CIVIL ACTION COMPLAINT

1. At all times mentioned herein, Plaintiff, Benjamin W. Fisher, is an adult

individual who resides 210 Ashton Court, Pittsburgh, Allegheny County,

Pennsylvania.

2. At all times mentioned herein, Plaintiff, Benjamin W. Fisher is the

President of GAC Systems, LLC d/b/a Maximum 4 Minimum Motors.

3. At all times mentioned herein, Plaintiff, GAC Systems, LLC, d/b/a

Maximum 4 Minimum Motors, is a corporation organized and existing under the

laws of the Commonwealth of Pennsylvania, with its principal place of business

at 57 Economy Grade Road, Coraopolis, Allegheny County, Pennsylvania.

4. At all times mentioned herein, Defendant, Shai Ivgi, is an adult individual

who resides at 532 Baer Avenue, Hanover, York County, Pennsylvania.

FIRST CAUSE OF ACTION - LIBEL

5. On or about March 3, 2010, Defendant published false and defamatory

. matter on the world wide web about Plaintiffs at www.ripoffreport.com alleging generally throughout his publication that he purchased a vehicle from Plaintiffs in 2007 and was subjected to various unethical or unlawful business practices, stating in part "Ben Fisher is still ripping people off on the internet via www.maximum4minimummotors.com .. and "[f]or those of you thinking of doing business with Ben look elsewhere first." A copy of said publication is attached hereto as Exhibit "A" and incorporated herein by reference.

6. The internet posting referred to Plaintiffs by name throughout, was made of and concerning Plaintiffs, and was so understood by those who read the information at www.ripoffreport.com.

7. Defendant's statements generally that he purchased a vehicle from Plaintiffs and that he was subjected to various unethical or unlawful business practices and specifically that "[Plaintiff] is still ripping people off on the internet via www.maximum4minimummotors.com .. are false as they pertain to Plaintiffs.

8. The posting at www.ripoffreport.comis libelous on its face. It clearly exposes Plaintiffs to hatred, contempt, ridicule and obloquy because it charges Plaintiffs with having committed unethical or unlawful business practices.

9. The Defendant's internet posting was seen and read on or about March 4,

2010 and continues to be seen and read today at www.ripoffreport.com.

10. As a proximate result of the above-described publication, Plaintiffs have suffered loss of their reputation, shame, mortification, and irreparable injury to their business, in an amount to be established by proof at trial.

11. The above-described publication was not privileged because it was published by Defendant with malice, hatred and ill will toward Plaintiffs and the desire to injure them, in that Defendant had verbally expressed, in a public, internet forum, a specific desire and intent to harm Plaintiff's by publishing such" false matter. Because of Defendant's malice in publishing, Plaintiffs seek punitive damages, in an amount to be established at trial.

WHEREFORE, Plaintiffs demand judgment against Defendant for:

1. Compensatory damages in excess of $25,000.00;

2. Punitive Damages;

3. Interest as allowed by law;

4. Costs of suit; and

5. Such other and further relief as this Court may deem just and proper.

SECOND CAUSE OF ACTION - LIBEL

12. On or about April 18, 2010, Defendant published false and defamatory matter on the world wide web about Plaintiffs at www.complaintsboard.com alleging generally throughout his publication that he purchased a vehicle from Plaintiffs in 2007 and was subjected to unethical or unlawful business practices, stating, in part that "8en Fisher is still ripping people off on the internet via www.maximum4minimummotors.com .. and "you are a slimy car salesman you will tell the unknowing anything to attempt to swindle them out of their hard earned money" and "you were reported yet again, for making uninvited advances towards underage males on you tube and xbox live". A copy of said publication is attached hereto as Exhibit "8" and incorporated herein by reference.

13. The internet posting referred to Plaintiffs by name throughout, was made of and concerning Plaintiffs, and was so understood by those who read the information at www.complaintsboard.com .

