THE IMPLEMENTATION OF RESTORATIVE JUSTICE FOR


CHILDREN PERMITTING CRIMINAL ACTS IN THE JUVENILE
CRIMINAL JUSTICE SYSTEM

Juvenile Criminal Justice is regulated in Law Number 11 of 2012 concerning


the Juvenile Criminal Justice System. In the preamble of Law 11 of 2012
concerning the Juvenile Criminal Justice System it is stated that "children are
a mandate and a gift from God Almighty who has complete human dignity and
worth. Seriousness in paying attention to and protecting children's rights in
practice is hampered in law enforcement problems caused by internal and
external factors. Children who are involved as perpetrators of crimes are like
perpetrators of crimes committed by adults. Juvenile criminal justice aims to
provide the best for children, without compromising the interests of society and
upholding justice. In addition, to re-educate and improve the child's attitude
and behavior so that he can leave the bad behavior he has been doing so far.
The problem can be formulated as follows: What are the considerations for law
enforcement officials in implementing restorative justice as a legal
breakthrough for children as perpetrators of crimes that do not meet the
provisions on the limitation that perpetrators can be diverted? The type of
research used in this research is normative. Based on the above study, the
following conclusions can be drawn: Law enforcement officials can implement
restorative justice as a legal breakthrough against children who commit crimes
that do not meet the provisions of diversion, namely the Juvenile Justice System
Law provides for a Diversion institution. As regulated in Article 1 number 7,
which confirms the following: "Diversion is the transfer of settlement of child
cases from the criminal justice process to processes outside the criminal
justice. And, statutory arrangements guarantee legal protection for
perpetrators of child crimes in providing reforms to juvenile criminal law in
the future, namely the law on the juvenile justice system is very important,
because this law is part of legal protection for children. The justice process for
children must be designed in such a way that children are protected both
legally and psychologically. Criminal investigation activities carried out by the
police, prosecutors, judges and other officials against children must prioritize

the interests of the child or see what criteria are best for the welfare of the child
concerned without reducing attention to the interests of society.
