Jurisdiction and Venue This Court has jurisdiction over this proceeding pursuant to 28 U.S.C. 157 and

Venue is proper in this district pursuant to 11 U.S.C. 1408 and 1409. Background On May 19, 2010 (the Petition Date), Westcliff Medical Laboratories, Inc. and

Biolabs, Inc. (collectively, the Debtors) filed a voluntary Chapter 11 petitions pursuant to 11 U.S.C. 101, et seq. (the Bankruptcy Code). 4. Prior to the Petition Date, Beckman and the Debtor entered three (3) lease

agreements whereby the Debtor leased certain blood-analysis equipment from Beckman. 5. In addition to leasing equipment from Beckman, Debtor purchased certain reagent

chemicals used in conjunction with the equipment. Beckman is entitled to an Administrative Expense Claim pursuant to Section 503(b)(9) of the Bankruptcy Code for Goods Delivered by Beckman to the Debtor within twenty (20) days of the Petition Date Section 503(b)(9) provides an administrative expense claim to a creditor that

delivered goods to the debtor during the 20-day period immediately preceding the debtors bankruptcy filing. 7. The Petition Date was May 19, 2010. During the 20-day period immediately

preceding the Petition Date April 29, 2010 to May 18, 2010 - Beckman delivered goods to the Debtor with a value totaling $11,062.62. 8. True and correct copies of invoices evidencing these transactions are attached

hereto as Exhibit A.1 9. Pursuant to Section 503(b)(9), Beckman is therefore entitled to an administrative

expense claim in the amount of $11,062.62.

1 To the extent that any of the goods identified on the invoices in Exhibit A are determined to have been

received by the Debtor after the Petition Date, Beckman reserves its rights to include those goods as a Section 503(b)(1) administrative expense claim as Beckman believes that the goods were actual and necessary costs of preserving the estate.

WHEREFORE, Beckman Coulter, Inc. respectfully requests an Order from this Court (i) granting Beckman an allowed administrative expense claim pursuant to 11 U.S.C. 503(b)(9) in the amount of $11,062.62 and, (ii) ordering the Debtor to make payment of $11,062.62 to Beckman in satisfaction of Beckmans administrative expense claim.
