rights and remedies'now or later promulgated,
with respectto suchprotectionand preservationof real
property interests.

9' That the Defendant,Herman Lamison,

admits that he obtaineda mortgage from American
Home Mortgage, but has no knowledge of,
nor was Defendant,ever notified of an assignmentto
 Citibank, N.A. as Trustee, upon information and beliel, Plaintiff has
never provided Defendant
Herman Lamison with a proper assignmentof the moftgage
and therefore Defendant alleses that
Plaintiff doesnot have standingto commencethis
action.

EIGHTH AFFIRMATIVE DEFEN$E

i0' That the Plaintiff has not complied with the terms
of Chapter Section 17, amending
RPAPL Section 1302 having failed to give proper
notice to the Defendant.RpApL Section 1302
states:

"l' Any complaint servedin a proceedinginitiated pursuant

to this article relating to
a high-costhome loan or a subprimehome loan, as such
terms are defined in section
6-l and 6-m of the banking I,u*, respectively,must contain
an affirmative allegation
that at the time the proceedingis .o--"n".d, the plaintiff (a) is the owner and
holder of the subject mortgage and note, or has bein
delegatedthe authority to
institute a mortgage foreclosure action by the owner
and holder of the subject
mortgageand note; and (b) has complied with all of the provisions
of Banking Law
Section 595-a ["Regulation of mortgage brokers, mortiage
bankers and exempt
organizations"],and any rules and regulationspromutga6a
thereunder,Section 6-l
f"High-cost home loans") or 6-m ["subprime home loais"]of the Banking Law, and
Section1304["Requiredprior notices"]of this article".

I 1' Upon information and belief, the loan issuedby Plaintiff is

a high cost or subprimehome
loan.

1' Dismissing the Plaintiffs complaint herein and awarding interest, costs
