Dear Mr. Hill:
Thank you for your recent email on behalf of the executive director responsive to my
public records request. Please excuse my delay in responding. In answer to your query, it
would be my pleasure to speak with you by telephone. All ca])s on my home office
business telephone extension are recorded for quality assurance purposes pursuant to the
business use exemption of Florida Statutes chapter 934, specifically section
934.02(4)(a)(I) and the holding of Royal Health Care Servs., Inc. v. Jefferson-Pilot Life
Ins. Co., 924 F.2d 215 (11th Cir. 1991). As such you are free to chose your course of
action. The preceding information is my personal opinion of how the law applies to me,
and is not provided to you as legal advice or the unlicensed practice of law. However, if
you speak with me by telephone, I will take that as your consent to being recorded.
I am requesting legal actions commenced in either federal or state courts, whether

ongoing, closed, or on appeal, involving The Florida Bar (TFB):


1. Lawsuits by non-lawyer persons who previously complained about lawyer misconduct to TFB.
2. Lawsuits by non-lawyer persons or entities about TFB's lawyer discipline process.

3. Lawsuits by lawyers (from any jurisdiction, regardless of bar membership) about


TFB's lawyer discipline process, including lawsuits about their own personal situation
and/or alleged misconduct.
4. Lawsuits about the Americans with Disabilities Act (ADA) or which mention the ADA.
5. lawsuits about Florida Lawyers Mutual Insurance Company (FLMIC) or that mention
FLMIC.
6. Lawsuits against TFB that raise issues of constitutional rights (federal or state), such
as due process of law, equal protection, obstruction ofjustice, first amendment speech,
and all other constitutionally-guaranteed rights.
7. Lawsuits against TFB pertaining to negligence, fraud, mail fraud, breach of fiduciary
duty, RICO claims (federal or state), or pertaining to restraint oftrade/anti-trust,
corruption or malfeasance.
8. Lawsuits about TFB's right to exist, or to exist as the "arm" of the Florida Supreme Court.
7. Unlicensed Practice of Law (UPL) lawsuits by TFB against any person or entity.
8. Lawsuits about TFB's Lawyer Referral Service.
In addition, please provide the following:
9. A copy of the report issued in 2006 with the findings of the Special Commission on
Lawyer Regulation, chaired by Hank Cox.
10. Results of TFB's 2003 poll to assess what Bar members thought of the job TFB was
doing with its discipline.
II. Information about Florida State Representative Fred Brummer's proposed
constitutional amendment to take the regulation of lawyers away from TFB and the
Florida Supreme Court.
12. The Florida Bar's policy regarding interpersonal relationships, dating, consensual
sexual relations, engagements to marry, and marriage, for Assistant StafTCounsel
working in the same office.
13. How can a prospective client of a lawyer licensed to practice in the state of Florida
know whether the lawyer has malpractice insurance, and whether or not the insurer is
Florida Lawyers Mutual Insurance Company?
14. Information about TFB lawyer referral service, bylaw 2-3.2(d)(l). Information about
the 12% fee the lawyer must pay for the referral. Also, when TFB makes a referral for a

lawyer advertising on the LRS a particular area of practice, what does it do (if anything)
to assure that the referral confonns with Rule 4-7.2(b)(5)?

(b) Prohibited Statements and Infonnation
(5) Advertising areas of practice - a lawyer or law finn shall not advertise
for legal employment in an area of practice in which the advertising lawyer or law
finn does not currently practice law

16. Infonnation about programs for the development and provision of benefits and
services to bar members, including, but not limited to, insurance benefits and association
member discounts on goods and services, TFB bylaw 2-3.2(d)(9)
17. The salary, benefits, and emoluments of the executive director, TFB Rule 1-7.2 and
bylaw 2-4.3
18. The salary and benefits of the Director of Lawyer Regulation, the five Chief Branch
Disciplinary Counsels, and the Assistant Staff Counsels
19. TFB annual budget, bylaw 2-6.3 (for the past 3 years)
20. TFB audit filed with the Supreme Court, bylaw 2-6.16, the full audit and the
condensed summary published in The Florida Bar Journal or The Florida Bar News. (For
the past 3 years)
21. Annual report of The Florida Bar and its committees (bylaw 2-8.2 & special
committees, bylaw 2-8.3), including the section on General Practice, Solo and Small Finn
Section (for the past 3 years)
22. Legislative action of sections and divisions, TFB bylaw 2-7.5
23. Infonnation about TFB insurance for members of the board of governors, officers,
grievance committee members, UPL committee members, clients' security fund
committee members, and employees, bylaw 2-9.7 and history of claims submitted or paid.
24. Infonnation about TFB law office management assistance service, bylaw 2-9.8
25. Infonnation about TFB public interest programs, bylaw 2-9.9
26. Infonnation about TFB members benefits program, bylaw 2-9.10
27. Infonnation about TFB assistance to members suffering from impainnent related to
chemical dependency or psychological problems, bylaw 2-9.11

29. Does TFB provide model fee or representation agreements for its members to use
with clients? If yes, kindly provide a copy of each model agreement.
30. Does TFB provide information or guidance to its members, especially new members,
about how to charge clients for legal services? This request is for infonnation in addition
to what is required by the Rules of Professional Conduct and the Rules Regulating The
Florida Bar.
31. Is there a process or procedure for bringing a bar complaint against a lawyer or
Assistant Staff Counsel employed by The Florida Bar?
32. What information can you provide about Lanson v. TFB, 08-80422-Civ
Zloch/Snow? I see the case was voluntarily dismissed without prejudice.
33. Information about direct and indirect political activities by TFB against Florida
J.AJ.L. 4 Judges, Florida Division of Elections Committee #35025.
34. Can an ordinary citizen of the state of Florida subscribe to The Florida Bar Journal
or The Florida Bar News?
35. On or about September 30, 2008, I submitted a public records request to Susan V.
Bloemendaal, Chief Branch Disciplinary Counsel, Tampa. As of today Ms. Bloemendaal
has not responded, although limited information was provided by Mr. Dillard. When can
I expect a full response to my records request submitted to Ms. Bloemendaal? And in
directing nlY request to Ms. Bloemendaal, did I submit my request to the proper person?
36. On or about November 5, 2007, I submitted a public records request to Kenneth
Lawrence Marivn, Director of Lawyer Regulation, copy enclosed. As of today
Mr. Marvin has not responded. Can you respond on Mr. Marvin's behalf?

the following documents I mailed you in June, 2007. Specifically I am concerned with

Here are the documents for which I am making a public records request:

My letter to you dated June 20, 2007, that referenced, and provided, three bar
complaints. I want copies of my June 20, 2007, cover letter to you showing The Florida
Bar's "received" stamp, and I want copies of the three bar complaint forms showing The
Florida Bar's "received" stamp on those complaint forms.

My letter to you dated June 21,2007, requesting intervention in the libel
counterclaim in the case Neil J. Gillespie v. Barker, Rodcms & Cook, P.A. and William J.
Cook, Case No. 05-CA-7205, Circuit Civil, Hillsborough County. I want a copy of my
June 21, 2007 letter to you showing The Florida Bar's "received" stamp.

My letter to you dated June 30, 2007, that provided you copies of HALT's amicus
curiae briefs in the Illinois case of Cripe v. Leiter, and in the matter of Mark M. Hager, a
disciplinary matter in the District of Columbia. I want a copy of my June 30, 2007, letter
