The above-entitled cause came on for hearing

before the HONORABLE A. JAY CRISTOL, one of the judges

f the UNITED STATES BANKRUPTCY COURT, in and for

the SOUTHERN DISTRICT OF FLORIDA, at 51 Southwest 1st

Avenue, Miami, Dade County, Florida, on Thursday,

February 1, 2001, commencing at or about 10:00 a.m.,

2 matter, I believe.

3 MR. AVRON: Yes, sir. Good morning, Judge. My

4 name is Paul Avron, I'm with the firm of Berger Davis &

5 Singerman. We're here today on a -- well, excuse me.

6 MS. ALONSO: Good morning, your Honor.

7 Grisel Alonso, Assistant United States Attorney on behalf

8 of the Federal Bureau of Prisons.

9 MR. AVRON: Excuse me, Judge. Good morning

10 again. We're here today on a continued status conference

11 of a December 18th order granting discovery to the Federal

12 Bureau of Prisons in the form of tapes of outgoing calls

13 made by Mr. Lawrence from the Federal Detention Center

14 here in Miami.

15 THE COURT: I have a recollection of the matter.

16 MR. AVRON: Yes, sir.

17 THE COURT: What do we need to do today?

18 MR. AVRON: Sir, we have -- I have spoken with

19 Ms. Alonso and Mr. De Aguiar, who is also with the Federal

20 Bureau of Prisons, and reached a tentative agreement

21 subject to your Honor's approval --

22 THE COURT: Approved.

23 MR. AVRON: -- on a going forward basis. I would

24 like to hit the highlights, but if I may approach and

25 present a proposed order?

1 THE COURT: You may, but, I mean, is this

2 something you want on the record? If you've got an

3 agreement and it's going to be sealed, don't you want to

4 just leave it that way?

5 MR. AVRON: That's fine.

6 THE COURT: I mean, there's no dispute as to what

7 the agreement is, is there?

8 MR. AVRON: No, and I've presented it to ---

9 MS. ALONSO: No, your Honor, there is -- there is

10 no objection to the presentation of the order. In fact,

11 in compliance with the proposed order I have here with me

12 today the latest telephone log that was produced to me

13 this morning by fax from the Federal Bureau of Prisons.

14 I'm going to hand it to counsel.

15 THE COURT: Very well. Okay.

16 MS. ALONSO: Just for the record, the Bureau is

17 appreciative of the trustee's efforts to keep the burden

18 short and sweet in this matter given the time frame.

19 THE COURT: Well, I'm delighted that it's short,

20 I'm not sure how sweet, but ---

21 MR. AVRON: And also for the record, the trustee

22 wants to express his appreciation to Ms. Alonso and

23 Mr. De Aguiar for their cooperation in this obviously

24 highly sensitive matter.

25 THE COURT: Well, I'm delighted that everyone has

1 been able to work so well together to resolve everyone's

2 individual problems and needs without unduly impacting or

3 adversely affecting the other side of the issue.

4 MR. AVRON: Judge, may I, after your Honor signs

5 the order, if I may, with the Court's approval, walk that

6 through the clerk's office to see that it's filed under

7 seal?

8 THE COURT: You certainly may.

9 MR. AVRON: Thank you, sir.

10 THE COURT: I would take it, if you'd like, to my

11 office and get a copy made for yourself and for the

12 United States Attorney or will they do it down there?

13 Whatever, just so you have your copy before it gets

14 sealed.

15 MR. AVRON: They actually make -- I've done it a

16 few times here, they make copies for me here and I will --

17 THE COURT: Okay.

18 MR. AVRON: -- pursuant to the order, serve it

19 on ---

20 THE COURT: Okay. My only complaint is, I mean,

21 I can't have these long mornings, but anyhow, try to make

22 it a little shorter next time.

23 MR. AVRON: Thank you, sir.

24 THE COURT: Thank you.
