The wording of paragraph 2(a) of the summonses requires each witness to produce to the Panel the witnesses’ “primary evidence on Topic 081 — Rezoning and Precincts (Geographical Areas), as well as any associated supplementary statements and maps’. 3. As noted in our email to Julie McKee dated 17 March 2016, given the broad wording of Paragraph 2(a) of the summonses, the witness summons could arguably require each witness to produce all primary statements prepared by that witness for Topic 081. As recorded in our email of 17 March 2016, we have confirmed with Claire Kiman, Counsel for HNZ, that this was the intent of the summonses, and agreed that the evidence to be produced in response should reflect the above list (rather than, for instance, unnecessarily producing precinct evidence or rezoning evidence on geographical areas not listed above). 5. The affected Council witnesses have therefore confined production of their evidence in tesponse to the summonses of 16 March to the primary evidence, supplementary evidence and associated maps relating to the rezoning areas listed in paragraph 3 above.
