1. INTRODUCTION
This ESYD Guidance presents the main points of the Directive 95/16/EC, with an emphasis
on the obligations of the manufacturer and the notified body, in order to identify the critical
points in the conformity assessment procedure and to facilitate the accreditation procedure
of bodies to be notified.
In any case, the involved parties shall be informed fully with the provisions of this Directive,
the applicable standards, as well as with the relevant Guidelines issued by the European
Commission and being available on the web page www.newapproach.org.
This Guidance supplements Guidance Document EA-2/17, regarding the requirements for
the assessment of organizations with the purpose of notification.
In addition, this ESYD Guidance is applicable to periodic inspections of lifts, contains both
application guidelines for certification and inspection bodies in the process of being
accredited or having been accredited by ESYD, but also for ESYD assessors and refers inter
alia to:
2. DEFINITIONS
Lift inspection means the process of carrying out standard inspections and tests on the
lift, intended to verify its conformity with safety specifications (regulations and standards).
Existing lift is characterized each lift that has been in operation and is in use, regardless of
the year of installation.
Initial inspection of lift means the inspection of a new lift by an accredited/notified body,
before it is placed on the market and is put into use.
Scope
For the purposes of this Guidance, ‘lift’ shall mean a lifting appliance serving specific levels,
having a carrier moving along guides which are rigid and inclined at an angle of more than
15 degrees to the horizontal, intended for the transport of:
— persons,
— persons and goods,
— goods alone if the carrier is accessible, that is to say a person may enter it without
difficulty, and fitted with controls situated inside the carrier or within reach of a person
inside the carrier.

Lifting appliances moving along a fixed course even where they do not move along guides
which are rigid shall be considered as lifts falling within the scope of the Lifts Directive (e.g.
the lifts with ribbed guides).

A. the manufacturer selects the module/annex to be applied for the conformity assessment
of safety components as shown below:

relating to lifts as shown below:
C. Since the full quality assurance procedure as set out in annex XIII can be applied both in
the design and installation phase and only in the design phase, it is possible for the person
who performs only the design and construction and not the installation to have the full
quality assurance system approval.
Therefore the installer selects the module/annex (production phase) to be applied for the
conformity assessment relating to lifts as shown below:

In this case, the designer of the lift (design phase) shall provide all documentation to the
installer to ensure the correctness and completeness of the final inspection of the
installation, including the documentation of design inspection, in accordance with paragraph
3.3 of annex XIII.
The manufacturer or the person responsible for installation, respectively, in each case draws
up the declaration of conformity.

In annex 1 of this Guidance, the main points of essential safety requirements are set out.
The preparation of the technical dossier for a lift and its safety components is one of the
most critical points in the conformity assessment procedure by a third party and applies to
annexes V (module B), X (module G), and practically in XIII (module H), in the sense that
the quality management system of the manufacturer must include the information
contained in the technical dossier.
The technical dossier should include the following:
- A general description of the representative model of the lift (all possible extensions should
be clearly indicated) / of the safety components (including the area of use and conditions)
- Essential requirement(s) taken into consideration and the means adopted to satisfy it
(them) (e.g. a harmonized standard)
- A copy of the lift instruction manual / a copy of the assembly instructions for the safety
components
- Steps taken at the installation stage to ensure that the series-produced lift conforms to
the provisions of the Directive / at the manufacturing stage to ensure that series-produced
safety components conform to the safety component examined.
4.2.1. Lodges an application for assessment of his quality assurance system with a
notified body. The application must include:
a. all relevant information on the lifts, in particular information which makes for an
understanding of the relationship between the design and operation of the lift and
enables conformity with the requirements of the Directive to be assessed,
b. the documentation on the quality assurance system.
4.2.2. Maintains a quality assurance system that ensures conformity of the lifts with the
requirements of the Directive that apply to them.
4.2.3. Documents all the elements, requirements and provisions adopted, in a systematic
and orderly manner in the form of written measures, procedures and instructions.

