TOPIC:

1. With reference to the provisions in the Federal Constitution and other relevant
laws (if any), discuss any TWO (2) of the following:
i) Supremacy of the Federal Constitution (50 marks)
ii) Federal and State Legislative powers (50 marks)
iii) Public and Private laws (50 marks)


2. Article 3(1) of the Federal Constitution provides Islam is the religion of the
Federation; but other religions may be practised in peace and harmony in any part
of the Federation.

Discuss the application of Islamic Law as a source of law in Malaysia.

3. Elain applied for a job as an executive at Excell Top Performance. The potential
employer requested for a report from per present employer, Jati Diri Sdn Bhd. In
the referral letter, the Human Resources Officer, Puan Suzanna wrote, a
hardworking personnel and a team-player but at times needs to control her
emotions when dealing with the public.

As a result,Elaines application was rejected by Excell Top Performance. Elaine
was not satisfied with Puan Suzannas statement and said that she has been
defamed as a bad tempered person.

Discuss what right Elain has under the law.

4. Anuar suffered from skin irritation. He went to see Dr. Sammy, a skin specialist,
for consultation and medication. Dr Sammy diagnosed Anuars condition
dermatitis. Dr Sammy gave Anuar an injection and some medication. Two days
later, Anuar found that both his arms were swollen and covered with rashes.
Anuar admitted himself into the hospital. The hospital discovered that Anuars
condition was due to wrong medication prescribed earlier.

Anuar seeks your advice as to whether he could take legal action against Dr
Sammy on the ground of medical negligence.
