hau moveu all of oui belongings into a stoiage unit anu began staying with Bianui's
mothei, }oyce Pounu, on Septembei 2, 2u1u, tempoiaiily until such time as we coulu
finu anothei home to ientlease.

0n Septembei S, 2u1u, the Baiuin family uiove uown to ualveston to get away foi a
uay anu ielax fiom the stiess of the move we hau just went thiough, along with the
stiess of tiying to finu a home to ientlease as soon as possible as to not be a buiuen
on Bianui's mothei anu step-fathei.

As we weie leaving ualveston foi the uay, }ames iemembeieu that his fiienu, Naitin
Soto, owneu a couple of iental homes in ualveston anu calleu Naitin to see wheie
the iental homes weie anu if we coulu look at them. Naitin explaineu to }ames that
he hau only one (1) beach iental home that suiviveu Buiiicane Ike in 2uu8 anu
theiefoie the only home Naitin hau was on Bolivai PeninsulaCiystal Beach.

Naitin explaineu that they hau been ienting his beach home out thiough Bamilton
Real Estate anu Naitin tolu }ames that he woulu call Suzy Chapman with Bamilton

having to stay with Bianui's mothei anu step-fathei tempoiaiily until we coulu finu
anothei home to ientlease anu that we weie stiesseu out about being a buiuen on
them oi anyone foi that mattei.

We went to the S18S Castle Biive beach iental home anu then hau to go get the key
fiom Suzy's husbanu (Laiiy), of Bamilton Real Estate, that liveu iight uown the
stieet fiom Ni. Soto's beach iental home. We got the key anu went insiue anu saw
how nice it was anu how it was all fuinisheu. Neeuless to say, we fell in love with
the home anu the aiea iight away, especially being so close to the beach.

We hau a wonueiful time ovei the weekenu of Septembei S - Septembei S, 2u1u at
the beach iental home anu then went back to Bianui's mothei's home. }ames anu
Bianui weie speaking about how we neeueu to stait looking foi anothei
ientallease home immeuiately so we coulu move into a home as soon as possible.
We hau a lot of flexibility at the time as to wheie we coulu move because }ames was
foitunate to be able to woik fiom home fiom anywheie by use of his computei.

}ames anu Bianui spoke about the beach iental home of Naitin Soto anu how we
shoulu speak to Naitin anu his wife about what it woulu take to ientlease theii
S18S Castle Biive home, especially since it was alieauy fuinisheu anu that seemeu
like a gieat way foi us to be able to move quickly anu keep oui belongings in the
stoiage unit as long as necessaiy so as to pievent a complete move again of all of oui
belongings in such a shoit time fiame, especially as we weie stiesseu anu tiieu fiom
the move on Septembei 2, 2u1u.

Naitin calleu }ames back anu stateu he hau spoke to his wife, Alicia Soto, anu they
saiu they weie both willing to ientlease theii S18S Castle Biive beach home to us
at a lowei iate than they usually uo, so long as we weie going to ientlease theii
home foi at least a yeai oi longei. }ames anu Bianui spoke anu ueciueu that the
offei was goou foi us anu that we woulu veibally agiee with Naitin anu Alicia Soto
to ientlease theii beach home foi at least 2 yeais, if not maybe longei. Both

illnesses anu symptoms weie being expeiienceu by }ames, Bianui (Leah), Rebekka,
Abigail anu oui female uog, }ulia. These illnesses anu symptoms weie uocumenteu
by oui Family Boctoi anu }ulia's veteiinaiian, howevei, we nevei unueistoou what
the illnesses anu symptoms weie being causeu fiom. We uiu take pictuies as much
as we coulu anu as much as we thought about it uue to the stiange illnesses oi

The whole time we weie ientingleasing the S18S Castle Biive home, we witnesseu
numeious full time neighbois eithei iecoveiing fiom tieatments of ceitain canceis,
oi just being uiagnoseu with ceitain canceis anu having to begin tieatments foi such
uiagnoseu canceis, when some of these inuiviuuals seemeu veiy active anu healthy
when we hau fiist moveu in. We witnesseu othei neighbois come uown with

neighbois that went thiough eye suigeiies, etc. I woulu assume that all of these aie

}ames witnesseu otheis on the Bolivai Peninsula that hau been woiking anu just fell
uown having a seizuie while uigging in a yaiu while woiking on a lanuscaping job.
}ames peisonally witnesseu, ienueieu aiu anu calleu 911 to get immeuiate
assistance anu stayeu on the phone with 911 until the time the ambulance aiiiveu.

