Dr. Terrence Nazareth : Appellant Vs. CPIO, SEBI, Mumbai : Respondent
ORDER
1. The appellant had filed an application dated July 24, 2014, under the Right to Information Act, 2005 (hereinafter referred to as "RTI Act"). The respondent vide letter dated August 19, 2014, responded to the appellant. The appellant has filed this appeal dated September 11, 2014 (received at SEBI on September 12, 2014), against the said response. I have carefully considered the application, the response and the appeal and find that the matter can be decided based on the material available on record.
2. From the appeal, I note that the appellant is aggrieved by the respondent's response to the following queries of his application, viz.
i. "Please give me a complete list of each and every communication since July 2005 that SEBI had on the subject ICICI Client documents, Account Opening Forms, etc. damaged during the Mumbai/Navi Mumbai Floods of July 2005 and the suspension/termination of Clients demat and trading accounts with ICICI Bank, ICICI Securities, etc. ii. Please give me a copy of each such submission listed in (i) above iii. Please let me know the total number of complaints received by you from ICICI customers on the subject of suspension of their ICICI trading and demat accounts, during the period Oct 1, 2007 to Dec 31, 2010. How many of these were forwarded to the stock exchanges?"
3. In this appeal, the appellant has inter alia submitted: "The (respondent) has flatly refused to provide me any answers to my application regarding communications of SEBI regarding ICICI Client Documents destroyed in Floods "

In his response to the appellants application, I note that the respondent inter alia informed the appellant that further to the information already provided to him through earlier RTI applications, no additional information was available with the concerned department of SEBI. I do not find any reason to disbelieve the response provided by the respondent and upon a consideration of the same, I find that the requisite information in respect of the appellant's Brought to you by http://StockViz.biz Page 2 of 2
request for information had been provided by the respondent. I, therefore, find no deficiency in the respondent's response to the appellant's application.
5. In view of the above, I find that there is no need to interfere with the decision of the respondent. The appeal is accordingly dismissed.