14. Defendant's statements generally that he purchased a vehicle from

15. The internet posting at www.complaintsboard.comis libelous on its face. It clearly exposes Plaintiffs to hatred, contempt, ridicule and obloquy because it charges Plaintiffs with having committed unethical or unlawful business practices, and crimes of moral turpitud~.

16. The Defendant's internet posting was seen and read .on or about April 18,

2010.


18. The above-described publication was not privileged because it was

published by Defendant with malice, hatred and ill will toward Plaintiffs and the

desire to injure them, in that Defendant had verbally expressed, in a public internet forum, a specific desire and intent to harm Plaintiff's by publishing such false matter. Because of Defendant's malice in publishing, Plaintiffs seek punitive damages, in an amount to be established at trial.







THIRD CAUSE OF ACTION - LIBEL

19. On or about May 26, 2010, Defendant published false and defamatory matter on the world wide web about Plaintiffs at www.businessdirectory.bizjournals.com alleging generally throughout his publication that he purchased a vehicle from Plaintiffs in 2007 and was subjected to unethical or unlawful business practices, stating, in part that "Ben Fisher is still ripping people off on the internet via www.maximum4minimummotors.com .. and "you are a slimy car salesman you will tell the unknowing anything to attempt to swindle them out of their hard earned money" and "you were reported yet again,

for making uninvited advances towards underage males on you tube and xbox live". A copy of said publication is attached hereto as Exhibit "C" and incorporated herein by reference.

20. The internet posting referred to Plaintiffs by name throughout, was made of and concerning Plaintiffs, and was so understood by those who read the information at www.businessdirectory.bizjournals.com .

21. 22. The internet posting at www.businessdirectory.bizjournals.comis libelous on its face. It clearly exposes Plaintiffs to hatred, contempt, ridicule and obloquy because it charges Plaintiffs with having committed unethical or unlawful business practices, and crimes of moral turpitude.

26. On or about June 7, 2010, Defendant published false and defamatory matter on the internet about Plaintiffs at www.pissedconsumer.com alleging generally throughout his publication that he purchased a vehicle from Plaintiffs in 2007 and was subjected to unethical or unlawful business practices, stating, in part that "Ben Fisher is still ripping people off on the internet via www.maximum4minimummotors.com .. and "you are a slimy car salesman you will tell the unknowing anything to attempt to swindle them out of their hard earned money" and "you were reported yet again, for making uninvited advances towards underage males on you tube and xbox live". A copy of said publication is attached hereto as Exhibit "0" and incorporated herein by reference.

27. The internet posting referred to Plaintiffs by name throughout, was made of and concerning Plaintiffs, and was so understood by those who read the information at www.pissedconsumer.com.

Defendant's statements generally that he purchased a vehicle from Plaintiffs and that he was subjected to various unethical or unlawful business practices and specifically that "[Plaintiff] is still ripping people off on the internet via www.maximum4minimummotors.com .. and that "[Plaintiff] [is] a

30. The Defendant's internet posting was seen and read on or about May 26,

2010 and continues to available to read today at www.pissedconsumer.com.


32. The above-described publication was not privileged because it was published by Defendant with malice, hatred and ill will toward Plaintiffs and the desire to injure them, in that Defendant had verbally expressed, in an public internet forum, a specific desire and intent to harm Plaintiff's by publishing such false matter. 33. On or about July 13, 2010, Defendant published false and defamatory

matter on the internet about Plaintiffs at www.merareview.com alleging generally

throughout his publication that he purchased a vehicle from Plaintiffs in 2007 and

was subjected to unethical or unlawful business practices, stating, in part that

"Ben Fisher is still ripping people off on the internet via

www.maximum4minimummotors.com .. and "you are a slimy car salesman you

will tell the unknowing anything to attempt to swindle them out of their hard

earned money" and "you were reported yet again, for making uninvited

advances towards underage males on you tube and xbox live". A copy of said

publication is attached hereto as Exhibit "E" and incorporated herein by

reference.

