MUNICIPAL ORDINANCE NO. 01-2012

APPROVING THE APPLICATION FOR RECLASSIFICATION OF LOT NO. 4308-B-5,
OWNED BY MR. WILSON VALERA KO, REPRESENTED HEREIN BY MR. LITO
JAMES GUERRERO BAUTISTA , COVERED BY TCT NO. T-153062, WITH AN AREA
OF 10,000 SQUARE METERS, SITUATED AT UPPER BINOGSACAN, GUINOBATAN,
ALBAY FROM AGRICULTURAL TO INDUSTRIAL PURPOSE.

WHEREAS, an application for reclassification of Lot No. 4308-B-5, covered by TCT No. T153062, owned by Mr. Wilson Valera Ko, duly represented by Mr. Lito James
Guerrero Bautista, from agricultural to industrial purpose, was received by the
Sangguniang Bayan;
WHEREAS, the Sangguniang Bayan through the Committee on Housing and Urban
Development to which such matter was referred to, had conducted the necessary
committee meeting and an on-site public hearing and ocular inspection;
WHEREAS, during the on-site public hearing and ocular inspection conducted last June 27,
2011 at Upper Binogsacan, the Barangay Officials, BARC Personnel, and the
adjoining property owners were all amenable for the area to be reclassified, as
applied by its owner, except on the issue on tenancy which on July 4, 2011, by
certification issued by the MARO and received by the Office, the property had
been certified that, it is not covered nor voluntarily offered for coverage under the
Comprehensive Agrarian Reform Program;
WHEREAS, the Sangguniang Bayan, through the Committee, likewise reviewed the
requirements and the submitted documents such as but not limited to, BARC,
MARO, MAO, Barangay and MPDC clearances and certifications for
reclassification and other pertinent documents such as Tax Clearances, photocopy
of the Certificate of Title, Sketch Map and photocopy of the subdivision plan, and
the Committee also took notice of the fact that the applicant faithfully complied
the recommendations provided for in its Committee Report No. 106-2011, the
requisite business and building permits and real property taxes, thus, with all
these, the Committee deems that such application has substantially complied the
requirements provided for under Section 20 of the Local Government Code of
1991 necessary for reclassification;

WHEREAS, over and above the requirements, the LGU welcomes the applicant in the
municipality as the newest biggest investor in town which has opened a lot of
opportunities in terms of development in the area and creation of jobs to
Guinobatan and Albayanos;
WHEREFORE, in consideration of the foregoing premises:
BE IT NOW ORDAINED, by the Sangguniang Bayan of Guinobatan, Albay in session
assembled that:
SECTION 1. The reclassification of Lot No. 4308-B-5, covered by TCT No. T-153062, located
at Upper Binogsacan, this Municipality, owned by Mr. Wilson Valera Ko,
represented herein by Mr. Lito James Guerrero Bautista, from agricultural to
residential purpose, is hereby authorized in accordance with Chapter 2, Section
20, Book 1` of R.A. 7160, otherwise known as the Local Government Code of
1991.
SECTION 2. The Office of the Municipal Assessor is likewise authorized to make the
necessary adjustment on the existing records on file pertinent to the lot herein
reclassified upon its effectivity.
SECTION 3. This ordinance shall take effect upon its approval on review by the Sangguniang
Panlalawigan.
