7277,otherwiseknownasthe"MagnaCartafor DisabledPersons",withnewSections32and33,toreadasfollows: "CHAPTER8.OtherPrivilegesandIncentives "SEC.32.Personswithdisabilityshallbeentitledtothefollowing: (a)Atleasttwentypercent(20%)discountfromallestablishmentsrelativetotheutilizationofall servicesinhotelsandsimilarlodgingestablishmentsrestaurantsandrecreationcentersforthe exclusiveuseorenjoymentofpersonswithdisability (b)Aminimumoftwentypercent(20%)discountonadmissionfeeschargedbytheaters,cinema houses,concerthalls,circuses,carnivalsandothersimilarplacesofculture,leisureand amusementfortheexclusiveuseofenjoymentofpersonswithdisability (c)Atleasttwentypercent(20%)discountforthepurchaseofmedicinesinalldrugstoresforthe exclusiveuseorenjoymentofpersonswithdisability (d)Atleasttwentypercent(20%)discountonmedicalanddentalservicesincludingdiagnostic andlaboratoryfeessuchas,butnotlimitedto,xrays,computerizedtomographyscansandblood tests,inallgovernmentfacilities,subjecttoguidelinestobeissuedbytheDepartmentofHealth (DOH),incoordinationwiththePhilippineHealthInsuranceCorporation(PHILHEALTH) (e)Atleasttwentypercent(20%)discountonmedicalanddentalservicesincludingdiagnostic andlaboratoryfees,andprofessionalfeesofattendingdoctorsinallprivatehospitalsandmedical facilities,inaccordancewiththerulesandregulationstobeissuedbytheDOH,incoordination withthePHILHEALTH (f)Atleasttwentypercent(20%)discountonfarefordomesticairandseatravelfortheexclusive useorenjoymentofpersonswithdisability (g)Atleasttwentypercent(20%)discountinpublicrailways,skywaysandbusfareforthe exclusiveuseandenjoymentofpersonwithdisability

(h)Educationalassistancetopersonswithdisability,forthemtopursueprimary,secondary, tertiary,posttertiary,aswellasvocationalortechnicaleducation,inbothpublicandprivate schools,throughtheprovisionofscholarships,grants,financialaids,subsidiesandother incentivestoqualifiedpersonswithdisability,includingsupportforbooks,learningmaterial,and uniformallowancetotheextentfeasible:Provided,Thatpersonswithdisabilityshallmeet minimumadmissionrequirements (i)Totheextentpracticableandfeasible,thecontinuanceofthesamebenefitsandprivileges givenbytheGovernmentServiceInsuranceSystem(GSIS),SocialSecuritySystem(SSS),and PAGIBIG,asthecasemaybe,asareenjoyedbythoseinactualservice (j)Totheextentpossible,thegovernmentmaygrantspecialdiscountsinspecialprogramsfor personswithdisabilityonpurchaseofbasiccommodities,subjecttoguidelinestobeissuedfor thepurposebytheDepartmentofTradeandIndustry(DTI)andtheDepartmentofAgricultural (DA)and (k)Provisionofexpresslanesforpersonswithdisabilityinallcommercialandgovernment establishmentsintheabsencethereof,priorityshallbegiventothem. TheabovementionedprivilegesareavailableonlytopersonswithdisabilitywhoareFilipino citizensuponsubmissionofanyofthefollowingasproofofhis/herentitlementthereto: (I)Anidentificationcardissuedbythecityormunicipalmayororthebarangaycaptainofthe placewherethepersonswithdisabilityresides (II)Thepassportofthepersonswithdisabilityconcernedor (III)TransportationdiscountfareIdentificationCard(ID)issuedbytheNationalCouncilforthe WelfareofDisabledPersons(NCWDP). Theprivilegesmaynotbeclaimedifthepersonswithdisabilityclaimsahigherdiscountsamay begrantedbythecommercialestablishmentand/orunderotherexistinglawsorincombination withotherdiscountprograms/s. Theestablishmentsmayclaimthediscountsgrantedinsubsections(a),(b),(c),(f)and(g)astax deductionsbasedonthenetcostofthegoodssoldorservicesrendered:Provided,further,That thetotalamountoftheclaimedtaxdeductionnetofvalueaddedtaxifapplicable,shallbe includedintheirgrosssalesreceiptsfortaxpurposesandshallbesubjecttoproper documentationandtotheprovisionsoftheNationalInternalRevenueCode(NIRC),as amended." "SEC.33.Incentives.Thosecaringforandlivingwithapersonwithdisabilityshallbegranted thefollowingincentives: (a)PersonswithdisabilityshallbetreatedasdependentsundertheSection35(A)oftheNational InternalRevenueCode,asamendedandassuch,individualtaxpayerscaringforthemshallbe accordedtheprivilegesgrantedbythecodeinsofarashavingdependentsunderthesame sectionareconcernedand (b)Individualsornongovernmentalinstitutionsestablishinghomes,residentialcommunitiesor retirementvillagessolelytosuittheneedsandrequirementsofpersonswithdisabilityshallbe accordedthefollowing: (i)Realtytaxholidayforthefirstfiveyearsofoperationand

