Last Friday night, the wee men of Extreme Midget Wrestling kept a massive crowd at Dirtys Bar & Q on its feet for an exhibition of their brand of hand to hand to boot to turnbuckle combat. Full-sized grappler Nacho Dirty showed up to throw down some mayhem as well. All in all, small stature wrestling at Dirtys was a huge, hardcore success. That same night, a little further south, NBs own Billy Buch hit the ring in the main event matchup at the Texas Legacy 17 MMA card at Cowboys Dancehall. Billy lost in the first round after submitting to a brutal flying armbar applied by his opponent, Patrick Ybarra . Buchs record now stands at (3-2-0), while Ybarra remains undefeated at (4-0-0). Civil Rights: The Government Taketh Away, then Giveth Back February is Black History Month, and I thought it might be nice to do a column that talked about libertarian ideals on race. Its not a topic I would typically address because, to be honest, I dont think its significant. I dont think race is a major factor in modern life, and like most libertarians, I expect government to be color blind. But, there can be no doubt that libertarianism has not made the inroads it should across racial lines and particularly in the black community. If thats ever going to change, libertarians are going to have to open up and defend their views through a racial prism. Let me start by pointing out that black libertarians are not quite as rare as unicorns. There are a few black voices that focus on liberty. Walter Williams and Thomas Sowell are both well know syndicated columnists who are friendly to libertarian ideas. So too is Larry Elder, a pundit I first encountered on talk radio in Southern California. I have even heard the occasional libertarian sounding quote from Chris Rock and Bill Cosby. Even so, its safe to say that libertarian thought has not widely resonated with the black community. Perhaps the biggest reason for this is that black voters have, for years, been a captured base for the Democratic Party. When 80 percent or so of black voters identify themselves with a single party, its not surprising that you dont see much representation in other parties. This has been the case since Truman was elected. Trumans desegregation of the military and regulations eliminating racial bias in federal hiring can be seen as true advances in civil rights at the time, and his actions were rewarded with votes. LBJ cemented this attitude by supporting the Civil Rights Act of 1964 when Goldwater, a Republican with clear libertarian tendencies would not. When someone seems to be on your side, its hard not to like them, and any time there is even the slightest wavering, you can depend on the Democratic Party to remind black Americans of this history and even distort the history of Republicans and libertarians in this regard. The truth is that black voters have been conditioned to see the government (mostly the federal government) as a benefactor. Whether its Lincolns actions in the Civil War or the 1964 Civil Rights Act, the power of government has repeatedly been used to protect the black community, but no one every seems to ask, protect them from whom? When it comes to civil rights, all of the advancements made by the federal government have only served to protect black Americans from government. The legislation that was offered to protect would have been wholly unnecessary if not for previous legislation designed to repress. We had a civil war in this country because the government supported slavery as an institution. Brown v. Board of Education was an important step only because it overturned Plessy v. Ferguson, which upheld state required segregation. Rosa Parks was arrested for breaking a law when she refused to leave the white section of the bus in Montgomery. In all of the cases where the government stepped in, it was in response to a problem that had been created largely by government. Its fair to say that Democrats used the power of the federal government to advance civil rights for black Americans, but its equally fair to point out that they never should have had to. The libertarian argument looks at things from the other side. By what right does the government (federal or otherwise) dictate how Americans of different races interact? Its a matter of freedom of association. Plessy v. Ferguson was wrong not just because separate but equal isnt equal. It was wrong because government shouldnt have the authority to force people not to interact because of race. If thats true, though, its also important to recognize that the government doesnt have the authority to force people to interact because of race either. And thats the very reason that many libertarians are leery of much of the civil rights law we see in this country. The problem isnt solved by legislating that people must treat each other equally; its solved by requiring that government treat people equally and leave all of us alone to associate as we please. A near perfect example of this can be found in professional sports. There is, perhaps, no industry where black Americans have been more successful, and that success wasnt due to government interference; it was due to market pressure. Most of us recognize the importance of Jackie Robinson becoming the first black player in major league baseball, but Robinsons story was a long time in coming. Discussion of

integration in baseball began as early as 1901, and when blacks were not allowed to play on white teams, they developed teams of their own. These racially segregated teams had occasion to play one another, and there was no question that color was not an issue in competitiveness. The concern had always been, rather, that white audiences wouldnt support teams with black players. It was economics as much as racism which first kept black players from the field and ultimately it was economics that insured they would be on it. Once a single major league team had broken this color barrier and profited by it, other teams were forced to make the same moves or be outplayed by teams that were choosing from a larger pool of talent. (In fairness, I should mention that basketball followed a similar pattern and might be said to have led the way for black Americans in sports.) Another example can be seen with black Americans in the entertainment industry. Racism and segregation lasted only so long as it was economically viable. This isnt an aberration; its just how the market works. Untapped talent and untapped markets represent an opportunity to make money. Any person that puts their racist attitudes above their profit motive will soon be trounced by their competition. If left alone by government, the market will assess when segregation is no longer acceptable, and changes will be made earlier than even if you try to force them. This is the model that libertarians want on race, one where the market decides and government is restrained in the shaping of social norms. Government should treat all its citizens equally, and the federal government should be active in seeing that states do the same, but government should never be allowed to project their values over those of the private citizen. Where weve seen government act to enforce values, it has much more frequently trampled rights than protected them, so its better that they stay out of the values business altogether. Would that mean that private citizens have license to be racist? Yes, but it also means that they have license not to be. In the grand majority of cases this will yield a better result, and in all cases it will result in more freedom for everyone.