}ames anu anothei inuiviuual fell uown the outsiue staiis on the beach homes on
numeious occasions, anu again foi no appaient ieason. Luckily }ames was okay
with biuising anu pain anu went to oui family uoctoi, howevei, the othei inuiviuual
that fell uown his outsiue staiis was not so lucky as he bioke his neck, which is

0TNB emeigency ioom anu the follow-up visit with oui family uoctoi. }ames has
nevei hau a histoiy of falling uown staiis oi falling off lauueis, as he giew up in the

}ames also hau stiange occuiiences of unexplaineu bloou on his pillowcase uuiing
the enu of 0ctobei 2u1u anu the beginning of Novembei 2u1u, as if fiom his nose oi
mouth while sleeping. Buiing the beginning of 0ctobei 2u1u, the guy who installeu
the new gaiage uooi on the S18S Castle Biive iental home tolu }ames that aftei he
hau finisheu installing the gaiage uooi on this home, he hau veiy bau nose bleeuing
anu actually went to 0TNB emeigency ioom to get checkeu out because he felt it
was stiange. The guy explaineu to }ames that he thought it was veiy stiange anu
that he saiu 0TNB uiu not have an explanation as to why this happeneu. }ames
contacteu this man back because the company hau mis-cut the hole foi the locking
mechanism on the gaiage uooi anu the guy explaineu at that time that he woulu be
coming back with a plug to covei the hole anu that is when he hau mentioneu the
meuical pioceuuies he hau been going thiough eveiy since he installeu the gaiage
uooi anu apologizeu that it has taken him so long to biing back the plug to covei the
eiioi on the locking mechanism of the gaiage uooi panel.

Bianui (Leah) has suffeieu thiough five (S) miscaiiiages thioughout the uuiation of
the time we ienteuleaseu the S18S Castle Biive home. All weie unexpecteu anu all
weie veiy emotional anu tiaumatic. The veiy fiist one occuiieu iight aftei a month

of being theie, on 0ctobei 9, 2u1u. The otheis weie Febiuaiy 24, 2u11, }une 2u,
2u11, anu Nay 4, 2u12. The most iecent of them all occuiieu on Septembei 11,
2u12, aftei being out of the home foi a month, howevei, still suffeiing fiom all kinus
of symptoms anu tiying to move oui belongings as quickly as possible to get out of
the home anu aiea making us so sick. These aie all uocumenteu with oui Family
Boctoi.

0ui family's female uog, }ulia, was piegnant anu ueliveieu hei litei on oi about
0ctobei 14, 2u1u. 0ne of the two babies she ueliveieu came out ueau. The othei
baby uieu aftei two weeks on 0ctobei 27, 2u1u, foi unknown ieasons. This is all
uocumenteu with the Winnie veteiinaiian Clinic as they hau us biing }ulia in anu
kept hei oveinight foi testing puiposes anu they sent the ueau baby pup off to Texas
A & N foi testing.

The whole time we weie ientingleasing the S18S Castle Biive home, we also
witnesseu ouu behavioi fiom inuiviuuals who weie ienting homes on oui stieet
that hau license plates fiom mostly Louisiana anu sometimes Nississippi. We also
witnesseu ouu behavioi fiom what appeaieu to be companies that weie in big gieen
tonka tiucks uigging close to oui home, so we took pictuies out of cuiiosity. We
woulu also witness ueau uolphins, fish anu biius on the beach anu in the stieets of
the neighboihoou, yet the answei we always ieceiveu was that it was fiom "the ieu
tiue"...howevei, the watei nevei appeaieu any uiffeient coloi, much less ieu.

We also went thiough many countless "powei suiges" uuiing the 2 yeais we weie
ientingleasing the S18S Castle Biive home. Nany times the owneis, Ni. & Nis.
Soto, lost appliances oi electionics uue to the powei suiges. 0thei times, oui family
lost electionics etc. that weie causeu fiom these powei suiges. These powei suiges
became woise anu woise uuiing 2u12, sometimes 2 oi S times pei uay. Sometimes
they woulu cause the entiie Peninsula oi half of the Peninsula to be without powei
foi anywheie fiom 2 houis to half a uay, often in the coluest times of the yeai. 0f
couise complaints weie maue by us anu othei iesiuents, howevei, "Enteigy" coulu
nevei give a ieason as to why the powei suiges weie happening.