Note 3: the requirement for the competence to design a lift does not preclude the
possibility of supply of components.
Note 5: choosing the right type of machinery requires both knowledge of its
application as well as knowledge related to friction, way of connection of
ropes, etc.
d. The examinations and tests that will be carried out on acceptance of the
supplies of materials, components and sub-assemblies.
f. The examinations and tests that will be carried out before (inspection of
installation conditions: shaft, housing of machinery, etc.), during and after
installation (including at the very least the tests laid down in Annex VI,
Section 4 (b)).
g. The quality records, such as inspection reports and test data (including
internal audit reports, covering all activities of the Quality Management
System), calibration data, reports on the qualifications of the personnel
concerned, etc.
4.2.4. Undertakes to discharge the obligations arising from the quality assurance
system as approved and to ensure that it is maintained in an appropriate and
efficient manner.
4.2.5. Keeps the notified body that has approved the quality assurance system
informed of any intended updating of the quality assurance system.
4.2.6. Allows the notified body access for inspection purposes to the design,
manufacture, assembly, installation, inspection and testing and storage
locations, and must provide it with all necessary information, in particular:
b. The quality records provided for in the design part of the quality assurance
system, such as results of analyses, calculations, tests, etc.
c. The quality records provided for in the part of the quality assurance system
concerning acceptance of supplies and installation, such as inspection reports
and test data, calibration data, reports on the qualifications of the personnel
concerned, etc.
4.2.7. Retains for a period of 10 years after the lift has been placed on the market,
keeping at the disposal of the national authorities
b. The updating referred to in the second paragraph of Section 3.5 (Annex XIII).
c. The decisions and reports from the notified body which are referred to in the
final paragraph of Section 3.5 and in Sections 4.3 and 4.4 (Annex XIII).
d. Where the installer is not established in the Community, this obligation falls
to the notified body.
4.3 Full quality assurance (module H) Annex IX for the safety components
4.3.2. Lodges an application for assessment of his quality assurance system with a
notified body. The application must include:

components with the requirements of the Directive that apply to them and
enables lifts to which they have been correctly fitted to satisfy those
requirements.

