x----------------------------x AFFIDAVIT OF WITNESS I, Juan dela Cruz, of legal age, single, student and a resident of 123 Catanduanes Street, Brgy. Bungad Quezon City. After having been duly sworn to in accordance with law do hereby depose and say that: 1. I personally know the victim since she is my classmate and she confided to me some of her problems; 2. On December 2, 2011, Friday at around 8:00 in the evening, I was at Far Eastern University (FEU) Manila attending my class; 3. It was 9:00 in the evening when the class ended and by that time I was walking along the alley around Morayta going to the place where I can get my book bind. There were around 5 persons at the alley. 4. While walking, I saw the victim and the accused talking. At first they were just talking with a soft voice in order not to attract others. However, when I passed by towards them, they were already shouting at each other; 5. I have heard about the baby, his family and the victim was already crying; 6. Before I reached my destination, I heard the victim shouted "hindi ko ilalaglag ang bata. Bhala ka sa pamilya mo magpaliwanag." Then I saw the victim ran and the accused followed her; 7. After I got my book bind around 9:15, I was walking back towards the main road
