form, from the head of the concerned
department to the effect that they are required to stay out of the hostel during the night
or the head of the concerned department himself sends the list of staff on night duty in
his department.
Leave Rules
58.

Leave for absence from the college shall not automatically entitle a student to

leave the hostel without the permission of the warden. When a student wishes to leave
the hostel for one or more nights, he/she may apply to the Warden in writing and get
his/her permission.
59.

Leave should be sanctioned before it is availed of.

60.

A student absenting himself/ herself from the hostel, without getting his/ her

leave sanctioned, shall be subjected to fine or other disciplinary action.


Guests
61.

No student shall be allowed to keep a guest in his/ her room.

62.

Only parents or close relatives will be permitted to stay as guest in the Guest

House of the college on payment of charges, subject to availability of accommodation


which will be provided on recommendation of the Warden concerned.
63.

Names of the guests visiting the hostel shall be entered in the visitors register

maintained in the hostel.


64.

A student keeping the guest in the hostel shall be liable to disciplinary action.

However, in exceptional cases warden can permit a guest to stay in hostel for not more
than two days.
65.

In all hostels there shall be one visitors room where all the residents can meet

their guest. No guest shall be allowed to go inside the hostel.

Vehicle
66.

No student shall be allowed to keep a vehicle in the hostel/ campus. If any body

intends to do so, may do so after submitting an affidavit from his/ her parents on
prescribed format indicating clearly that hostel/ college authorities shall not be
responsible for any mishap or unlawful activity occurring due to the vehicle.
Withdrawal/removal from the hostel
67.

A resident, who desires to withdraw from the hostel, shall submit an application

on a prescribed form, to the Warden after having cleared all hostel dues.
68.

Before permitting student to withdraw from the hostel the warden shall ensure

that he has

Returned in good condition, all hostel property issued to him/ her

Even though a student might have actually vacated his/ her room, he/ she shall be

liable to pay all hostel and mess dues and fines, standing against his/ her name up to the
date he/ she continue to be on the rolls of the hostel and until his/ her name is formally
withdrawn with the permission of the warden.
70.

No student shall be allowed to stay in the hostel, if his hostel and mess dues are in

arrear for more than a month.


71.

Where a student has left the hostel, for whatever reason without clearing his dues

to the hostel, the Principal of the college may affect recovery of the outstanding dues from
the security deposit. In case the amount exceeds the amount of the deposit, the Principal
can withhold the issue of Character certificate, provisional degree certificate, internship
certificate till the balance of the outstanding dues are paid by the student.
The competent authority shall have the power to add to these rules or delete or amend
any of the existing rules from time to time.

4. I shall not stay out overnight without prior permission of the warden.

6. I shall not keep any guest in my room without written permission of the warden.
7. I shall not cook or take food in my hostel room.
8. I shall clear mess and other dues by 10th of every month.
9. I shall have cordial relations with other inmates and shall not disturb them.
10. I shall not indulge in any type of ragging.
11. I shall take care and be responsible for public property of the hostel.
12. I shall not keep electrical appliances (Music system, Heater etc) in my room.
13. I shall not keep jewellery, cash or other valuable item in my room.
14. I shall lock my room while going out.
15. I shall not smoke; take alcohol/ drugs in hostel premises.
16. I shall not keep vehicles without prior written permission of the warden.
17. I shall attend all hostel functions/ meetings etc.
18. After completion of the course/ term in the institute, I shall immediately vacate the
hostel room and shall hand it over to the Chief Warden personally and shall obtain no
dues certificate from the Chief Warden.
