The Title Mortgage by Deposit of Title Deeds falls under Section 58(f) of the
Transfer of Property Act, 1882. It basically speaks about a mortgage being made to
secure debts or advances made, or to cover future advances.
Mortgage by deposit of title deeds is an important part of the Mortgage Law. It is
essential that we understand this part of the Mortgage law to understand it in
whole. In this paper focus is placed upon Mortgage by deposit of Title Deeds. To
substantiate and explain this title, further reliance is placed upon case laws and
other judicial pronunciations. This paper deals with the delivering of documents of
title to immovable property with an intent to create a security thereon.
The research methodology adopted to complete this paper is doctrinal. The
resources used are majorly secondary data sources (books, articles, judgments)
inclusive of other online sources.