34. The internet posting referred to Plaintiffs by name throughout, was made

of and concerning Plaintiffs, and was so understood by those who read the

information at www.merareview.com.

35. Defendant's statements generally that he purchased a vehicle from

Plaintiffs and that he was subjected to various unethical or unlawful business

practices and specifically that "[Plaintiff] is still ripping people off on the internet

37. The Defendant's internet posting was seen and read on or about July 13,

2010 and continues to available to read today at www.merareview.com.

SIXTH CAUSE OF ACTION - FALSE LIGHT -INVASION OF PRIVACY

40. Plaintiff incorporates by reference all of the foregoing allegations as if set

forth herein at length.

Defendant has published and continues to publish false and malicious statements about Plaintiffs, including but not limited to, alleging generally throughout his publications that he purchased a vehicle from Plaintiffs in 2007 and was subjected to unethical or unlawful business practices, stating, in part that "Ben Fisher is still ripping people off on the internet via www.maximum4minimummotors.com .. and "you are a slimy car salesman you will tell the unknowing anything to attempt to swindle them out of their hard earned money" and "you were reported yet again, for making uninvited advances towards underage males on you tube and xbox live".

42. Defendants defamatory statements about Plaintiffs placed Plaintiffs in a

false-light before the world wide public.

43. The false-light in which Defendant placed Plaintiffs would be highly

offensive to a reasonable person.

44. At all times relevant Defendant knew that his statements were false and

acted in reckless disregard of the truth.

45. At all times relevant Defendant's actions and conduct were malicious and

specifically designed to cause Plaintiffs irreparable harm.

46. Defendant's defamatory statements about Plaintiffs have had a deleterious impact on Plaintiffs and their business because they are forced to expend money to defend against false statements and Plaintiffs are embarrassed and humiliated.

47. Defendant's defamatory statements about plaintiffs has caused Plaintiffs to suffer irreparable harm and severely impaired their personal and professional reputation and standing worldwide.







SEVENTH CAUSE OF ACTION

TORTIOUS INTERFERENCE WITH BUSINESS RELATIONSHIPS.

48. Plaintiff incorporates by reference all of the foregoing allegations as if set

forth herein at length.

business constitute intentional interference with Plaintiff's existing and

perspective economic relations.

52. Defendant's false and malicious publications about Plaintiffs have caused

Plaintiff's irreparable harm and severely impaired their professional business

relations with clients and perspective clients worldwide.

I am surprised Ben Fisher is still ripping people off on the internet via www.maximym4mjnjmummotors.com. He promised me floor mats and software for my navigation system in the car I purchased from him back in 2007. He told me several times he mailed the things out, of course this was a lie to keep his eba y reputation. Truth be told Ben steers most of his ill sales away from ebay and sometimes even goes through the process of posting fake feedback for himself on ebay. , "' 'Found a BMW Xs on Ebay - the listing had expired before I had a chance to put in offer but called Ben Fisher, the owner and he said if! could do SX armunt he would do the deal. It was too good a deal to pass up.

I drove down and picked the vehicle up and drove back without a glitch. However, when I arrived home, I realized that the remote for the DVD was not in vehicle. I called Ben and it took about a month for him to put in courier, but finally did. He filled the paperwork out wrong, and they sent it back to him. Icalled him again and said he would retry. Nothing for months. I checked at the local dealer and they want $500+ for new one. I called him again and he said he'd do the next day. I received an email from him that he was not able to send it because it had to go across the border into Canada I buy tons of stuff on Ebay and generally receive it within a week. In fact, I just bought tires and rims from LA. and they arrived within 6 days. HOW HARD COULD IT BE TO COURIER A TINY REMOTE? I've contacted him several times since pleaded for him to resend, but no reply.

