The ANTI Hazing Law
The ANTI Hazing Law
The term organization shall include any club or the Armed Forces of the Philippines,
Philippine National Police, Philippine Military Academy, or cadet corps of the Citizen’s
Military Training, or Citizen’s Army Training. The physical, mental and psychological
testing and training procedure and practices to determine and enhance the physical,
mental and psychological fitness of prospective regular members of the Armed Forces
of the Philippines and the Philippine National Police as approved by the secretary of
National Defense and the National Police Commission duly recommended by the Chief
of Staff, Armed Forces of the Philippines and the Director General of the Philippine
National Police shall not be considered as hazing for the purpose of this act.
SECTION 4. If the person subjected to hazing or other forms of initiation rites suffers
any physical injury or dies as a result thereof, the officers and members of the fraternity,
sorority or organization who actually participated in the infliction of physical harm shall
be liable as principals. The person or persons who participated in the hazing shall
suffer.
a.) The penalty of reclusion perpetual if death, rape, sodomy or mutilation results
therefrom.
b.) The penalty of reclusion temporal in its maximum period if in consequence of the
hazing the victim shall become insane, imbecile, impotent or blind.
c.) The penalty of reclusion temporal in its maximum period if in consequence of the
hazing the victim shall have lost the use of speech or the power to hear or to smell, or
shall have lost an eye, a hand, a foot, an arm or a leg shall have lost the use of nay
such member shall have become incapacitated for the activity or work in which he/she
was habitually engaged.
d.) The penalty of reclusion temporal in its minimum period if in consequence of the
hazing the victim shall become deformed or shall have lost any other part of his/her
body, or shall have lost the use thereof or shall have been ill or incapacitated for the
performance of the activity or work in which he/she has habitually engaged for a period
of more than ninety (90) days.
e.) The penalty of prison mayor in its maximum period if in consequence of the hazing
the victim shall have been ill or incapacitated for the performance of the activity or work
in which he was habitually engaged for more than thirty (30) days.
f.) The penalty of prison mayor in its medium period if in consequence of the hazing the
victim shall have been ill or capacitated for the performance of the activity or work in
which he was habitually engaged for ten (10) days or more, or that the injury sustained
shall require medical attendance for the same period.
g.) The penalty of the prison mayor in its period if in consequence of the hazing the
victim shall have been ill or incapacitated for the performance of the activity or work in
which he was habitually engaged from one (1) to nine (9) days, or that the injury
sustained shall require medical attendance for the same period.
h.) The penalty of prison correctional in its maximum period if in consequence of the
hazing the victim shall sustain physical injuries, which do not prevent him/her from
engaging in his habitual activity, or work nor require medical attendance.
The responsible officials of the school or of the police, military or citizen’s army training
organization may impose the appropriate administrative sanctions on the person or
persons charged under this provision even before their conviction.
The maximum penalty herein provided shall be imposed in any of the following
instances:
c.) When the recruit, neophyte or applicant having undergone hazing is prevented from
reporting the unlawful act to his parents or guardians, to the proper school authorities or
to the police authorities, through force, violence, threat or intimidation;
e.) When the victim is below twelve (12) years of age at he time of hazing.
The owner of the place where the hazing is conducted shall be liable as an accomplice,
when he/she has actual knowledge of the hazing conducted therein but failed to take
any action to prevent the same from occurring. If the hazing is held in the home of one
of the officers of members of the fraternity, sorority, group, or organization, the parent
shall be held liable as principals when they have actual knowledge of the hazing
conducted therein but failed to take any action to prevent the same from occurring.
The school authorities including faculty members who consent to the hazing or who
have actual knowledge thereof, but failed to take any action to prevent the same from
occurring shall be punished as accomplices for the acts of hazing committed by the
perpetrators.
The officers, former officers or alumni of the organization, group, fraternity or sorority
who actually planned the hazing although not present when the acts constituting the
hazing were committed shall be liable as principals. Officers or members of an
organization, group, fraternity or sorority’s adviser who is present when the acts
constituting the hazing were committed and failed to take any action to prevent the
same from occurring shall be liable as a principal.
The presence of any person during the hazing is prima facie evidence of participation
therein as a principal unless he prevented the commission of the acts punishable
herein.
Any person charged under this provision should not be entitled to the mitigating
circumstances that there was no intention to commit so grave a wrong.
This section shall apply to the president, manager, director, or other responsible officer
of a corporation engaged in hazing as a requirement for employment in the manner
provided herein.
SECTION 5. If any provision or part of this Act is declared invalid or unconstitutional, the
other parts or provision thereof shall remain valid and effective.
SECTION 6. All laws. Orders, rules of regulations, which are inconsistent with or
contrary to the provisions of this Act, are hereby amended or repealed accordingly.
SECTION 7. This Act shall take effect fifteen (15) days after its publication in at least
two (2) national newspapers of general circulation.
Fraternities in the Philippines are social organizations of men in different colleges and
universities in the Philippines having common purpose, interests, and activities.