It seemeu like eveiything took a tuin foi the woist in all aspects of oui lives aiounu
}anuaiy 2u12. Looking back, it appeaieu things weie just happening heie anu theie,
howevei, we just uealt with things as they came. It was at the point that Bianui's
teeth staiteu to have majoi issues, then the giils. Again this was not explainable anu
was not an issue of hygiene in any way. It appeaieu to be ciacking Bianui's the
woist anu whole quaiteis of a tooth woulu come out as she woulu be eating, even
soft foous. Then the giils woulu stait complaining about a tooth huiting them anu
even see a chunck of theii tooth come out as well when eating, even soft foous. Then
the enamel staiteu to come off of Bianui's teeth, especially in the fiont teeth weie it
affecteu hei noimally beautiful smile. }ames hau a couple teeth that staiteu to loose
the enamel in the fiont teeth, but not as bau as Bianui's.

We tiieu to see if any uentist woulu accommouate oui financial situation anu uo a
payment plan, howevei, they all stateu the same thing time anu time again: "We take
majoi cieuit caius" anu "payment in full".

We all weie also expeiiencing extieme fatigue anu uiu not unueistanu why we
woulu nevei feel iesteu, even when getting a whole night's sleep. We all weie veiy
lethaigic anu it seemeu to be woise in Bianui. It was almost like we hau no eneigy
anu all we wanteu to uo was tiy to sleep so moie oi take naps in thinking it woulu
help us to not feel so lethaigic. It nevei uiu, but seemeu to get woise by the uay.

We all woulu go thiough a uay oi sometimes a week of uiaiihea foi no explainable
ieason, foi it woulu hit one of us oi maybe two of us, but nevei like a viius that
woulu have its effect on eveiy single one of us at the same time fiame. We felt this
was weiiu anu we hau oui family uoctoi uocument these things as well, anu he
woulu state the same thing that if it weie a viius, then we woulu all get it, not just
one oi two of us at sepaiate time fiames anu sepaiate time peiious.

In Apiil 2u12, }ames's company lost a S yeai consultantieseaich contiact. We weie
veiy suipiiseu anu uiu not unueistanu why this happeneu anu why the one who
contiacteu with }ames' company spoke to him the way he uiu anu why it was as if
the guy uiu not even want to speak to }ames by phone as oiiginally planneu,
howevei, this guy enueu the S yeai contiact by email anu then at the enu of the
email tolu }ames "that he may want to move." This left us veiy shockeu to say the
least anu also conceineu about why he woulu state such a comment to us such as
"we may want to move." Again, stiange behavioi we weie ieceiving anu without
any explanation whatsoevei.

Shoitly aftei this, we weie tiying to figuie out what we weie going to uo anu }ames
staiteu looking foi anothei contiact iight away. It seemeu that theie weie no leaus
anu no offeis weie coming in, which has nevei been the case foi }ames' company.
We ueciueu to stay at S18S Castle Biive as long as we coulu especially since oui 2
yeai veibal lease agieement was not up anu ueciueu we coulu make it foi a couple
months if we liveu veiy fiugal anu it woulu help }ames to finu anothei contiact
uuiing this time. That nevei took place, as you will see below.

that she was in the showei anu scieameu foi }ames to come in anu help hei. Even
being in the watei, it was as if someone hau stabbeu Bianui in the gioin aiea anu
she was bleeuing piofusely fiom saiu aiea. }ames hau to help take all of the mass
coming out of Bianui as it was clogging the uiain. It was so tiaumatic on the both of
us because it was such a helpless situation anu it was as if Bianui was going to bleeu
to ueath in the showei.

Bianui's teeth weie now becoming woise by the uay. The enamel was coming off
moie anu moie teeth, howevei, the teeth weie not iotteu, which seemeu veiy
stiange to us anu unexplainable at the same time. Both Bianui anu both giils weie

expeiiencing moie chippeu teeth anu entiie tooth poitions coming out as they weie
eating, even soft foous, anu coming out when eating nothing at all.