data, reports on the qualifications of the personnel concerned, etc.,
o the means of monitoring the achievement of the required design and product
quality and the effective operation of the quality assurance system.
4.3.6. Undertakes to discharge the obligations arising from the quality assurance
system as approved and to ensure that it is maintained in an
appropriate and efficient manner.
4.3.7. Informs the notified body which has approved the quality assurance system of
any intended updating of the quality assurance system.
4.3.8. Allows the notified body access for inspection purposes to the design,
manufacture, inspection and testing, and storage locations, and shall provide it
with all necessary information, in particular:
— The quality records provided for in the design part of the quality system, such
as results of analyses, calculations, tests, etc.
— The quality records provided for in the manufacturing part of the quality
assurance system, such as inspection reports and test data, calibration data,
reports on the qualifications of the personnel concerned, etc.
4.3.9. Retains for a period of 10 years after the last safety component has been
manufactured, keeping at the disposal of the national authorities:
— The decisions and reports from the notified body which are referred to in
the final paragraph of Section 3.4 and in Sections 4.3 and 4.4 (Annex IX).
Where neither the manufacturer of the safety components nor his authorized representative
is established in the Community, the obligation to keep the technical documentation
available falls to the person who places the safety component on the Community market.
The person that performs the lift manufacture, assembly, installation and final inspection
shall have authorization of electrician installer, Specialty D.
The engineers referred to in article 1 of L. 6422/1934 have the right to carry out the design
of the lift.
For the conduct of the final inspection of the lift, the installer shall have at his disposal the
equipment referred to in paragraph 7 of the present Guidance.
The notified body must have specific control procedures for each Module it has activities.
5.1.1.1 examine the technical dossier to assess how far it can meet the desired
aims,
5.1.1.2 examine the representative model of the lift / safety component to check
that it has been manufactured in accordance with the technical dossier,
5.1.1.3 perform or have performed the appropriate checks and tests necessary to
verify whether the solutions adopted by the installer of the lift/the
manufacturer of the safety component meet the requirements of the
Directive.
The audit team shall examine the completeness of the technical dossier, the content of
which is presented in paragraph 4.1 of the present Guidance (see also Annexes 7 and 8).
DESIGN INSPECTION
When the design is not entirely in accordance with harmonized standards, the notified
body must ascertain:
5.1.2.1 Whether the design conforms to the provisions of the Directive and, if it does,
issue an ‘EC design examination certificate’ to the installer, stating the limits of
the certificate's validity and giving the details required for identification of the
approved design.
5.1.2.2 Assess the quality assurance system to determine whether it satisfies the
requirements of Section 3.2 of Annex XIII of the Directive. It must presume
compliance with these requirements in respect of quality assurance
systems that implement the relevant harmonized standard (1).
The auditing team must have at least one member with experience of
assessment in the lift technology concerned.
The assessment procedure must include at least a visit to the lift installer's
premises and a visit to the installation site.
Specifically, the assessment conducted by the certification body must include
audit of the manufacturer, who applies an approved quality assurance system for
the design, manufacture, final inspection of the lift and testing.
The assessment procedure must also include a visit to the manufacturer's
premises (on-site).
(1) This harmonized standard will be EN 29001, supplemented where necessary to take
account of the specific features of the lifts.
5.1.2.3 Notify its decision to the lift installer. The notification must contain the conclusions
of the examination and the reasoned assessment decision.
5.1.2.4 Assess the modifications proposed and decide whether the modified quality
assurance system will still satisfy the requirements referred to in Section 3.2 of
Annex XIII of the Directive or whether a reassessment is required.
5.1.2.5 Must periodically carry out audits to make sure that the manufacturer of a lift
maintains and applies the quality assurance system and must provide the
manufacturer of a lift with an audit report.
In the policy and procedures of the notified body, the criteria according to which
the minimum audit frequency is defined must be determined.
5.1.2.6 May pay unexpected visits to the premises of a lift installer or to the
assembly site of a lift. At the time of such visits, the notified body may carry out
tests or have them carried out in order to check the proper functioning of the
quality assurance system where necessary. It must provide the lift installer with a
visit report and, if a test has been carried out, with a test report.
The installer shall notify the list of installed lifts of his clients to the notified body.
5.1.2.7 Must forward to the other notified bodies the relevant information concerning the
quality assurance systems issued and withdrawn.
Notify its decision to the manufacturer of the safety components. The notification
must contain the conclusions of the examination and the reasoned assessment
decision.
Assess the modifications proposed and decide whether the modified quality assurance
system will still satisfy the requirements referred to in Section 3.2 of Annex IX of the
Directive or whether a reassessment is required.
Notify its decision to the manufacturer. The notification must contain the conclusions
of the examination and the reasoned assessment decision.
Must periodically carry out audits to make sure that the manufacturer of
the safety components maintains and applies the quality assurance
system and must provide an audit report to the manufacturer of the
safety components.
Must forward to the other notified bodies the relevant information concerning the
quality assurance system approvals issued and withdrawn.
The notified body shall carry out checks and tests that shall cover in particular:
a) Examination of the documentation to check that the lift conforms to the representative
model of the lift approved in accordance with Annex V part B of the Directive.
b) — operation of the lift both empty and at maximum load to ensure correct installation
and operation of the safety devices (end stops, locking devices, etc.),
— operation of the lift at both maximum load and empty to ensure the correct
functioning of the safety devices in the event of loss of power,
— static test with a load equal to 1,25 times the nominal load.
The final inspection must be carried out by a person not involved in the design,
manufacture, assembly and installation.
The notified body must define the qualifications of the personnel involved in the conformity
assessment procedures. This personnel must satisfy the corresponding requirements that
are reported in Annex II of the present Guidance.
The persons carrying out lift installation inspections are divided in four categories:
• Trainee inspector
• Inspector
• Auditor
• Lead Auditor
Trainee inspectors and inspectors must be Dipl. Mechanical Engineers, Electrical Engineers,
Mechanical-Electrical Engineers, Naval-Mechanical Engineers and Naval Engineers or
Engineers with equivalent specialty, University graduates, who are members of the
Technical Chamber of Greece (T.E.E.) and holders of the respective professional license, as
well as Technologist Engineers with corresponding specialties, graduates of Technological
Institutions, provided that they are registered in the Ministry of Development registers.
Everyone who has activities in foreign countries must have the corresponding
equivalent license, as required by local Legislation.
Note: In cases of Engineers with other specialties, having post-graduate degree in mechanical
engineering or in similar sector and documented experience of more than 10 years in the technical field
of lifts, compatibility is proven with the requirements of the present Guidance. These trainee inspectors
and inspectors have the possibility to develop under the same conditions as all other trainee inspectors
and inspectors.
In order to become an inspector (provided that the aforementioned qualifications exist), one
must have attended a training seminar, relative to lift inspections, of a minimum duration of
80 hours.
Moreover, he must have participated in at least 60 50 inspections, 40 20 of which must
have been carried out in hydraulic lifts and 20 30 in electrical lifts. 50% of these inspections
must be initial inspections, in each type of lift (hydraulic, electrical).
Auditors and lead auditors must be Dipl. Mechanical Engineers, Electrical Engineers,
Mechanical-Electrical Engineers, Naval-Mechanical Engineers and Naval Engineers or
Engineers with equivalent specialty, University graduates, who are members of the
Technical Chamber of Greece (T.E.E.) and holders of the respective professional license, as
well as Technologist Engineers with corresponding specialties, graduates of Technological
Institutions, provided that they are registered in the Ministry of Development registers.
Everyone who has activities in foreign countries must have the corresponding
equivalent license, as required by local Legislation.
Note: In cases of Engineers with other specialties, having post-graduate degree in mechanical
engineering or in similar sector and documented experience of more than 10 years in the technical field
of lifts, compatibility is proven with the requirements of the present Guidance.
In order to become an auditor (provided that the aforementioned qualifications exist), one
must have attended a training seminar, relative to lift inspections, of a minimum duration of
80 hours. In addition, he must have attended a training seminar of a minimum duration of
50 hours, relative to technical dossier examination procedures, according to the current
national and European regulations.
Moreover, he must have participated in at least 120 100 inspections, 80 40 of which must
have been carried out in hydraulic lifts and 40 60 in electrical lifts. 50% of these inspections
must be initial inspections, in each type of lift (hydraulic, electrical). He must also have
participated in the examination of 40 20 lift technical dossiers, as a trainee auditor.
In order for the auditor to be upgraded to lead auditor, additionally to the aforementioned in
paragraph 5.4.4, he must have carried out at least 120 100 inspections, 80 40 of which
must have been carried out in hydraulic lifts and 40 60 in electrical lifts. 50% of these
inspections must be initial inspections, in each type of lift (hydraulic, electrical). He must
also have conducted 60 40 lift technical dossiers examinations.
Inspectors have the right to carry out on-site lift inspections (initial and periodic).
Auditors have the right to carry out on-site lift inspections and lift technical dossiers
examinations.
Lead auditors, in addition to the aforementioned, can participate as experts in special cases
of inspections, appeal and accident examinations, according to the current legislation.
Furthermore, the notified body must provide training to the aforementioned personnel,
which must comprise:
6.1 During the inspection of lifts and depending on the type of the installation and the year
at which the lifts’ legalization document was issued, inspection certificate, operation license
or registration certificate/decision or preliminary installation approval or building permit
upon which the installation was made – Article 10 “periodic Inspections & tests” and article
15 “Transitional Provisions” of Common Ministerial Decision No Φ9.2/28425 (Government
Gazette issue 2604B/2008), there might be required:

6.4 For the documentation of the inspections that have been conducted, photographic
evidence is required. Specifically the following should be photographed as a minimum:
The presence of the inspector shall be recorded in one of the previously mentioned items
with his consent.
Taking into consideration annex D of the standards ELOT EN 81.1:1999 & ELOT EN
81.2:1999 “Examinations and tests before putting into service” concerning the minimum
measurements and verifications that need to be conducted during the onsite inspection to
the lift installation:

instruments and/or measurement methods can be used for the above measurands, provided
that they are documented.
8.1 The maximum number per day (on an 8 hour basis) of initial lift inspections that are
conducted by a qualified person should not exceed two (2), while it can be combined with
one (1) periodic inspection at the most.
8.2 The maximum number per day (on an 8 hour basis) of periodic lift inspections
conducted by a qualified person should not exceed four (4).
8.3 When a qualified person conducting lift inspections has to conduct one (1) initial
inspection per day (on an 8 hour basis), he can not conduct more than two (2) periodic
inspections on the same day, and vice versa.
8.4 On a weekly basis, a qualified person conducting lift inspections can perform lift
inspections for six (6) days (on an 8 hour basis) at the most, thus the total number of
initial & periodic lift inspections is adjusted according to the here above articles 5.7.1, 5.7.2
and 5.7.3.
According to the applicable national and European legislation, the context of the
declarations of conformity and certificates that the certification and/or inspection bodies
issue or review must include at least the elements described in the exemplars of annex II of
the Ministerial Decision No Φ9.2/28425 (Government Gazette issue 2604B/2008).

