On the basis of specific information received from the CBDT; the telephone lines of Ms Nira Radia and some of her associates were put under observation after obtaining .perrnission from the Home Secretary. Ms Nira Radia is chief of Mis Vaishnavi Corporate Consultants Pvt Ltd, Mis Noesis Strategic Consulting Sen-ices Pvt. Ltd., MIs Vitcom and Mis Neucom Consulting. These companies are involved iii consulting in Telecom, Power, Aviation and Infrastructure. These entities not only manage the media bur as per conversations. apparently try to influence policy changes and decisions of the various government departments to suit the

commercial requirements of their clients. "

I. From conversations it appears that Ms Nira Radia might have had some role with regards to the award of Telecom licenses. In a conversation she guides a new ielecom operator on the need to delay the inflow of funds from the overseas investor and not to give the impression to the

government that there bas been any "windfall' profit. .

2. There are some direct conversations between Ms. Radia and Telecom Minister. In some other conversations Ms Radia boasts to have helped some of the telecom operators in their efforts to obtain licenses/spectrum. Ms Radia has also been in regular touch with Shri Chandolia

FOR THE MONTH OF JUNE. 2009

The 9 lines kept under surveillance during the month belong to two separate groups. The first group relates to a Public Relation (PR) agency and comprises of 6 lines under interception for )20 days' from 20111 AUgust 2008 onwards. The group was again brought under interception vide order dated Illh May 2009 and the period of 180 days would be over on J Od! July 2009. The conversation of the. target and associates indicate laundering and structured payoffs-transactions and Iiaison. 'for . projects of telecom and power. They also indicate cross border transactions related to Telecom. Petroleum and also media. With reference to corporate client of the target, after processing row intelligence. actionable infonnation of possible cross border

. transactions has been passed on to (he field formation for further necessary action. As regards other clients. there are series of inputs mostly relating to third pari?'. conversations contents whereof need some preliminary cross-verification before coming to a 'logical conclusion. A final impact analysis shall be submitted once the interception in this ~up is concluded.

The second group comprises 3 numbers. CaUs in 1bis group appear to relate to financial transactions ranging in crores including foreign bank accounts and unauthorized international derivative transactions. There are also some cellsrelating to cricket betting. These people also appeared to be involved in cross border transactions about which some information has been gathered. Theinfonnation processed so far has already been passed on to the field formation for further action. No further extension is being sought in this case, Detailed impact analysis shall be submitted.

As regards other clients, there are series or inputs mostly relating to third party conversations. Telephone conversations . suggest that confidential documents and policy papers seem to reach the target, Conversationsseemto hint that the target has either handled and facilitated cross border transfer of funds" or is in the know of the same.

The target as pertelephone conversations along with associates has apparently fronted for someone to acquire a news channel in'lndia. There appear'to have been some cross border transactions in this acquisition. The target is also spreading business connections to AfricaincJuding investments in Guinea and Senegal.

Conversations of the target with a businessman. who is also a government nominee 011 Jl state PSUappears to suggest that the target along. With the businessman is trying to facilitate the takeover of this p~'U by a large client of the target. A conversation also indicates a quid-pro-quo with respect to another PSU.

The target has, as per telephone conversations, facilitated for a fee#filing of PrLs by NGOs to hurt the business interests of the rivals of clients. There are some third-party conversations relating to other corporate entities which indicate manipulations in their books. These entities include clients of the target and also some of their rivals. The contents ·of these conversations are being processed.

2. The second group comprises 3 (three) numbers. Calls in this group appear' to relate to financial transactions including foreign bank accounts and unauthorized international derivative transactions. There are also some calls relating to betting in cricket and other sports .. These people also appeared to be involved in cross border transactions such as acquisition of assets through tax havens. Some of these proceeds have apparently come back ·into defunct Indian companies. This intelligence has been .matched against infonnation in the public domain. The information thus processed has

. already been passed on to DIT (Inv) Delhi formation for further action.