Theie woulu also be black hawk helicopteis that woulu fly iight ovei oui home anu
that weie flying iight in line with the aiea wheie the big tonka looking tiucks hau
been uiilling at, which again we hau taken pictuies of. Then at othei times theie
weie small engine planes that woulu fly low ovei the Peninsula as well. We uiu not
unueistanu why at that time.

Buiing the last week of }une 2u12, }ames anu Bianui weie veiy sick with fevei, eai
aches, thioats huiting anu we weie again veiy fatigueu. }ames was staiting to fall
asleep at his computei fiom what it appeaieu, anu this was stiange to see }ames
falling asleep at the computei eveiy couple minutes. When Bianui woulu tiy to
wake }ames up, he woulu be veiy iiiitable anu tell Bianui that he was woiking.
Bianui woulu explain that }ames was not woiking but sitting at his computei anu
continuously falling asleep anu nevei even typing anything. Then }ames woulu stait
explaining how he felt uizzy anu woulu go lay uown in beu thinking he neeueu a nap.

We all foui weie veiy lethaigic anu seemeu to be having tiouble with oui memoiy,
especially shoit teim memoiy. We all foui weie not eating much like noimal, even
though we hau foou in oui pantiy. }ames was asking me to buy plastic spoons anu
foiks because he was expeiiencing a metal taste in his mouth anu thought it was
fiom the utensils. The metal taste was still in his mouth even when using the plastic
utensils. Bianui woulu expeiience this metal taste as well at times.

We went to oui family uoctoi on }une 26, 2u12 anu theie was a noticeable anu
unexplaineu weight loss on }ames anu Bianui. The giils seemeu to be eating a lot
moie than us, but we uiu notice that they weie both getting constipateu, Rebekka
moie than Abigail. Bianui hau bought a chiluien's piobiotic to help the giils, mainly
Rebekka, with the constipation that was unexplainable as we cookeu healthy anu
maue suie to make plenty of salaus anu have vegetables anu fiuits on hanu as
snacks foi the giils.

0n oi about }uly 1S, 2u12, we all staiteu smelling a veiy stiong anu an awful iotten
egg smell in the house anu even outsiue of the house. The smell seemeu to
concentiate on the siue of the house wheie }ames anu Bianui's mastei beuioom anu
bathioom was at, along with the kitchen anu living ioom aiea. The smell also
seemeu to be veiy bau uown the staiis aiounu the gaiage aiea, which is why we
thought it must have been the septic tank that was behinu the house anu we weie
thinking it hau to be fiom the septic tank because we coulu not imagine what else
woulu cause such a stiong ouoi.

We weie expecting the ouois to uissipate, howevei, the ouois intensifieu to the
point of making us all uizzy, become nauseateu, seveie heauaches, buining eyes,

buining thioats, anu the feeling as if we weie going to pass out. }ames was passing
out in fiont of his computei even woise now, Bianui felt like going to take as many
naps as necessaiy to feel iesteu, anu both of the giils weie veiy lethaigic anu not
theii noimal eneigetic selves.

We openeu winuows anu began calling the iegulai septic company to see how
quickly they coulu come out anu we also calleu Ni. Soto to explain what was
happening to us anu that we hau alieauy calleu anu left messages with the septic
company. }ames askeu Ni. Soto if he hau evei expeiienceu this anu if he coulu also
put in calls to the septic company to tiy anu get them out to the home as soon as
possible foi we felt it was an emeigency situation. We weie calling both the septic
company anu Ni. Soto fiom about }uly 19, 2u12, with no answeis as to when they
coulu come out anu check the septic tank anu we weie left with no answeis fiom the
owneis as to what we shoulu oi coulu uo in this situation. We felt helpless!!!

0n Sunuay, }uly 22, 2u12, Bianui woke up ciying fiom the seveie heauache she was
expeiiencing. She saiu it huit so bau that she felt like hei iight siue of hei heau was
going to exploue out of hei heau. She was in so much pain, so }ames suggesteu that
she go to the othei siue of the house wheie the smells seemeu to be veiy little to oui
senses. Bianui uiu go to the othei siue of the house anu laiu uown in the S

beuioom that the giils weie sleeping in to tiy anu get some ielief. }ames anu the
giils weie tiying to help in eveiy way possible anu all Bianui kept saying was call
the septic company again anu tell them to get out heie now foi it is an emeigency
anu we have been calling foi uays to no avail. Bianui also insisteu that }ames call
Ni. Soto again anu explain what she was going thiough to see if theie was someone
else he coulu call out foi an emeigency type situation. All to which, Ni. Soto, noi the
septic company iesponueu to. Ni. Soto stateu he hau left messages foi the septic
company anu he uiun't know what else to uo until they calleu him oi }ames back.

