COMPLAINT AGAINST VICTORIAN EQUAL OPPORTUNITY AND HUMAN RIGHTS COMMISSIONER

1. I wish to make a formal complaint against the Victorian Equal Opportunity and Human Rights Commissioner
on account of her failure to adequately consider and perform her important statutory duties and
responsiblities under the Charter of Human Rights and Responsiblities Act.
2. I attach for your information:
a. copy of my facsimile today to the Commissioner (including copies of her letters of 15 September
2009); and
b. copy of my facsimile of 28 August 2009 to the Commissioner (and the Victorian Attorney-General)
enclosing my Notice under Section 35 of the Charter of Human Rights and Responsibilities Act.
3. Please note that I previously sent several folders of materials to the Commissioner in respect of the human
rights abuses complained of in that Notice.
4. Please also note that the Section 35 Notice includes approximately 300 pages of attached documentation.
5. I have not provided the full Section 35 Notice or other background materials to you at this stage as I wish to
receive confirmation that your Office is considering this complaint, before I go to the expense (some $50 -
$100) of copying and sending these materials to you.
6. I ask that you appoint person with sufficient seniority and capacity to properly consider this complaint.
7. Please note that this is a dynamic complaint, as I expect that the Commissioner is unlikely to 'reform' of her
own accord, and I expect futher misconduct from her office. I trust that the person you assign to investigate
this complaint will also recognise the dynamic nature of this ongoing complaint.
8. Please note also that there is a connection between this complaint and my complaint regarding the Victorian
Legal Services Commissioner, Ms Marles (just one of the extraordinary 95 reports of misconduct by the

Victorian Legal Services Commissioner, as recounted in your 2008-09 Annual Report). I mention this to
underscore the seriousness of my complaint/s.
9. Finally, I encourage you to take a personal interest in these complaints.
10. I believe that there is considerable suggestion of what my former Law Professor and Mentor, Professor Alan
Fels would describe as 'tacit [ie unspoken] collusion' between these various statutory oligarchs which seem
hell bent on ensuring that lawyers powers and privileges continue to prevail even at the expense of crushing
the sorts of basic human rights that 'ordinary' Victorians ought to be able to take for granted, as confirmed if
only from 1 January 2007 by virtue of the Charter of Human Rights and Responsibilities Act.
