and Official principal lawfully constituted of the Right Reverend ffather in God
John by Divine Providence Lord Bishop of Durham To all Christian People to whom
these Presents shall come or whom they shall or may in anywise concern and more especially to the Vicar Churchwardens
Parishioners and Inhabitants of the Parish of Heddon on the Wall in the County of Northumberland
and Diocese of Durham Greeting in our Lord God Everlasting Whereas it was Setforth and alleged before the Worshipful Thomas
Gyll Master of Arts our Surrogate lawfully appointed on the Behalf of William

Brown Gentleman that he was desirous of obtaining a Licence or Faculty to be granted to him for fencing off and inclosing on the
South and East sides thereof with an Iron Rail ffour foot or there
abouts in Heighth fixed on a Stone Base of the Heighth of the two Foot or thereabouts, but so as to leave open and uninclosed a free
and convenient Pafsage of about three Foot Square to the Door of the
Chancel a Piece or Parcel of Ground in the Church Yard there wherein the Bodies of several Persons of his own Family have, alone, as
it is believed for these Sixty Years last past and upwards
been interred and which is thus situated bounded and described (to wit) Adjoining upon the East End Wall of the Body of the said
Church on the west on the chancel wall on the north
extending in a Line from the South East Corner of the body of the Said Church ten ffoot or thereabouts to the East and from the said
Chancel Wall ten ffoot or thereabouts to the South and for
appropriating and confirming the said Piece or Parcel of Ground for the Interment of the Bodies of himself his Family and his and
their Descendants and families for ever hereafter

exclusive of all others whomsoever and that the Vicar and Churchwardens of the said Parish and Parish Church have certified the
matters above alleged to be true and that the ffencing
off and confirming the aforesaid Piece or Parcel of Ground in the manner above mentioned will not be attended with any
Inconvenience or Predjudice to any Person whatever and have also recognized
that a Licence or ffaculty may be granted to the said William Brown in the manner and for the purposes abovesaid as fully appears by
a Petition subscribed by the said William Brown and a
Certificate thereto Subjoined Subscribed by the said Vicar and Churchwardens exhibited before our said Surrogate and now
remaining in the Registry of this Court And Whereas our said Surrogate rightly
And duly proceeding at the Petition of the Proctor of the said William Brown did decree the Vicar Churchwardens Parishioners and
Inhabitants of the said Parish in special and all others in
General having or pretending to have any Right or Interest in all or any of the above Promises or matters above mentioned to be
peremptorily cited to appear before Us our Surrogate or some other
competent Judge in this Behalf at a Certain Competent Time and place to show good and competent time and place to show good and
sufficient Cause concludent in Law if they or any of them had know any why a Licence or ffaculty should
not in due form of Law be granted to the said William Brown in the said manner and to the Effect of all and singular the Purposes
above and hereinafter mentioned with Intimation that if
none of them appeared at such Time and place or appearing should not show good and sufficient Cause concludent Law to the
contrary We our Surrogate or some other competent Judge in that behalf
did intend and would proceed to the Granting of such Licence or ffaculty to the said William Brown in the manner and to the Effect
and for the Purposes desired aforesaid their Absences or rather

Contumacy in any wise not withstanding And Whereas our said Surrogate rightly and duly further proceeding on the duo
Exocution and Return of the said Citation with Intimation and after calling all
Persons as well in special and general thereby cited to appear and none of them appearing did pronounce them to be in Contempt and
in pain of such their Contumacy did decree a Licence or ffaculty to be granted
to the said William Brown in the manner and to Effect and for all and singular the Purposes above and hereinafter mentioned as in and
by the proceedings thereupon how and now remaining in the
Registry of this said Court doth fully approve We therefore well weighing and considering the Promifses by virtue of our Power and
Authority ordinary and as far by the Ecclesiastical Laws
of this Realm and Temporal Laws of the same We can or may ratify and confirm all and whatsoever our said Surrogate hath done or
caused to be done in the Promifsor And do hereby
give and grant to the said William Brown our Licence or ffaculty for fencing off and including the aforesaid piece or parcel of Ground
bounded and described aforesaid and of the Dimensions
aforesaid in the manner above setforth but so as to leave on the Outside of the Iron Rail to be made as aforesaid (to wit) at the North
East Corner thereof adjoining upon the aforesaid Chancel Door at
space of about three ffoot square for an open free and convenient Pafsage to and Entrance into and out of the said Chancel and for
appropriating and confirming the said piece or parcel of Ground bounded and described as aforesaid and of the Dimensions
fenced off and inclosed with a convenient Entrance into the same to the said William Brown for his Use and Benefit for the Interment
of the Bodies of himself his family and his and their Descendants and
ffamilies forever hereafter exclusive of all others whomsoever and without the Leastt Hinderance Molestation or Interruption of Vicar
Churchwardens Parishioners or Inhabitants respectively for their Time

being of the said Parish or any other person or persons whomsoever And we do hereby so grant appropriate and confirm the same
accordingly In Testimony whereof We have caused the Seal of the
Consistory Court of Durham to be affixed to those Presents Dated at Durham the Sixth Day of May in the Year of our Lord One
thousand seven hundred and Seventy seven
