    Transcript of the Feb. 1, 2001 sealed bankruptcy court wiretap hearing. It identifies an illegal, ongoing, long-standing, amorphous "agreement" for the U.S. Govt to conduct ongoing telephone (and other) surveillance of Lawrence, his attorneys, and others, ostensibly for the bankruptcy trustee. However, all of that protected law enforcement material was being secretly and illegally funneled to Bear Stearns (now JP Morgan) for years. See posted 2006 court admission, by Berger Singerman attorneys Paul Singerman, James Fierberg, and Paul Avron, that Bear Stearns had obtained the law enforcement tapes. This amazing transcript states that a reason for the unparalleled secrecy was to assure the surveillance (including attorney-client surveillance) continued "without unduly impacting or adversely affecting the other side of the issue." The "other side of the issue" was Lawrence's then pending appeal to the 11th Circuit and other open district court matters, including the planning of a subsequently filed habeas corpus petition. The purpose of the secrecy was to successfully prevent Lawrence, his attorneys, the district court, or appeals court from learning of the secret attorney-client communications surveillance during multiple appeals and other proceedings. Further documents posted show Juval Aviv, an infamous self-proclaimed Israeli assassin, was the initial recipient of the law enforcement tapes and other information -- purportedly for his fabricated "investigations." Then, though the aid of Berger Singerman attorneys, that information was illegally funneled to Bear Stearns. This transcript was only first found by the court reporter in Sept. 2005, after years of the reporter's previous denials that it existed. Further transcripts of long undisclosed hearings, are being posted to this site. A wiretap "extension" order was issued the same day of this undocketed sealed hearing (the order is posted to this site) even though no motion for such an "extension" wiretap was filed by Goldberg. Furthermore, what was also happening was that a "mole" or "canary in the mine" had been planted within the US Attorney's office, Juval Aviv. Nobody told the USAO that law enforcement information was routinely being funneled to senior Bear Stearns management despite the fact that serious laws were being violated. Aviv became a means to tip off Bear Stearns if there was an investigation into not only their ongoing theft of law enforcement tapes and other protected information, but as to what later turned out to be the largest financial scam in U.S. history, the "derivatives" fraud now, which, in part, was played out in Goldman Sachs hearings in Congress, and the continuing collapse of our financial system. Why was all of this information being stolen? So that Bear Stearns would have information they could use in pending state and federal court litigation with Lawrence and his family -- for debt collection! If Bear Stearns had been stopped in the early 2000's, when it first became apparent they were stealing lawfully protected information from the US Department of Justice, the U.S. taxpayer would not have later bought 30 billion in worthless securities from Bear Stearns in 2008, and some of the extraordinary damage still being inflicted on the US economy could have been prevented. Secretly sealed billing records show that the direct recipient of the stolen law enforcement material was Bear Stearns senior management. Instead of stopping Bear Stearns, it was encouraged, using illegal special favors and insider connections, to create even larger frauds secure in the knowledge that their power and influence extended into being actively able to monitor the DOJ from the inside.

    3 MR. AVRON: Yes, sir. Good morning, Judge. My

    4 name is Paul Avron, I'm with the firm of Berger Davis &

    5 Singerman. We're here today on a -- well, excuse me.

    6 MS. ALONSO: Good morning, your Honor.

    7 Grisel Alonso, Assistant United States Attorney on behalf

    8 of the Federal Bureau of Prisons.

    9 MR. AVRON: Excuse me, Judge. Good morning

    10 again. We're here today on a continued status conference

    11 of a December 18th order granting discovery to the Federal

    12 Bureau of Prisons in the form of tapes of outgoing calls

    13 made by Mr. Lawrence from the Federal Detention Center

    14 here in Miami.

    15 THE COURT: I have a recollection of the matter.

    16 MR. AVRON: Yes, sir.

    17 THE COURT: What do we need to do today?

    18 MR. AVRON: Sir, we have -- I have spoken with

    19 Ms. Alonso and Mr. De Aguiar, who is also with the Federal

    20 Bureau of Prisons, and reached a tentative agreement

    21 subject to your Honor's approval --

    22 THE COURT: Approved.

    23 MR. AVRON: -- on a going forward basis. I would

    24 like to hit the highlights, but if I may approach and

    25 present a proposed order?

    1 THE COURT: You may, but, I mean, is this

    2 something you want on the record? If you've got an

    3 agreement and it's going to be sealed, don't you want to

    4 just leave it that way?

    5 MR. AVRON: That's fine.

    6 THE COURT: I mean, there's no dispute as to what

    7 the agreement is, is there?

    8 MR. AVRON: No, and I've presented it to ---

    9 MS. ALONSO: No, your Honor, there is -- there is

    10 no objection to the presentation of the order. In fact,

    11 in compliance with the proposed order I have here with me

    12 today the latest telephone log that was produced to me

    13 this morning by fax from the Federal Bureau of Prisons.

    14 I'm going to hand it to counsel.

    15 THE COURT: Very well. Okay.

    16 MS. ALONSO: Just for the record, the Bureau is

    17 appreciative of the trustee's efforts to keep the burden

    18 short and sweet in this matter given the time frame.

    19 THE COURT: Well, I'm delighted that it's short,

    20 I'm not sure how sweet, but ---

    21 MR. AVRON: And also for the record, the trustee

    22 wants to express his appreciation to Ms. Alonso and

    23 Mr. De Aguiar for their cooperation in this obviously

    24 highly sensitive matter.

    25 THE COURT: Well, I'm delighted that everyone has

    1 been able to work so well together to resolve everyone's

    2 individual problems and needs without unduly impacting or

    3 adversely affecting the other side of the issue.

    4 MR. AVRON: Judge, may I, after your Honor signs

    5 the order, if I may, with the Court's approval, walk that

    6 through the clerk's office to see that it's filed under

    7 seal?

    8 THE COURT: You certainly may.

    9 MR. AVRON: Thank you, sir.

    10 THE COURT: I would take it, if you'd like, to my

    11 office and get a copy made for yourself and for the

    12 United States Attorney or will they do it down there?

    13 Whatever, just so you have your copy before it gets

    14 sealed.

    15 MR. AVRON: They actually make -- I've done it a

    16 few times here, they make copies for me here and I will --

    17 THE COURT: Okay.

    18 MR. AVRON: -- pursuant to the order, serve it

    19 on ---

    20 THE COURT: Okay. My only complaint is, I mean,

    21 I can't have these long mornings, but anyhow, try to make

    22 it a little shorter next time.

    23 MR. AVRON: Thank you, sir.
