Directive 95/16/EC establishes European legal requirements for the design, construction, installation and
placing on the market of ne lifts! "t also sets out the conformit# assessment procedures to be folloed b#
lift installers to ensure conformit# ith these safet# requirements! $he Directive covers ne lifts
permanentl# installed in buildings and constructions for carr#ing passengers or passengers and loads! "t
also applies to certain safet# components for lifts listed in %nne& "' of the Directive! "t does not cover lifts
temporaril# installed on construction sites, cablea#s and funicular raila#s, or lifts installed on machiner#
or in mineshafts!
"nstallers of lifts and manufacturers of safet# components ()suppliers*+ have to compl# ith the ,ift
Directive! %ll lifts and safet# components ithin the scope of the ,ift Directive, hich are placed on the
market and put into service in C#prus, including imports, have to-
be safe (or in the case of a safet# component enable the lift in hich it is installed to be safe+.

provisions of the ,ift Directive appl# in enlarged Europe in the 55 2ember 3tates and 4ora#, "celand and
,iechtenstein!

Directive 95/16/EC as adopted b# the European 8arliament and Council aiming at harmonising the las
of the 2ember 3tates relating to lifts! $he Directive applies to lifts and safet# components first placed on
the Communit# market and put into service on or after 1 1ul# 1999!

$he ,ift Directive applies to lifts permanentl# serving buildings and constructions! "t also applies to the
safet# components for use in such lifts listed in %nne& "' of the ,ift Directive (%rt! 1(1++!

What is a lift?
,ift is an appliance serving specific levels, having a car moving along guides hich are rigid or along a
fi&ed course even here the# do not move along guides hich are rigid (for e&ample, scissor lifts+ and
inclined at an angle of more than 15 degrees to the hori:ontal and intended for the transport of-
persons,

What is a safety component?
3afet# component is a component listed in %nne& "' to the ,ift Directive and is intended to be used in a
lift! 3afet# components are-
Devices for locking landing doors!
Devices to prevent free fall or uncontrolled upard movements of the car in the event of poer
cut or failure of components (3ection ;!5 of %nne& "+!
<verspeed limitation devices!
(a+ Energ#=accumulating shock absorbers-
- either non=linear,
- or ith damping of the return movement!
(b+ Energ#=dissipating shock absorbers!
3afet# devices fitted to >acks of h#draulic poer circuits here these are used as devices to
prevent falls!
Electric safet# devices in the form of safet# sitches containing electronic components!
Who is installer of the lift?
"nstaller of the lift is the natural or legal person ho takes responsibilit# for the design, manufacture,
installation and placing on the market of the lift and ho affi&es the CE marking and dras up the EC
Declaration of Conformit# (%rt 1(7++!
Who is manufacturer of the safety component?
2anufacturer of the safet# component is the natural or legal person ho takes responsibilit# for the design
and manufacture of the safet# component specified in the %nne& "' and ho affi&es the CE marking and
dras up the EC Declaration of Conformit# for the safet# component (%rt 1(7++!

$he folloing are e&cluded from the scope of the ,ift Directive (%rt! 1(;++-
cablea#s, including funicular raila#s, for the public or private transportation of persons,
lifts speciall# designed and constructed for militar# or police purposes,
mine inding gear,
theatre elevators,
lifts fitted in means of transport,
lifts connected to machiner# and intended e&clusivel# for access to the orkplace,
rack and pinion trains,
construction=site hoists intended for lifting persons or persons and goods!

$he ,ift Directive requires, among other things, t#pe=e&amination, inspection and verification testing of lifts
and of the safet# components specified in %nne& "' to the ,ift Directive before the# can be placed on the
Communit# market and put into service! 8rovision is also made for conformit# assessment of lifts and
specified safet# components based on a lift installer?s or manufacturer of safet# components? qualit#
assurance s#stem!

Where are essential health and safety requirements specified?
,ifts and safet# components must satisf# the essential health and safet# requirements set out in %nne& " to
the ,ift Directive, or, in the case of a safet# component, it shall enable the lift in hich it ill be installed to
satisf# those requirements (%rt ;+!

2ethods of compl#ing ith the Essential @ealth and 3afet# Aequirements are to ensure that lifts and
safet# components are in conformit# ith-
the essential health and safet# requirements themselves. or
harmonised standards, the reference of hich has been published in the <fficial 1ournal of the
European Bnion. or
in the absence of harmonised standards, e&isting national technical standards and
specifications regarded as important or relevant for the proper implementation of the essential
health and safet# requirements!
8aragraph 5!5 of %nne& " to the ,ift Directive provides derogation from the manner in hich the ob>ective
ill be achieved to prevent the risk of crushing hen the car is in one of e&treme positions! $his
derogation affords 2ember 3tates the possibilit# of giving prior approval to other means to avoid the
specified risk particularl# in e&isting buildings, here the solution is impossible to fulfil! 0urther information
can be obtained from the C#prus Contact point at the Department of ,abour "nspection!

