On the Supreme Court Order in JNUSU Election Case

The Supreme Court has passed an order in the JNUSU Election case today. The Court has vacated the stay on JNUSU Elections and modified its earlier stay order. However, the Court did not accept all the suggestions made by the Amicus Curiae in his petition. The Bench has agreed to grant the following exemptions from the Lyngdoh Recommendations for the conduct of JNUSU Elections: 1. The maximum age limit for M Phil/Ph D students has been increased from 28 years to 30 years. 2. There will be no requirement for attendance to contest elections. 3. Photocopied material would be allowed in election campaign subject to an expenditure limit of Rs 5000. The court did not accept the suggestions made for allowing people to contest for the office-bearers position for two times; retaining the original time frame prescribed in the JNUSU Constitution and changing the criteria for modifying the requirement of tried and convicted for criminal charges to charged or convicted. There will also be a Grievance Redressal Mechanism. With this latest Supreme Court judgment the way has been cleared for the conduct of JNUSU Elections subject to the new guidelines laid down by the court. The JSCs Counsel has told us that the next JNUSU Elections can be held in January 2012. A UGBM will be convened in the first week of January to elicit the opinion of the student community. The UGBM shall be held on 6.1.2012.
