ON SEPTEMBER 20, 2010 AT ABOUT 1538 HOURS, I INV. MOISES VAZALDUA WAS WORKING SURVEILLANCE IN THE,
AREA OF AZUL AND THOMAS ROAD WITH PHARR POLICE OFFICER OMAR AVENDANO. WHILE WORKING
SURVEILLANCE WE HEARD OFFICER JOSE TAMEZ VIA RADIO CONDUCTING A TRAFFIC STOP AT THE 100 BLOCK
W. LA QUINTA ON A BLUE MERCURY GRAND MARQUIS. THE SAME VEHICLE WAS SEEN BY US EARLIER IN THE
AREA WHERE WE WERE WORKING SURVEILLANCE. WE THEN PROCEEDED TO THE AREA TO ASSIST OFFICER
‘TAMEZ WHILE HE CONDUCTED HIS INVESTIGATION.
I THEN WALKED TOWARDS OFFICER TAMEZ WHO WAS INTERVIEWING A MALE SUBJECT LATER IDENTIFIED AS
OMAR MARTINEZ. OFFICER TAMEZ WAS EXPLAINING TO MARTINEZ THAT HE WAS DETECTING A STRONG ODOR
OF MARIHUANA EMITTING FROM INSIDE THE VEHICLE. I THEN HEARD A MALE VOICE YELLING OUT, JUST
NORTH OF OUR LOCATION. THE MAN YELLED OUT SEVERAL THINGS, BUT I ONLY HEARD HIM SAY “YOU
REMEMBER ME”. OFFICER TAMEZ REPLIED THAT HE DID REMEMBER HIM AND THAT HE NEEDED TO LEAVE THE
AREA BECAUSE HE WAS CONDUCTING AN INVESTIGATION. I THEN APPROACHED TAMEZ AND HE INFORMED ME.
‘TO BE CAREFUL WITH THE MAN ACROSS THE STREET WHO HE RECOGNIZED TO BE GUADALUPE CHAVEZ JR FOR
A PREVIOUS ARREST.
‘AS [WALKED UP TO THE SUSPECT I RECOGNIZED HIM ALSO FROM A PREVIOUS ARREST EARLIER IN THE MONTH.
TALSO RECOGNIZED HAT MARTINEZ WAS ARRESTED LEAVING A KNOWN NARCOTIC HOME IN THE AREA OF
AZUL LANE. I THEN TOOK THE OPPORTUNITY TO INTERVIEW MARTINEZ, WHILE TAMEZ SEARCHED HIS
‘VEHICLE. MARTINEZ APPEARED TO BE EXTREMELY NERVOUS AND WAS NOT ANSWERING MY QUESTIONS. AT A
‘CERTAIN POINT MARTINEZ WAS MORE CALM AND READY TO SPEAK WITH ME ABOUT NARCOTICS, WHEN MR.
(CHAVEZ YELLED OUT FROM ACROSS THE STREET, “TIENES DERECHOS PRIMO, DON’T TELL THEM ANYTHING”. 1
‘TURNED BACK AND SAW CHAVEZ PACING THE ROADWAY JUST NORTH OF US IN A SUSPICIOUS MANNER. I ASKED
CHAVEZ TO LEAVE THE AREA, AND NOT TO INTERFERE WITH OUR INVESTIGATION. CHAVEZ REFUSED TO LEAVE
AND WAS YELLING “DON’T TALK TO THEM”. I THEN INFORMED CHAVEZ THAT HE NEEDED TO REMAIN QUIET
AND WALK AWAY BECAUSE HE WAS INTERFERING WITH THE INVESTIGATION. AT THE SAME TIME CHAVEZ WAS
BEGINNING TO WALK TOWARDS US AND I COMMANDED TO STEP BACK OR HE WOULD BE ARRESTED FOR
INTERFERENCE. CHAVEZ REFUSED AND REMAINED IN THE AREA. OFFICER AVENDANO THEN WALKED IN THE
DIRECTION OF CHAVEZ AND ASKED HIM TO LEAVE THE AREA. CHAVEZ WALKED ONTO A PROPERTY AND CAME
OUT WITH WHAT APPEARED TO BE A CAMERA. CHAVEZ STAYED IN THE AREA, AND STILL DIDN'T LEAVE. AT
‘THAT POINT THE SUSPECT MARTINEZ SAID “ESE PINCHE VATO TA LOCO”. MARTINEZ ATTITUDE THEN CHANGED
AND HE REFUSED TO ANSWER ANY QUESTIONS ABOUT THE NARCOTICS. MARTINEZ INFORMED ME THAT HE JUST
WANTED TO LEAVE. IN MY PROFESSIONAL OPINION, I BELIEVE THAT CHAVEZ'S REMARKS AND COMMENTS:
CAUSED MARTINEZ NOT TO TALK TO US AND DISRUPTED AND INTERRUPTED OUR INVESTIGATION. NO FURTHER
ACTION WAS TAKEN ON MY BEHALF.