There is a whisper in Whispers in Corridors which states that "the uncrowned Maharaja of Indian Telecom (implying Shri Sunil Mittal ) is banking on woman power (implying Neera Radia) to smoke the piece pipe with India's Telecom Minister A Raja in midst of a major global take over & his appetite for precious spectrum ": (The Detailed whisper is given at Annexure I)

This whisper can be better understood in the following context:

Telephone lines of Neera Radia and some of her associates have been put under observation. Neera Radia is chief of Vaishnavi Corporate Consultants Pvt Ltd, Noesis Consulting, Vitcom and Neucom Consulting (started in November 2008). Vitcom has been handling the business of NDTV Imagine while Neucomm was set up essentially for the purpose of handling the affairs of the Mukesh Ambani Group of industries, Vaishnavi handles the media affairs as well as.' 'environment management' for the Tata Group, Unitech, Star TV along with other corporate clients. While Noesis officially comprises of retired senior bureaucrats. it is controlled by Smt Radia and is involved in consulting in Telecom, power, Aviation and Infrastructure. These entities not only manage the media but also allegedly ensure that policy changes and decisions of the various government departments suit the commercial requirements oftheir clients. The group also interferes in the appointment of ministers so as to dovetail the same to the commercial interests oftheir clients.

Intercepted" Telephone conversations suggest that Neera Radia bas had a role to play in the managing of policy changes at the highest level of government including those leading to the award of Telecom license to Unitech Wireless. the Telecom arm of the Unitech, Swan Telecom, Aircell and for various other telecom operators. Very often, telephone conversations seem to suggest, a large number of confidential documents and policy papers seem to reach Smt Radia, Further Vaishnnvi through certain chartered accountant associates, who are entry operators, provide services for arrangement of adjustment entries and structured payoffs.

The following" are some otherinputs relating to teleeom sector picked ';IP from the conversations:

I. Mrs Radia is a very close associate of Sbri A. Raja, Telecom Ministerand has been instrumental "in getting licenses and spectrum to the following:

i, SwanTelecom

ii. Aircell

iii. Urtitech Wireless

iv. Datacom.

a. Of the above Datacom setup by HFCL group along with Mr. Dhoot of Videocon is alleged to be having funding through the Mukesh Ambani group and an employee of Reliance, Manoj Modi who is constantly in touch with Mrs. Radia.

b. Swan on paper backed by a Mumbai based real estate company, Oynamix Balwas group of companies was apparently through the efforts of Nira Radia favoured by Raja Minister for Telecom in allotment of license and also in the priority list of spectrum, in Delhi and Mumbai circle, as per the seniority list

prepared by the Department of Telecom.UAE's telecom giant Emirates Telecommunications Corp (Ehtisalat) controls about 45% of Swan Telecom for up to $900 million; This deal values Swan Telecom at $2 billion. At present Mauritius-based Delphi Investments Ltd holds 9.9% stake in Swan .. A 90.1 % stake in Swan Telecom is owned by Tiger Trustees Pvt. Ltd, which in turn is 99.8 per cent owned by Dynamix BaJwas Ltd which has allegedly received round tripped funds. The conversations seem to suggest that the minister Shri. A Raja and Mrs. Radia too have equity interest in Swan and her associates are to be put. on the board.

2. There is a long conversation between Mr.· Ratan Tata and Mrs. Radia whieh establishes that Mr. Tata wanted to prevent Dayanidhi Maran from becoming telecom Minister at any cost. Apparently. Tata indirectly controls equity in Airce! through Maxis Communication and Apollo, Mr. Tata felt the need to' exit telecom (Tata Telecom or Aircell is not clear) in case Mr. Maran become Minister (telecom). '

3. Tata through Voltas is in touch with Ncera and Ratnam. CA of Ammal wife of M Karunanidhi, They are apparently going to construct a building in Chennai on a land, controlled by "Trill" with the Karunanidhi family as payoffDMK for keeping Maran out of Telecom,

4. On Mrs. Radia's &. Kanbnozhi's behalf Barkha Dutt &. Vir Sanghvi were negotiating for ministerial birth DMK members especially Raja with Congress members.

5. Airtel wanted Raja out and to take back spectrum provided. He terms ADAGgroup as Evil Empire.

6. Some close associates of Mrs. Radia in relation to this work are, (i) TaTUn Das, (ii) Vir Singhvi &. (iii) Sunil Arora lAS officer Rajsthan Cadre.

7. As mentioned earlier Mrs. Radia was very close to Ratnam, CA of Mrs. Karunanidhi (Ammal), Kanimozhi and off course Raja. She was to meet Raja in relation to their

common investment in Swan Telecom and other matters. .