ESYD Assessor examines the dossier of the manufacturer/installer at the Body premises.
The body report for the decision for the EC Type Examination Certificate Issue,
along with the application and the manufacturer’s quality system concerning module
D and
The application and the manufacturer’s quality system, including product design and
respective test reports, concerning module H.
The onsite assessment by ESYD Assessor includes the evaluation of the Notified Body
inspection at the manufacturer/installer premises.
The quality assurance system requires procedures that allow the supervision of the system
from the design phase to the final inspection.
ESYD Assessor examines the method with which the organization evaluates the quality
assurance system to determine whether it complies with the directive requirements.
During the assessment conducted by ESYD concerning the Directive 95/16/EC “Lifts”,
according to annexes IX & XIII (Module H) “Full Quality Assurance” for lifts and safety
components, the ESYD assessor will examine how the body evaluates the quality assurance
system to determine whether it complies with the directive requirements.
ANNEX 1
Obligations under essential health and safety requirements apply only where the lift or
safety component is subject to the hazard in question when the specific lift or safety
component is used as intended by the installer of the lift or the manufacturer of the safety
components.
The safety-component manufacturer and the installer of the lift are under an obligation to
assess the hazards in order to identify all those which apply to their products; they must
then design and construct them taking account of the assessment.
In accordance with Article 14, the essential requirements laid down in Directive 89/106/EEC,
not included in this Directive, apply to lifts.
Where the relevant hazard exists and is not dealt with in this Annex, the essential health
and safety requirements of Annex I to Directive 89/392/EEC apply.
1. CAR
The car must be designed and constructed to offer the space and strength corresponding to
the maximum number of persons and the rated load of the lift set by the installer.
Where the lift is intended for the transport of persons, and where its dimensions permit, the
car must be designed and constructed in such a way that its structural features do not
obstruct or impede access and use by disabled persons and so as to allow any appropriate
adjustments intended to facilitate its use by them.
The means of suspension and/or support of the car, its attachments and any terminal parts
thereof must be selected and designed so as to ensure an adequate level of overall safety
and to minimize the risk of the car falling, taking into account the conditions of use, the
materials used and the conditions of manufacture.
Where ropes or chains are used to suspend the car, there must be at least two independent
cables or chains, each with its own anchorage system. Such ropes and chains must have
no joins or splices except where necessary for fixing or forming a loop.
Lifts must be so designed, constructed and installed as to prevent normal starting if the
rated load is exceeded.
Lifts must be equipped with an over speed governor. These requirements do not apply to
lifts in which the design of the drive system prevents over speed.
Lifts driven by friction pulleys must be designed so as to ensure stability of the traction
cables on the pulley.

Controls
1.6.1. The controls of lifts intended for use by unaccompanied disabled persons must be
designed and located accordingly.
- there can be no possible confusion with circuits which do not have any direct
connection with the lift,
- a fault in the electrical installation does not give rise to a dangerous situation.
2.1. The lift must be designed and constructed to ensure that the space in which the car
travels is inaccessible except for maintenance or in emergencies. Before a person enters
that space, normal use of the lift must be made impossible.
2.2. The lift must be designed and constructed to prevent the risk of crushing when the car
is in one of its extreme positions.
The objective will be achieved by means of free space or refuge beyond the extreme
positions.

The doors of the car must remain closed and interlocked if the lift stops between two levels
where there is a risk of a fall between the car and the shaft or if there is no shaft or where
there is no shaft.
3.2. In the event of a power cut or failure of components the lift must have devices to
prevent free fall or uncontrolled upward movements of the car.

4. OTHER HAZARDS

4.2. Landing doors, where they have to contribute to the protection of the building against
fire, including those with glass parts, must be suitably resistant to fire in terms of their
integrity and their properties with regard to insulation (containment of flames) and the
transmission of heat (thermal radiation).