Not to mention the plethora of problems I've had with the Xs. Wouldn't have to mention but since he won't send remote has really ticked me off, so I will. First off, there were no rear floor mats, or cargo cover. I had a problem with the steering which was apparently replaced by local Pittsburgh BMW dealer, but they installed new one wrong, so I had to pay to fix since problem was caused by another dealer. The rubber firewall seal was also ripped - $500 for a new one, again not covered under warranty. New front brakes not properly lubricated, $125 to service. Bunch of pennies rattling around in the center consoleanother $125 to have removed!

'" 'Found a BMW X5 on Ebay - the listing had expired before I had a chance to put in offer but called Ben Fisher, the owner and he said if I could do $X amount he would do the deal. It was too good a deal to pass up.

I drove down and picked the vehicle up and drove back without a glitch. However, when I arrived home, I realized that the remote for the DVD was not in vehicle. I called Ben and it took about a month for him to put in courier, but finally did. He filled the paperwork out wrong, and they sent it back to him. I called him again and said he would retry. Nothing for months. I checked at the local dealer and they want $500+ for new one. I called him again and he said he'd do the next day. I received an email from him that he was not able to send it because it had to go across the border into Canada. I buy tons of stuff on Ebay and generally receive It within a week. In fact, l just bought tires and runs from LA, and they arrived within 6 days. HOW HARD COUill IT BE TO COURIER A TINY REMOTE? I've contacted him several times since pleaded for him to resend, but no reply.

Not to mention the plethora of problems I've had with the X5. Wouldn't have to mention but since he won't send remote has really ticked me off, so I will. First off, there were no rear floor mats, or cargo cover. I had a problem with the steering which was apparently replaced by local Pittsburgh BMW dealer, but they installed new one wrong, so I had to pay to fix since problem was caused by another dealer. The rubber firewall seal was also ripped - $500 for a new one, again not covered under warranty. New front brakes not properly lubricated, $125 to service. Bunch of pennies rattling around in the center console - another $125 to have removed!

''''Found a BMW X5 on Ebay - the listing hadexpjred before I had a chance to put in offer but called Ben Fisher, the owner and he said if I could do $X amount he would do the deal. It was too good a deal to pass up.

I drove down and picked the vehicle up and drove back without a glitch. However, when I arrived home, I realized that the remote for the DVD was not in vehicle. I called Ben and it took about a month for him to put in courier, but finally did. He filled the paperwork out wrong, and they sent it back to him. I called him again and said he would retry. Nothing

for months. I checked at the local dealer and they want $500+ for new one. I called him again and he said he'd do the next day. I received an email from him that he was not able to send it because it had to go across the border into Canada. I buy tons of stuff on Ebay and generally receive it within a week. In fact, I just bought tires and rims from LA. and they arrived within 6 days. HOW HARD COULD IT BE TO COURIER A TINY

REMOTE? I've contacted him several times since pleaded for him to resend, but no reply.

Not to mention the plethora of problems I've had with the X5. Wouldn't have to mention but since he won't send remote has really ticked me off, so I will. First off, there were no rear floor mats, or cargo cover. I had a problem with the steering which was apparently replaced by local Pittsburgh BMW dealer, but they installed new one wrong, so I had to pay 10 fix since problem was caused by another dealer. The rubber firewall seal was also ripped - $500 for a new one, again not covered under warranty. New front brakes not properly lubricated, $125 to service. Bunch of pennies rattling around in the center console - another $125 to have removed!

When I inspected vehicle poyor to purchase I notice several things that needed attention all cosmetic but the fact that he tried to hide them made me want them replaced. He agreed to do so. As I went to leave after promised a full tank of gas I notice that the tank was on empty the paperwork was already done or I would have left without the car. I left with the vehicle, a mechanically sound vehicle, with full expectations that the blemishes would be repaired. I did not get it in wrotlng. A huge mrstake on my part. Its been over a month and Ben sun has not made good on hIS word a word that WIll forever be useless. I have made several attempts to contact Ben via phone and email neither have been successful. Unfortunately, I will have to pay for the repairs rnyselt, Hopefully he will have no further victims .