It is somewhat comparable to gangs as they are both organization of people. However, gangs
usually lack purpose and acceptance to communities. Usually linked with violence because
members tend to compete with each other. Unlike in fraternity, members have this humility to
help each other out and protect each other from an outsider.
[edit] Initiation
A person usually joins a fraternity to be recognized and be a part of something. The idea of
having some-"buddy" gives a feeling of confidence and security. In the Philippines, most of
those who join fraternities are middle class students seeking protection. Others are students who
come from the provinces and seek out fraternities that group them among ethnic or regional
lines. Some in universities, join as to be part of an "elite" group of a particular department,
division, and/or course of study.
Before one can join a certain fraternity, he must undergo a series of tasks approved by that
certain group. These tasks test one's integrity and endurance to prove his determination to be a
member. Usually these initiations are physical and mental practices. In the Philippines, initiation
is frequently violent and mentally degrading. Some also says it includes erotic element. Because
of these, they call initiation hazing.

Paddling - sometimes over a lap, a knee, but mostly at the back of the thigh or on the bare
buttock;
Slapping - slapping of the face;
Tedious Cleaning - cleaning of toilet bowl, etc.;
Weird Clothing - an incoming member will be asked to wear a very funny or weird costume that
would impose a negative effect on the wearer;
Food - a combination of food mixed and in absurd container;
Servitude - waiting on others (as at frat parties) or various other forms of housework, often with
pointless tests of obedience.
For many years now, many students are getting killed due to fraternity hazings. Almost are
students from the University of the Philippines. Still, students risk serious injury or even death
for the supposed privilege of fraternity membership.
Among the countless victims of brutal and senseless deaths by fraternity hazing in colleges and
universities in our country are as follows:
1. Marlon Villanueva -
2. Niño Calinao - got killed in 1999 during initiation by Alpha Sigma Rho fraternity.[2];
3. Jan Angelo Dollete - got killed during the initiation rites on May 6, 2006 held by the Alpha
Phi Omega (APO) Fraternity [3];
5. Lenny Villa - a neophyte of Aquila Legis, a fraternity in the Ateneo Law School killed in
hazing February 1999

REPUBLIC ACT NO. 8049- AN ACT REGULATING HAZING AND OTHER FORMS OF
INITIATION RITES IN FRATERNITIES, SORORITIES, AND OTHER ORGANIZATIONS
AND PROVIDING PENALTIES THEREFORE
SECTION 1. Hazing, as used in this Act, is an initiation rite or practice as a prerequisite for
admission into membership in a fraternity, sorority or organization by placing the recruit,
neophyte or applicant in some embarrassing or humiliating situations such as forcing him to do
menial, silly, foolish and other similar tasks or activities or otherwise subjecting him to physical
or psychological suffering or injury.
The term "organization" shall include any club or the Armed Forces of the Philippines,
Philippine National Police, Philippine Military Academy, or officer and cadet corp of the
Citizen's Military Training and Citizen's Army Training. The physical, mental and psychological
testing and training procedure and practices to determine and enhance the physical, mental and
psychological fitness of prospective regular members of the Armed Forces of the Philippines and
the Philippine National Police as approved ny the Secretary of National Defense and the National
Police Commission duly recommended by the Chief of Staff, Armed Forces of the Philippines
and the Director General of the Philippine National Police shall not be considered as hazing for
the purposes of this Act.[4]
Senator Miriam Defensor-Santiago, however, said in a statement, that, "Republic Act No. 8049,
or the Anti-Hazing Law, must undergo a comprehensive review because it has failed to stop
hazing within fraternities, sororities and student organizations since its enactment.[5]
In the central city of Mandaue, 20 fraternity-related shootings were recorded by police between
January and August of 2006.[6]