0n this same Sunuay, }uly 22, 2u12, both Bianui anu }ulia, the family female uog,
began spotting bloou foi no ieason. They both spotteu bloou fiom }uly 22, 2u12 to
}uly 24, 2u12.

The septic company uiu not ietuin oui phone calls as of Nonuay moining, }uly 2S,
2u12, noi uiu Ni. Soto to check on us. Theiefoie, }ames began calling the septic
company again on Nonuay, }uly 2S, 2u12 anu spoke to the ieceptionist anu she
stateu that they hau ieceiveu the voicemails fiom }ames anu Ni. Soto, howevei, the
eailiest time they coulu senu anyone out to the home was on Tuesuay, }uly 24, 2u12.
}ames explaineu again how seveie the illness anu symptoms weie that we weie
expeiiencing anu again she stateu the iegulai uay foi the septic company to senu a
woikei to oui siue of the Peninsula was on Tuesuays, so he was scheuuleu to come
on Tuesuay, }uly 24, 2u12. }ames hau calleu Ni. Soto anu askeu him to please tiy to
get someone out to the home quickei than that as we have now been suffeiing with
this awful smell anu sicknesses foi iight at a week stiaight now.

}ames anu Bianui scheuuleu an appointment with oui family uoctoi on Tuesuay,
}uly 24, 2u12 to check us out anu to uocument what is happening to us anu to see
what his opinion was. We explaineu how we hau been calling the septic company to
come out to the home since }uly 19, 2u12 anu that the septic company was not
ietuining oui calls, noi was the ownei, Ni. Soto tiying to finu anothei company to
come out oi tiy to uo whatevei he coulu to help with the situation. We also
explaineu to oui uoctoi how the septic company stateu they woulu come out on
theii iegulai "Tuesuay", which is when they aie on that siue of the Peninsula.

Bi. }ames B. Chepko stateu that he was veiy uistuibeu by this on both the septic
company's pait anu the ownei of the home's pait. Be explaineu that the septic
company shoulu have an "emeigency line" foi these type of situations anu that the
gases that can come back up into a home fiom a septic tank aie "ueauly" gases anu
can uefinitely cause all of the symptoms we weie explaining we weie going thiough.
Be stateu that the uay we weie at his office was "Tuesuay" so they shoulu be theie
oi be on theie way by the time we weie finisheu with oui uoctoi appointment. Be
stateu to call him if we neeueu any fuithei assistance anu that he was not happy
with the septic company putting us off with the symptoms we weie complaining of
anu that it sounueu like they weie not taking it seiious when they of all people
shoulu know how 'ueauly' the septic gases can be. The uoctoi was also uistuibeu at
that time that }ames anu Bianui hau lost even moie unexplaineu weight fiom seeing
us in }une.

Latei that uay, aftei we ietuineu home fiom the uoctoi appointment at
appioximately 4pm, it uiu not appeai that the septic company hau come by yet anu
the gas smells weie still veiy stiong like when we hau left that moining foi the
uoctoi appointment. We left the fiont uooi open anu }ames calleu the septic
company again anu the ieceptionist saiu all she coulu tell }ames was that the woikei
ieceiveu the ticket that moining anu he woulu be theie as soon as he coulu. By that
time we weie even moie fiustiateu anu upset that this was being taken so lightly
when we weie veiy ill ovei the gas smells anu what oui family uoctoi hau tolu us
that veiy uay at the uoctoi appointment. }ames calleu Ni. Soto again anu he just
saiu he uiun't know what else to uo oi who else to call anu just left us with the
fiustiation of tiying to figuie out what we shoulu oi coulu uo.

