The Court, having taken the above-entitled matter under submission on 3/14/11, now makes the
following ruling:
The court grants the motion for judgment on the pleading. The facts stated in the complaint are not
sufficient to support any causes of action for violation of the Elections Code. Further, the facts do not
support the elements of a state a cause of action to recover the costs of an election campaign under a
theory of common law fraud. The court cannot see that any amendments to the complaint will cure the
defects, so the motion is granted without leave to amend.
