Abstract

The concept of criminal liability of children is a troublesome issue in the area of criminal law. The central problem is about the circumstances in which a child can be held responsible for a criminal act which he or she has committed. The simplest and most straightforward way to handle this is by prescribing a lower age limit for criminal responsibility based on the logic that the children are considered doli incapax or incapable of understanding the consequences of their actions. The researcher through this paper would like to throw light on the changing idea behind the age of criminal responsibility and also the aspect of infancy that can be taken as a defense if any criminal wrong is done by a person below the prescribed age that is seven years old. The researcher would provide with suggestions, if any to improve the law on the point.
