Suitability Checklist

Ask the following questions to determine suitability:
Has your client been unable to resolve their dispute by agreement?
Your client does not have an ongoing relationship with the other party,
and will not have to deal with that party directly in the future.
Does the dispute involve a long-standing conflict which has involved
an irreconcilable breakdown in the relationship between the parties?
Is there a fundamental dispute on the basic facts that underlie the
clients conflict?
Does your client want to resolve one or more aspects of their dispute
privately?
Do both parties require confidentiality and privacy?
Does one or both parties wish to have a final verdict with no chance of
appeal?
Your client is not concerned about establishment of precedent or
articulation of public policy.
Does your client wish to choose the decision maker themselves?
Do both parties agree that complex questions of fact or legal
interpretation are central to the conflict?
Is the conflict solely or principally of a commercial nature?
Does one of the parties seek an award of damages or a determination
on fact?
Can the dispute be resolved in one meeting?
