Dear Mrs ODwyer, YOUR REQUEST FOR INFORMATION ON UK-US EXTRADITION Thank you for your e-mail of 5 June 2012, which has been handled as a request for information under the Freedom of Information Act 2000 (the FoI Act). You ask for the following information: How many UK citizens have been extradited to the US from the UK for crimes which would have taken place when the extradited person was on UK soil (under the current extradition treaty) between Jan 2004 up until May 30th 2012. How many extraditions of UK citizens have been requested by the US for crimes which would have taken place when the extradited person was on UK soil (under the current extradition treaty) between Jan 2004 up until May 30th 2012. How many extraditions of UK citizens to US remain pending for crimes which would have taken place when the extradited person was on UK soil under the current extradition treaty i.e. between Jan 2004 up until May 30th 2012. As a persons nationality has never been a bar to extradition between the UK and the US, the nationality of the person whose extradition was sought was not, before 2010, always recorded. Information about where the alleged offence was committed in each case is not held centrally; however, in every case the alleged offence would have to come within the jurisdiction of the requesting state. The information provided reflects these qualifications.

Between January 2004 and May 2012, from the limited information available, we have not identified any UK citizens who have been extradited to the US as being accused solely of a crime committed whilst the person was in the UK. We have identified five requests for extradition from the US where I can confirm that the alleged offences were committed whilst the person was in the UK. All five requests remain outstanding. The figures provided do not include requests between the US and Scotland. If you are dissatisfied with this response you may request an independent internal review of our handling of your request by submitting a complaint within two months to the address below, quoting reference 23013. If you ask for an internal review, it would be helpful if you could say why you are dissatisfied with the response.