(ii)Priorityinthebuildingand/ormaintenanceofprovincialormunicipalroadsleadingtothe aforesaidhome,residentialcommunityorretirementvillage." SEC.2.RepublicActNo.7277isherebyamendedinsertinganewtitle,chapterandsectionafter Section38bedenominatedastitle4,chapters1and2andSections40,41and42toreadas follows: "TitleFour ProhibitionsonVerbal,NonverbalRidicule andVilificationAgainstPersonswithDisability "CHAPTER1.DeliverancefromPublicRidicule "SEC.39.PublicRidicule.Forpurposesofthischapter,publicridiculeshallbedefinedasanact ofmakingfunorcontemptuousimitatingormakingmockeryofpersonswithdisabilitywhetherin writing,orinwords,orinactionduetotheirimpairment/s. "SEC.40.Noindividual,grouporcommunityshallexecuteanyoftheseactsofridiculeagainst personswithdisabilityinanytimeandplacewhichcouldintimidateorresultinlossofselfesteem ofthelatter. "CHAPTER2.DeliverancefromVilification "SEC41.Vilification.ForpurposesofthisChapter,vilificationshallbedefinedas: (a)Theutteranceofslanderousandabusivestatementsagainstapersonwithdisabilityand/or (b)Anactivityinpublicwhichinciteshatredtowards,seriouscontemptfor,orsevereridiculeof personswithdisability." "SEC.42.Anyindividual,grouporcommunityisherebyprohibitedfromvilifyinganypersonwith disabilitywhichcouldresultintolossofselfesteemofthelatter." SEC.3.Section46ofRepublicActNo.7277isherebyamendedtoreadasfollows: "SEC.46.PenalClause.(a)AnypersonwhoviolatesanyprovisionofthisActshallsufferthe followingpenalties: (1)Forthefirstviolation,afineofnotlessthanFiftyThousandpesos(P50,000.00)butnot exceedingOnehundredthousandpesos(P100,000.00)orimprisonmentofnotlessthansix monthsbutnotmorethantwoyears,orbothatthediscretionofthecourtand (2)Foranysubsequentviolation,afineofnotlessthanOnehundredthousandpesos (P100,000.00)butnotexceedingTwohundredthousandpesos(P200,000.00)orimprisonment fornotlessthantwoyearsbutnotmorethansixyears,orbothatthediscretionofthecourt. (b)Anypersonwhoabusestheprivilegesgrantedhereinshallbepunishedwithimprisonmentof notlessthansixmonthsorafineofnotlessthanFivethousandpesos(P5,000.00),butnotmore thanFiftythousandpesos(P50,000.00),orboth,atthediscretionofthecourt. (c)Iftheviolatorisacorporation,organizationoranysimilarentity,theofficialsthereofdirectly involvedshallbeliabletherefore. (d)Iftheviolatorisanalienoraforeigner,heshallbedeportedimmediatelyafterserviceof sentencewithoutfurtherdeportationproceedings.

Uponfilingofanappropriatecomplaint,andafterduenoticeandhearing,theproperauthorities mayalsocausethecancellationorrevocationofthebusinesspermit,permittooperate,franchise andothersimilarprivilegesgrantedtoanybusinessentitythatfailstoabidebytheprovisionsof thisAct." SEC.4.ThetitleofRepublicActNo.7277isherebyamendedtoreadasthe"MagnaCartafor PersonswithDisability",andallreferencesonthesaidlawto"Disabledpersons"shalllikewisebe amendedtoreadas"personswithdisability". SEC.5.TheDepartmentofSocialWelfareandDevelopment,theNationalCouncilforthe WelfareofDisabledPersons,andtheBureauofInternalRevenue,inconsultationwiththe concernedSenateandHousecommitteesandotheragencies,organizations,establishments shallformulateimplementingrulesandregulationspertinenttotheprovisionofthisActwithinsix monthsaftertheeffectivityofthisAct.