At appioximately 7:uupm on Tuesuay, }uly 24, 2u12, the septic company woikei
finally showeu up. Be saiu he was theie to see what was going on anu if we coulu
explain what was happening. We of couise saiu "thank uou you aie finally heie" foi
we have been sleeping with the winuows open anu have been veiy, veiy sick fiom
these gas smells in oui home anu uown at the bottom of the home, especially wheie
the gaiage aiea is. The septic tank woikei saiu he uiu smell the gas smell stiongly
anu saiu he happeneu to have a little black uevice to put on the septic tank to help
ielease the gases so as to pievent them fiom going back up the pipes in the home.
Be was theie about 1 houi anu he stateu that he hau nevei seen this happen in any
home befoie anu that he hau been in the septic inuustiy foi appioximately 2S yeais.
Be saiu he smelleu the gases veiy stiongly in the gaiage aiea too anu so }ames

uissipating anu we weie all thinking that the uevice the septic woikei put on the
septic tank was woiking. Be stateu to us again that he uiu not unueistanu why this
woulu be happening anu that he uiu not know of anything else to uo except what he
uiu. Aftei he left, }ames calleu Ni. Soto to explain what the septic woikei uiu anu
saiu that he uiu not know what else to uo. }ames explaineu to Ni. Soto that the
uevice he put on the septic tank uiu seem to be helping with the gas smells to be
uissipating but that we weie still going to sleep with the winuows open to make
suie all of the gases weie out of the house, as we weie scaieu fiom what we hau
been thiough the last week stiaight.

It appeaieu to be woiking pietty goou because we coulu not smell the gases so
stiongly, but all of a suuuen Bianui staiteu bieaking out with blisteis on hei face.
This was weiiu to us because we thought that the gases weie uissipating anu yet
Bianui was bieaking out all ovei hei face with blisteis anu hei eyes weie buining
veiy bau still. We continueu to keep the gaiage uooi open, even at night, as the gas
smells seemeu to be woise in the gaiage anu then coming up thiough the flooi into
the mastei beuioom, mastei bathioom anu utility ioom. We took pictuies of
Bianui's face anu weie in contact with Ni. Soto to explain that we uiu not think the
pioblem was fixeu as now Bianui was bieaking out with blisteis all ovei hei entiie
face anu we weie still smelling the gases anu that we still weie not feeling well.
Both }ames anu Bianui weie veiy fiustiateu with the entiie situation anu especially
the lack of inteiest that Ni. Soto oi his wife seemeu to have with what was taking
place in theii iental home. Bianui was veiy conceineu that Ni. Soto, noi his wife,
weie calling to check on us oi even attempting to tiy to come out anu assess the
situation themselves to see what else coulu be uone to help us with what was taken
place in theii home.

0n }uly 29, 2u12, Ni. Soto calleu out of the blue anu came out to the S18S Castle
Biive home to biing anothei television fiom the othei two being fiieu fiom the
powei suiges we hau been expeiiencing. At that time Ni. Soto saiu he coulu see
how much weight we hau lost anu that we uiu not look well anu that he uiu smell
the gas smell in the gaiage aiea, howevei, he uiu not know what else to uo. Be
stayeu a few houis anu then left. Again, we weie left with no answeis, no help anu
fiustiateu as we weie ielying on expeits anu the ownei of the home to take caie of
these issues foi us, insteau of us being the ones having to tiy anu iemeuy them
ouiselves at the same time we weie baiely alive.

}ames hau tolu Ni. Soto on }uly 29, 2u12 that he shoulu at least contact his
insuiance company anu see what theii opinions aie peitaining to these matteis of
the gases anu the powei suiges anu the fact that his "tenants" weie veiy ill fiom an
unknown substance that appeaieu to be in the foim of an egg smelling gas. Ni. Soto

then ieplieu to }ames telling }ames to call his 'ienteis insuiance'. }ames was
fiustiateu anu iesponueu back to Ni. Soto by saying "this is not an issue of a stolen
television oi bioken television, but iathei youi long teim tenants being veiy ill uue
to an unknown egg smelling gas anu it is a mattei of life anu ueath, which is not
coveieu by 'ienteis insuiance'.

So basically Ni. Soto left that uay anu continueu on with his life anu abanuoneu his
uuties anu obligations onto the 'tenants', }ames Baiuin anu family. This uiu not sit
well with us as we weie getting sickei by the uay anu felt as if the ownei shoulu be
veiy conceineu about the welfaie anu safety of his 'tenants' living in his piopeity
anu we also felt that he shoulu have been calling othei companies to tiy anu figuie
out what the pioblem(s) weie with his piopeity. Anu at the least, we felt Ni. Soto
anu his wife shoulu have taken fuithei steps to get us into a safe location until such
time as the mattei coulu be iuentifieu anu iemeuieu. This uiu not take place, but
iathei Ni. Soto began to get confiontational with us anu tieating us as if we weie
blowing these issues out of piopoition anu at the same time, just leaving us in his
home with the matteis uniesolveu anu failing to contact anyone else to tiy to
iemeuy these matteis.