8. Sunil MiHal of Bharti Airtel had been lobbying to prevent Raja from becoming Telecom Minister essentially for three reasons. first (i) GSM lobby aggrieved at the favor shown to CDMA lobby on spectrum; (ii) Mr. Mittal was lobbying for Dayanidhi Maran. (iii) there appears to be some irregularity in purchase of Vodafone's investment in Bharti Airtel this is being reported separateJy. Sunil Mittal contacted Mrs. Radia and wanted her to work for him on informal basis. Mrs. Radia said she would as long as there was no conflict of interest with TATA's. However. she would help him mend fences (for a fees with Telecom Minister Raja). There is a third person who apparently met Sunil Mittal at Sohail Seth's house who is acting 8S a link between Mr. Mittal and Mrs. Radia. (110537)

9. The same gentle man also spoke to Mr. Mukesh Ambaniwho expressed his reservation about Mrs. Neera Radia working for Mr. Mittal and so Mrs. Radia and this gentle man will do it on an informal basis.'

10. Apart from allegedly managingthejelecom license for Unitech, Smt Radia has handled' and facilitated cross border transfer of funds. Telenor has apparently purchased 60% of the equity for RI. 6120/- crore thereby valuing the project at over Rs. 10,000 crore and the value of the license at over Rs. 4000 crore. This is far in excess of the market. value of the telecom license and in the equity that is sought to be brought in within the next 12 months part of the round trip funds would make their way into India. Another conversation between Radia and Ajar Chandra suggest that the government is investigating the 'Telecom license issue has sought, details of sale of, interest in the telecom venture.The crux of the conversation is to 'stagger the inflow of funds and to give the Impression to the government that the funds have only come into the telecom company and that here has not been any 'windfall' Sain to the

With regards to the Tata group telephone conversations with regards to the Tata group suggests that the entire media and political environment management.for the failed Singur project and the subsequent shifting to Gujrat were handled by Neera Radia and her associates. 111is included "managing" important CPT (M) Ieaders; (Neera apparently has an independent very good relationship with certain left front and Clro leaders).

Apart from allegedly managing the telecom license for Unitech, telephone conversations seem to hint that Smt Radia has either handled and facilitated cross, border transfer of fundsor is in the

know of the same. Lehmann brothers were supposed to invest three trenches in Unitech's Mumbai project. The first investment that was done was Rs. 740 crores towards 50% of Unitech's holdings in Shivalik Ventures Pvt ltd 1150-50 N SPY between Unitech and Rohan.' Devlopers Mumbai. The balance was to come in two tranches of around US$ 550 million. Analysis of a series of conversations reveal that of the investments to be routed into India through Lehman Brothers Real Estate Partners, investing "third party funds in real estate" at least a part comprised round tripped funds and when Lehmann brothers collapsed, only one tranche had come and the. balance was stuck. Conversations suggest that part of the funds would

be re-routed through the deal structured with the International partner in the sale of equity in the Unitech Telecom entity. The initial discussions appeared to be with Telecom Italia as wellas Telenor while the deal was finally closed with Telenor of Norway.

Another conversation' between Radia and Ajay Chandra of Unitech .suggest that tbe government is investigating the Telecom license issue and has sought details of sale of interest in the telecom venture. The crux of the conversation is-to stagger the inflow of funds and to give-the impression to the government that the funds have only come into thetelecom company and tbat here has not been any 'windfall' gain to the promoters ofUnitecbas such.

A series of conversation of the associates of Anil Bansal and RS. Bansal associates of Radia also suggest that Unitech group, apart from others had taken accommodation entries to the time ofRs. 200 to 300 crore Wider the guise of purchase of computer software from them apparently to ~e out cash and suppress income. Furtherthe operatorsclaim to have also provided loan entries so

as to take out cash. The operators, nervous by the problems of Unitech and the fall of the stock

markets were keen to reverse these loan entries to prevent any future recoveries from them or their entities.

Parimal Nathani, associate of Man oj Modi, of Mukesh Ambani group in conversation seems to be trying to implicate members of the ADAG for being responsible in the PIL filed against the RIL & RPL merger where certain people have been caught in a. string operation seeking money from RIL to withdraw the PIL.
