RE: AGENDA ITEM PER CHARTER TO INVESTIGATE PHARR PD CORRUPTION

Honorable City Manager:

I am writing to request your office present an agenda item requesting the Pharr City

Commission, under the powers provided by the City Charter, investigate the City of Pharr Police

Department for organized criminal activity, including tampering with witnesses, tampering with

evidence, filing false police reports, filing false internal affairs reports, retaliation, and violating

my civil rights, including harassing a candidate for office and voter. These allegations were proven

true by a Third Party Review unanimously approved by city commission and assigned to the Law

Firm of Dykema Cox Smith.

I have lost count as to how many times I have requested the CITY perform this duty as

provided by the city charter.

I am also requesting the City Manager suspend Assistant City Manager Hilda Pedraza for

a quid pro quo arrangement with Pharr Mayor Ambrosio Hernandez and the City Commission for

failing to file criminal charges against former Commissioner Mario Bracamontes for filing a false

ballot application.

I am also requesting that Pharr Mayor Ambrosio Hernandez resign from all municipal,

county state and federal boards as mandated by interlocal agreements pending termination of

investigation into election fraud committed with Commissioner Ramiro Caballero, and Asst. City

Manager Pedraza.

I am also requesting that the Civil Service Commission counsel of Denton, Navarro, Rocha,

Bernal, Zech, P.C. be suspended until review of their role in appeals surrounding my illegal arrest

while a candidate for the Pharr-San Juan-Alamo Independent School District Board of Trustees,

CR-1487-11-D. DNRBZ worked with the Joaquin Zamora, the Hidalgo County Assistant

Criminal District Attorney, and the D.A.’s Appellate Division, to hide evidence of my innocence

on several occasions. Taxpayers paid for these illegal actions.

Elected officials and city staff have failed to propose an investigation to the City Agenda

because of direct financial interests as DHR Health primary owners, Board of Managers

appointment, or to avoid prosecution, including incarceration, or loss of employment with CITY.

As such the CITY is requesting federal funds to benefit these agents under fraudulent

circumstances.

I present the following facts to support a City Agenda item to investigate Pharr PD and

CITY corruption tied to my multiple arrests by Pharr PD:

 DHR Health Board of Managers representative, Mayor Hernandez was aware prior to his
election that Mario Bracamontes was not a resident of Pharr as required by CITY charter.

 Commissioner Ramiro Caballero lost to Bracamontes and met with an attorney to file a
challenge based on residency.

 Commissioner Caballero was advised by counsel that his suit would appear to be sour
grapes.

 Pharr resident Raul Gonzalez filed paperwork with the CITY to challenge Bracamontes
residency.

 I proposed the city challenge Bracamontes election based on fraud by our election official,
former City Secretary Pedraza, who knowingly filed and notarized a false ballot
application. Pedraza received numerous documents from CITY planning and zoning which

had several different addresses for Bracamontes prior to the one-year requirement to be
eligible for commissioner.

 I presented evidence of fraudulent ballot application and other documents in a Power Point
presentation before the City Commission.

 After being challenged based on residency, Bracamontes went to the PSJA ISD Personnel
Office and updated his school employment records, which listed another address prior to
charter requirements for election eligibility.

 On multiple occasions, I appeared before the PSJA ISD Board of Trustees to ask for a
review of the interlocal agreement with Pharr PD based on corruption, sexual assault of a
PSJA ISD student by a Pharr PD officer, and subsequent cover-up by the CITY.

 I filed a grievance with PSJA ISD to investigate police corruption during Board of Trustees
Election of 2010, when Pharr PD was actively looking to arrest me for interfering with a
narcotics bust in Las Milpas prior to my arrest involving K9 Officer Jose Tamez, who
planted narcotics on me and filed false police reports with Internal Affairs investigation
conducted by former Sgt. Santiago Solis as revealed by documents I reviewed while
participating with Dykema report. The illegal drug bust was documented by a 911 call.

 I requested minutes of meetings between former PSJA ISD Superintendent Daniel King,
Ph.D., and former City Manager Sandoval to discuss issues of police corruption but was
not provided any as they do not exist. Dr. King did indicate that Sandoval was not candid
and as a result PSJA ISD has not addressed the issue adequately.

 DHR Health has contracts and programs with PSJA ISD.

 PSJA ISD Board of Trustees member Jorge Zamrano, currently Pharr Municipal
Prosecutor is aware of my concerns about Pharr PD corruption and the violation of civil
rights as it pertains to juvenile defendants at PSJA ISD, Valley View ISD, and Hidalgo
ISD.

 On several occasions, I attempted to retain Marissa Carranza-Hernandez to file a civil suit


on my behalf against the CITY. Our newest municipal judge is also intimately aware of
Pharr PD corruption, including false reports filed by investigators to secure warrants, but
has not acted to prevent injustices against poor juvenile defendants in Pharr and Las Milpas.

 I was appointed by unanimous vote to become a board member to the Pharr Civil Service
Commission.

 I was removed allegedly due to “moral turpitude” and alleged City Manager “board
member appointment protocol” as explained by former City Manager Juan Guerra.

 By unanimous vote, city officials were aware of my excellent moral character, exoneration
on multiple arrests, and was challenging my conviction for evading arrest. Additionally,
Mayor Hernandez passed the Dykema Cox Smith investigation based on my
recommendation. CITY appointed Marissa Carranza-Hernandez after my numerous
attempts to get her appointed to bench.

 Juan Guerra was appointed to city manager despite an alleged domestic violence issue in
which Pharr PD did not book him and transport to Hidalgo County Detention.

 This incident must be what Juan Guerra meant when he said that he knew what I felt like
because he had been in former City Manager Fred Sandoval’s “dog house.”

 I called Mayor Hernandez to express my dissatisfaction that Guerra had been appointed to
city manager and I was assured that the CITY had discussed and taken into account his
alleged domestic incident during executive session.

 Most recently, many local news outlets have reported that Edinburg City Manager Juan
Guerra had all but been hired and resigned from City of Edinburg to join DHR Health.

 City Manager Juan Guerra never presented an agenda item to review Dykema Report. I
believe this constitutes a quid pro quo situation to prevent me from running for elected
office or exposing DHR Health representatives to prosecution for election fraud.

 DHR Health has been a mobile election site for Hidalgo County, especially during Health
District initiatives.

 I was replaced on the Pharr Civil Service Commission by Mario Lizcano, Government
Affairs Liaison for DHR Health, who was also aware of Pharr PD corruption against me.

 Civil service board counsel DNRBZ conspired with Joaquin Zamora and Michael Morris
to hide evidence of my innocence during several appeals.

 Pharr City Attorney Patricia Rigby was present when new exculpatory evidence was
presented in CR-1487-11-D(3) that was gleaned from Dykema Report.

 Hilda Pedraza was promoted to a new position despite engaging in election fraud and
organized criminal activity with Mayor Hernandez, City Commissioner Roberto Carrillo,
City Commissioner Eleazar Guajardo, City Commissioner Ricardo Medina, and
Commissioner Ramiro Caballero.

This list is not at all comprehensive, but does adequately address why I believe the CITY

has not acted to remove high ranking Pharr PD officials and officers. Moreover, DHR Health, its

Board of Managers, and stockholders continue to profit from these quid pro quo arrangements

between the CITY and PSJA ISD, which just voted to create its own police force despite their

knowledge of illegal police actions against me that prevent me from running for public office.

I hope that you forward an agenda item to address my concerns as soon as possible.