August staits out with the gases not smelling as stiong, howevei, we weie having
majoi symptoms anu illnesses, some which weie un-noticeable to us. Fiom August
S - August S, 2u12, Leah was expeiiencing majoi stomach pains anu uiaiihea, yet
none of the othei S family membeis weie having these symptoms. }ames was
passing out eveiy couple minutes at his computei thinking he was woiking. The
giils weie playing outsiue a lot as we hau the uooi anu winuows open in feai of the
gas smells coming back on stiong again.

Bianui calleu hei mom anu askeu hei to come stay with us foi a couple uays to help
us out anu was explaining all that we weie going thiough. Bianui's mothei, }oyce
Pounu, agieeu anu came out on August 8, 2u12 to stay with us anu see if maybe she
coulu tiy to unueistanu why the suuuen weight loss anu othei symptoms hau come
on as Bianui hau explaineu.

Bianui's mothei got to the S18S Castle Biive home at appioximately 4:uupm anu
planneu to stay a couple uays. She was veiy shockeu at what we lookeu like, moie
shockeu with }ames anu Bianui's appeaiance anu uiastic weight loss foi no ieason.
She was conceineu as to what Ni. Soto was saying oi uoing to help, oi the lack
theieof. She was also conceineu with what was going on because she saw we hau
plenty of foou in oui home anu that it appeaieu to be affecteu }ames anu Bianui the
most out of the entiie family. She uiu notice iight away that oui female uog, }ulia,
uiu not seem to be iesponuing anu acting noimally.

}oyce wanteu to go to the beach to take a walk anu befoie we coulu leave she saw
the neighboi, uene Stiaatmeyei, iiuing his bike up anu uown eveiy one's uiiveways

anu unueineath theii homes anu she saw the uevice hanging aiounu his neck.
Bianui askeu hei mom if she thought that was stiange oi not. Bianui's mom stateu
that she felt it was stiange because if uene Stiaatmeyei was tiying to get exeicise,
then it seemeu to uefeat the puipose of him iiuing up anu uown eveiyone's
uiiveways anu unueineath theii homes, insteau of just iiuing up anu uown the
stieets in the neighboihoou, if that was ieally the case of the uevice aiounu his neck
to calculate his mileage.

We all walkeu uown the stieet to heau to the beach. As we weie appioaching the
Sanu Castle stieet, which is the main entiance of the subuivision that leaus uown to
the beach, we saw the black cabling anu the uevices on the siue of the stieet that
was fiom the entiance of the neighboihoou anu leau uown to the enu of the stieet
iight at the beach. We weie all wonueiing what this equipment was anu we saw
that it hau a company name anu theii infoimation on one of the uevices. }ames anu
Bianui took pictuies so we coulu contact them anu enquiie as to what theii uevices
weie theie foi etc.

As we maue it back to the beach house at uusk anu got settleu in foi beu, all of a
suuuen the stiong egg smells came on again. This time we woke Bianui's mom up
anu she came out to see what the smell was anu she uiu inueeu smell the iotten egg
smells anu veiy stiong. }ames, Bianui anu }oyce all went uown to the gaiage anu
}ames openeu the gaiage uooi anu again the smells weie veiy, veiy stiong in theie.
}ames theiefoie openeu the gaiage anu kept it openeu, along with the winuows
thioughout the night. We all got little sleep that night as you can imagine.

The next uay, August 9, 2u12, Bianui's mom woke up with a migiaine heauache,
which she stateu was not noimal foi hei. Bianui was expeiiencing uiaiihea again.
The smells weie still stiong anu theiefoie }ames contacteu the septic company anu
Ni. Soto to see what they coulu uo anu how fast they coulu get out to the home to
see what these iotten egg smells aie anu why the gases aie coming into oui home
anu especially in the gaiage aiea, which appeaieu to be seeping up into the mastei
beuioom, mastei bathioom anu utility siue of the home the woist, anu even with the
uooi anu winuows open uay anu night.

