In the case of: In the matter of: Application for restoration of above titled execution petition May it please your honour sir, The applicant submits as under: 1. That the above titled execution petition was pending before the Hon'ble Court and the date of hearing was fixed on 11.10.2011. 2. That at the time of the hearing of the case, the applicant in order to inform his counsel went to Munsiff Court, Anantnag. As my counsel was busy in arguing the matter before that court but when I reached to this court, the case was already called by the court and due to the absence of the counsel and the applicant, case was dismissed in default, as such the instant application. 3. That the case has been dismissed vide order dated 11.10.2011 due to absence of the applicant. 4. That the application for restoration of the Execution petition is within time and there is no deliberate or intentional delay on the part of applicant in filing the application. 5. That writ petition titled Secretary Iqbal Memorial Trust Vs Assistant Labour Commissioner Anantnag & another is pending disposal before Hon'ble High Court. In the premises, it is therefore most humbly prayed that the application may be allowed and the Execution Petition may be restored to its original number and same will be the ends of justice and law.