$he ,ift Directive provides a ide choice of conformit# assessment procedures covering the design,
manufacture, installation and final inspection of lifts, and the design and manufacture of lift safet#
components! 8rocedures involve participation of a notified bod#! "n some procedures, notified bodies
check the conformit# of a model of a lift or safet# component! "n other procedures, notified bodies approve
and monitor the qualit# assurance s#stem of the lift installer or safet# component manufacturer ho is
then able to assess the conformit# of his products himself!

Chere a lift or safet# component is sub>ect to other Communit# Directives concerning other aspects and
hich also provide for the affi&ing of the CE marking, such marking shall indicate that the lift or safet#
component is also presumed to conform to the provisions of those other Directives (%rt D(7+(a++! $here are
to Directives, hich have to be considered carefull# in relation to lifts- the Construction 8roducts
Directive and the 2achiner# Directive!
What is the relation to the Construction Products Directive?
$he essential requirements of the Construction 8roducts Directive (%rt 5(;+ of the Directive D9/166/EEC+
also appl# to lifts (,ift Directive, %rt! 17+! $he Construction 8roducts Directive te&t is- )Chen a future
Directive concerns mainl# other aspects and onl# to a minor e&tent the essential requirements of this
Directive, that subsequent Directive shall contain provisions ensuring that it also covers the requirements
of this Directive!)
What is the relation to the Machinery Directive?
Chere the relevant ha:ard e&ists and is not dealt ith in the %nne& " of the ,ift Directive, then the
essential health and safet# requirements of the %nne& " of the 2achiner# Directive (9D/;9/EC+ applies also
to lifts (4ote- the ,ift Directive provides a reference to the old 2achiner# Directive D9/;95/EEC and its
amendments+! $he 2achiner# Directive principles of safet# integration must appl# to lifts in an# event!

What are obligations of other persons?
Chere neither the installer of the lift nor the manufacturer of the safet# component nor his authorised
representative established in the Communit# has complied ith the respective requirements of conformit#
assessment procedures, those obligations have to be fulfilled b# the person ho places the lift or safet#
component on the market in the Communit#! $he same obligations shall appl# to homsoever
manufactures or imports (from outside the Communit#+ a lift or safet# component and puts it into service
for his on use (%rt D(5++!
ow should the lift installer and the person on the building inform each other?
$he person responsible for ork on the building or construction and the installer of the lift must keep each
other informed of the facts necessar# for, and to take the appropriate steps to ensure, the proper
operation and safe use of the lift (%rt 5(5++!
$he shafts intended for lifts ma# not contain an# piping, or iring, or fittings other than that necessar# for
the operation and safet# of the lift (%rt 5(;++!

Must the C! mar"ing be affi#ed to every lift car?
Ees! CE marking must be affi&ed to ever# lift car, distinctl# and visibl#, in accordance ith 3ection 5 of
%nne& " and shall be affi&ed on each of the safet# components listed in %nne& "' or, here that is not
possible on a label inseparabl# attached to the safet# component (%rt 16(5++!
,ifts and safet# components bearing the CE marking and accompanied b# the EC Declaration of
Conformit# are regarded as conforming to all the provisions of the ,ift Directive including the conformit#
assessment procedures (%rt 5(1++!

Which standards provide presumption of conformity?
Chen the references of harmonised standards are published in the <fficial 1ournal of the European Bnion,
their application confers a presumption of conformit# ith the essential health and safet# requirements

presumption of conformit# ith the relevant essential health and safet# requirements!

What must be provided for a new lift?
% ne lift has to be provided ith-
EC Declaration of Conformit# in the national language,
instructions manual and a logbook in the national language,
data plate in the car ith the required information,
lift has to be CE marked!
Who has to provide the !C Declaration of Conformity in $ree" language for Cyprus?
$he supplier has to provide EC Declaration of Conformit# in /reek language! "f neither the supplier nor the
authorised representative established in the Communit# does provide it, then it must be provide b# the
importer or an# person that is responsible for placing the lift on the C#prus market! "f the translation is not
made b# the supplier or b# the authorised representative then the original Declaration has to be attached!

Who can ma"e translations?
%n#one! "t is not alloed to require that a translator ould be accredited or recognised b# the public
authorities!
%s it permitted to shorten the translation of the original manual?
4o, translation has to be correct and complete! "t is not alloed to shorten or modif# the original manual

Which notified body can be contacted by the installer or manufacturer?
"nstallers and manufacturers ma# address an# notified bod# in the EB that is approved for the relevant
procedure! $he certificates issued b# a notified bod# are valid in all EB countries!

%fter completing the appropriate conformit# assessment procedure, the lift installer or safet# component