That same uay my mom, }oyce, went to buy some Riu-X to see if that may help in the
mean time since Ni. Soto noi the septic company woulu come out to tiy anu uo
anything oi come to oui assistance. So as of the night of August 9, 2u12, still no
ietuin phone calls, anu we weie all left with the gaiage uooi anu winuows open to
tiy to at least get a little bit of sleep until someone coulu come out.

The next uay, August 1u, 2u12, }ames was on the phone calling Ni. Soto anu the
septic company again uue to the stiong gas smells. The septic company tolu }ames
at that time that they uiu not feel theie was anything else they coulu uo, so }ames
calleu Ni. Soto again anu tolu him what the septic company saiu anu }ames askeu
Ni. Soto if he coulu call anu get some othei company out foi we weie still sick anu
the gases weie still theie stiongei than evei, anu }ames even explaineu how

on August 8, 2u12. Ni. Soto again stateu he uiu not know what else to uo anu he uiu
not know who else to call.

Bianui took the numbei off the uevice, shown in the pictuies we took, anu calleu
"Cuuveiitas" on August 1u, 2u12 to see what the uevices weie anu who she coulu
speak to peitaining to what we weie going thiough anu explaineu how we weie
veiy sick anu getting woise anu that we weie having gas smells coming up fiom the
piopeity, all aiounu the piopeity anu insiue the home veiy stiong. Bianui was
given the name of the men who weie ovei that specific pioject anu left messages foi
them to contact us back immeuiately.

At that point, Bianui anu }oyce went to the neighboi's, Kay anu }ohn Noieyeko, to
see if they knew of any othei septic company we coulu call anu explaineu what we
weie uealing with. Kay immeuiately stateu she knew a guy that went to theii chuich
anu we coulu call him anu see what he coulu uo. Kay calleu Nac anu explaineu to
him what Bianui hau explaineu to hei, anu then Nac spoke to Bianui on the phone
anu askeu a couple questions. Nac stateu it was S:Supm anu that he was going to
iap up the job he was on anu heau stiaight ovei to oui home anu that he woulu be
theie by S:Supm the latest. Nac stateu that he helu the highest license that Texas
issues anu that he was the only one he knew of in the aiea anu theiefoie he felt he
was the highest qualifieu in that inuustiy anu he woulu see us at S:Supm the latest.

Aftei Nac was finisheu with his woik on the septic tank that evening, he showeu
}ames, Bianui, }oyce, Kay anu }ohn his TCEQ license numbei anu saiu if anyone hau
any questions, they shoulu call him. Be stateu that it was obvious to him that uay
that we weie veiy ill anu that he fixeu all that he coulu, but he uiu not feel the
pioblem was iesolveu anu wiote why in his iepoit. Be fuithei stateu that his main
concein was not the smell anu toxicity as much as the concein of the gas causing an
explosion of the iesiuence anu he then askeu to speak to Ni. Soto who was on the
phone with }ames at the time explaining that he was faxing ovei Nac's iepoit anu
invoice. Nac stateu that his concein was that the "seismic blasting" hau possibly
causeu unueigiounu anu in house cuplings to bieak loose which was ieleasing the
gas thioughout the home anu all the way aiounu the piopeity, especially seeping
thiough the sanu.

}ames ieceiveu a phone call fiom Wesley Tayloi with Samson Exploiation stating he
woulu like to meet the next uay, Satuiuay, August 11, 2u12, to uiscuss the issues we
weie expeiiencing anu tiy to iemeuy them. The meeting was set by phone by }ames

these conuitions anu especially with the illnesses we weie expeiiencing. We also
tolu Ni. Soto that we felt he shoulu have attenueu the meeting anu that he shoulu be
the one tiying to iemeuy the issues peitaining to his piopeity, in lieu of us, the
tenants.

So as of August 11, 2u12, the Baiuin Family took a bag full each anu went to stay at
Bianui's motheis in hopes that Ni. Soto woulu be attempting to iemeuy the entiie
situation fiom his home issues, the expenses of us, the tenants emeigency
ielocation, the expenses of uoctois appointments etc., which nevei took place.
Insteau, Ni. Soto attempteu to finu eveiy excuse as to why he was just going to get
us to move oui belongings out anu put his home up foi sale.

At that point, }ames anu Bianui hau to figuie out how anu when to go back to this
uangeious enviionment in oiuei to move oui belongings out anu then figuie out
what to uo fiom theie, all while extiemely ill.
