Disciplinary Cases General Procedure Part-1

As soon as it comes to know that some lapses were committed;


and there is some prima- facie evidence against a person, a preliminary
investigation has to be conducted.

Statements have to be obtained from all persons inquired in the


presence of the person found committed lapses; and in each statement
signatures obtained from the person inquired and also from the person
found committed lapses. Statements have also to be obtained from other
persons even in the absence of the person committed lapses.

All the above statements have to be studied in depth and only


those statements which form basis for charges have to be taken into account;
and also records if any found basis for charges have also to be taken.

A charge sheet has to be drafted with utmost care - framing


charges without conclusions and without repetition of charges; but with
a pre-history of the lapses committed and also basis for each charge.
