TheArmsTradeTreatyIncludingSmallArmsandLightWeapons KeyComponents

ThisdocumentoutlinesrecommendationsthatwouldstrengthenareasoftheArmsTrade Treatythathavethepotentialtocontrolandreducetheproliferationofsmallarmsandlight weaponsandrelatedammunition.TheinclusionoftheseisvitaliftheArmsTradeTreatyisto beeffectiveinsavinglivesandreducingseriousinjurytopeoplearoundtheworld. 1.Scope TypeofWeapons Thetreatyshouldregulatetransfersofallconventionalarms,andinparticular,smallarmsand lightweaponsandrelatedammunition. TypeofTransfers TheArmsTradeTreatyshouldapplytoallinternationalarmstransfers,meaningthephysical movementofarmsinto,orfrom,anationalterritoryandthetransferoftitletoand/orcontrol overthearms.Internationaltransactionsshouldalsobeincludedsuchassales,gifts,loans, leasesandtheforeignlicensingofproductionofarms. 2.Criteria AStatepartyshallnotauthorizeatransferofarmsifthereis,intheviewofthepotential transferringState,asubstantialriskthatthosearmswould Beusedtoperpetuateapatternoforfacilitatehighlevelsoffirearmsrelatedhomicideor seriousinjury Beusedtoperpetuateorfacilitatehighlevelsofgenderbasedviolence,inparticularrape andotherformsofsexualviolence ORbeusedtocommitorfacilitateviolationsofinternationalhumanrightsor humanitarianlaw,includingsexualandgenderbasedviolence

3.InternationalCooperationandAssistance InternationalcooperationandassistanceshouldbeanintegratedpartofanATTinorderto enhanceimplementationofthetreatysobligationsandgoals.Civilsocietyandwomensgroups shouldbeconsultedandgiventhespacetosharetheirinsightandexperiencesaswellas includedincapacitybuildingandassistanceprogrammes. 4.Implementation InorderfortheATTtobestrongandeffective,itshouldsethighstandardsfornationalsystems andinternalcontrolsandaclearlegalframeworkforbrokeringactivities.Furthermore,theATT shouldcontainstronglanguageonrecordkeepingandtransparency,informationexchange,law enforcementandtheInternationalSupportUnit(ISU),asoutlinedbelow: Recordkeepingandtransparency TheTreatyshouldobligeStatesPartiestopublishaccurate,comprehensive,timelyandpublic nationalreportsoninternationaltransfersofconventionalarmsandstepstakentoimplement theTreaty,inordertoensuretransparencyandaccountability,buildconfidenceamongStates Parties,andenablerelevantactors,includingcivilsocietyandwomensgroups,toassess implementation,accessinformationandraisepublicawarenessontheseissues.

Reportsshouldincludeinformationonexports,imports,brokering,transit,transhipmentand otherinternationaltransfersofconventionalarmscoveredbytheTreaty,fromortotheirterritory includingdetailsthefinalimporterstate,quantity,typeandvalueofconventionalarms,thestate oforiginoftheitemsandanyintermediarylocations,aswellasimplementationoftheTreaty undernationallaws,regulationsandadministrativeprocedures,includingrelevantenforcement actionsandinternationalcooperationandassistanceactivities.Recordsshouldbekeptfora minimumof20years. Statesshouldincorporatetheknowledgeandexperienceofdifferentcivilsocietygroups, includingwomensorganisations,inexchangesandtrainingprogrammesandinitiateamore systematicapproachtothegatheringofsexandagedisaggregateddata,thusfacilitatingmore effectiveactionsforcombatingviolationsoftheTreaty. InformationExchangewithStatesParties StatesPartiesshouldbeobligedtoshareinformationonauthorisedimporters,exportersand brokersofconventionalarmsandammunition,andforthepurposeoflawenforcement,States Partiesshouldexchangeinformationoninternationaltransferagents,brokersandotheractors suspectedtobeinvolvedintheillicittrade,aswellassexandagespecificdataontrafficking networks,includinglinkagesbetweendifferenttypesoftraffickingandanecdotalevidenceand qualitativedata. ImplementationSupportUnit AnindependentTreatyinstitution,suchasanATTISU,shouldbeestablished.Inadditionto otherrolessuggested,theISUshould: Conductgenderinclusiveoutreachandengagecivilsocietytoincreaseawarenessofthe TreatyregimeandtopromotetheuniversalityoftheTreaty SupportandguideStatesPartiesintheproductionofnationalreports,throughthe developmentofareportingtemplate DeveloplegalandadministrativetemplatesfornationalimplementationoftheTreaty PromotecivilsocietyengagementandcontributionstoimplementationoftheTreaty.