THE FAMILY of University of Makati student EJ Karl Intia will request the National Bureau of Investigation
(NBI) to conduct its own probe on the circumstances surrounding the victim’s death.
Intia allegedly died from injuries he suffered during initiation rites conducted by members of the Alpha
Phi Omega (APO) fraternity last month.
“All I want is justice for my son,” said Oscar Intia, the victim’s father, adding that he is set to meet NBI
Director Magtanggol Gatdula on Wednesday to seek his help in gathering evidence and in looking for 11
of 16 suspects who remain at large.
Makati Regional Trial Court Branch 57 Judge Honorio Guanlao recently ordered the release of APO
members John Marin, Rico Mansalapus, Michael Pagulayan and Rosel Wenceslao who were detained
earlier for lack of probable cause.
The four, along with another suspect who is a minor, earlier surrendered to police and reportedly
admitted that they took part in the hazing.

The management of West Negros University yesterday assured it will help their student who
allegedly became a victim of hazing last week attain justice.
A press statement from Elmer Bolivar, WNU vice president for administration, said the institution
is determined to make those responsible for the alleged hazing answerable for the crime they
committed.
The victim, whose name the police withheld, was invited by a fellow teenager Thursday last
week to meet his friends. The victim agreed, not knowing that it would be an initial meeting with
the alleged members of the fraternity called the “Tau Gamma Phi”, Bolivar said. When the victim
refused to join the organization, the “master initiator” threatened him, Bolivar added.
Bolivar also said that the suspect is not a member of the University’s football varsity team nor is
he a student of WNU...

recruitment of new members.
Magleo V. Adriano, national APO president, said they have already pledged to campaign for a national
resolution in 2007 supporting Republic Act 8049, or the Anti-Hazing Policy.
"Death cases due to hazing during initiation rites before the resolution was adopted have soared high,"
Adriano said during a press conference at Limketkai Center Thursday.
He, however, did not specify the number of deaths due to hazing, claiming there were no official
tracking of the victims.
Adriano added that hazing victims and the "hazers" would definitely not admit the wrongdoing while
doctors may not recognize their case as hazing.
"There is no difference between hazing and non-hazing practice to check the commitment and loyalty of
our new members. It is not through hazing that we contemplate to the upcoming new members. They
will undergo a series of programs to determine their dedication," Adriano said.
He admitted though that as of the moment, only 40 percent of their chapters have adopted the no-
hazing policy.
Since Thursday, around 2,000 members of APO in the Philippines gathered in Cagayan de Oro for their
26th National Biennial convention dubbed "One vision in the second decade of the third millennium."
"Here in Mindanao, most of the chapters apply minimal hazing but that can be changed since during this
year's four-day convention, we will discuss and strictly implement a no-hazing policy to all our chapters,"
Adriano said.
The constitution and by-laws of APO mandates to conduct a biennial general assembly to tackle
legislative and constitutional issues on hand, and the convening of the Electoral College to elect new
officials to govern the APO organization.

CAMP VICENTE LIM, Laguna, Philippines -- A 15-year-old girl, believed to be a confraternity neophyte,
was accidentally shot to death during the initiation rites in Biñan, Laguna Saturday evening, the police
said Sunday.
Senior Superintendent Manolito Labador, Laguna police director identified the victim as Glacy Monique
Dimaranan who died of a single gunshot wound in the head.
Labador said Dimaranan was undergoing a psychological test as part of the initiation rites of the Scout
Royal Brotherhood (SRB) when a member, identified as Edwin Salandanan, accidentally pulled the
trigger of the gun that he was pointing at the victim.
He said Wency Marfil, 15, another neophyte, reported the shooting to the police at around 6:30 p.m.
Police arrested five members of the confraternity, four of them minors and one elder member identified
as Richard John Layacan, 28, and the fraternity's adviser Erwin del Rosario, 33, in an apartment in
Barangay San Vicente where the rites were held.
Recovered was a slug of a 9mm pistol and documents allegedly used in the group's rites.
Salandanan and another member were able to escape and remain at large.
In a follow-up operation Sunday morning, police raided three suspected safe houses of the
confraternity, also in Biñan, and recovered four woodenpaddles that bore SRB's seal, a .22 rifle, assorted
ammunitions and illegal drug paraphernalia.
Labador said the police were coordinating with the Department of Social Welfare and Development
regarding the arrested minors.
In October, the fraternity's chapter in Cavite province was also held responsible for the death of 21-
year-old neophyte Elvis Sinalia.
Three fraternity members were arrested following an initiation rites very recently at Brgy. Jaguimitan,
Passi City.
Collared were Julio Layson, 21, Emi Pacardo, 21, and John Rey Falcis, 22, all of Brgy. Man-it, Passi City.
The suspects are alleged members of Tau Gama Fraternity.
They were allegedly conducting initiation rites at their neophytes when members of Passi City Police
Station arrested them.
The neophytes were disclosed as Red June Palic, 20, and Garette Dyson Palomo, 18, both of Saligumba
St., Passi City.
Three minors were also part of the initiation rites. The teenagers, aged 14, 15, and 17 years old, are all
residents of Brgy. Man-it, Passi City.
Police recovered from the crime scene a short bond paper bearing the password and Tau Gama
Fraternity’s brotherhood sign, candle, lighter, handkerchief, and a motorcycle with plate number
PN2376.
The three suspects are presently detained at the lock-up cell of Passi City Police Station pending the
filing of charges against them for violation of Republic Act No. 8049 (An Act Regulating Hazing and Other
Forms Of Initiation Rites In Fraternities, Sororities, And Organizations And Providing Penalties

MANILA, Philippines - Justice Secretary Leila de Lima has ordered the National Bureau of
Investigation (NBI) to investigate the death of San Beda Law student Marvin Reglos who died
from injuries sustained in an alleged hazing incident.
De Lima bared the victim's family got in touch with her, seeking for help.
The NBI Death Investigation Division will conduct the probe, the Justice chief said.
However, the Philippine National Police (PNP) will remain the lead agency investigating the
case.
"Ipapaimbestiga ko yan sa NBI. I was able to talk to the sister of the victim, nag-text siya sa akin
kanina and she is seeking the help of the DOJ (Department of Justice) and the NBI... I also talked
to Sec. Jesse Robredo, sinabi ko dapat ang PNP ang maglead sa investigation; ang NBI mag-
parallel through its Death Investigation Division," De Lima said.
Reglos, who sustained severe bruises on several parts of his body, was brought on Sunday night
to the Unciano Medical Center in Antipolo City by two unidentified men. He was declared dead
on arrival.
Two alleged fraternity members were later arrested as they were trying to supposedly check on
Reglos' condition.
De Lima, an alumna of the San Beda College of Law herself, told Reglos' family she made initial
inquiries about the victim, and it turned out that Reglos was a neophyte in a fraternity allied with
the Justice chief's very own sorority.

responsibilty" of fraternity leaders who allow or who, themselves, initiate hazing.
The Supreme Court recently handed down its decision in Villa's case, finding 5 fraternity men of
the Aquila Legis fraternity responsible for Villa's death in initiation rites in February 1991. News
on the High Court decision came out on Monday.

MANILA, Philippines - Justice Secretary Leila de Lima has ordered the National Bureau of
Investigation (NBI) to investigate the death of San Beda Law student Marvin Reglos who died
from injuries sustained in an alleged hazing incident.
De Lima bared the victim's family got in touch with her, seeking for help.
The NBI Death Investigation Division will conduct the probe, the Justice chief said.
However, the Philippine National Police (PNP) will remain the lead agency investigating the
case.
"Ipapaimbestiga ko yan sa NBI. I was able to talk to the sister of the victim, nag-text siya sa akin
kanina and she is seeking the help of the DOJ (Department of Justice) and the NBI... I also talked
to Sec. Jesse Robredo, sinabi ko dapat ang PNP ang maglead sa investigation; ang NBI mag-
parallel through its Death Investigation Division," De Lima said.
Two alleged fraternity members were later arrested as they were trying to supposedly check on
Reglos' condition.
De Lima, an alumna of the San Beda College of Law herself, told Reglos' family she made initial
inquiries about the victim, and it turned out that Reglos was a neophyte in a fraternity allied with
the Justice chief's very own sorority.
"Based on my initial inquiry kanina, it shows that the victim was a neophyte of the Lambda Rho
Beta fraternity, the ally fraternity of the sorority that I'm a part of which is the Lambda Rho
Sigma sorority... If it's true that he died of hazing then ang involved fraternity dyan is the
Lambda Rho Beta so I told the sister of the victim in the interest of full disclosure... wala
namang problema sa kanila," she said.
