1. ApplicantssubmittedseparateRTIapplications,bothdated31December2012
beforetheCPIO,NorthDelhiMunicipalCorporation,NewDelhitoobtaininformation
through nine points pertaining to the documents/correspondence/file notings etc.
pertainingtothestructuralsafety,noobjectioncertificatefromfiredepartmentetcin
respectoftheFerozshahKotlacricketgrounds enclosedherewithasAnnexure
A.
2. Theidenticalapplicationswaspreferredundertheprovisotosubsection(1)of
section7oftheRTIActwhichreadsasfollows:
"Providedthatwheretheinformationsoughtforconcernsthelifeorlibertyofa
person, the same shall be provided within 48 hours of the receipt of the
request."

3. TheRTIapplicationstatesthattherequestedinformationhasabearingonthe
safetyandlifeofthousandsofspectators(includingthatoftheappellants)whowere
presentinthecricketstadiumtowatchthecricketmatchheldon6January2013.
4. Not receiving any information from the CPIO, the appellants moved the
Commissionbypreferringcomplaintvidetheirapplicationsdated7January
2013 and 8 January 2013. The Commission registered the applications as
secondappealsandissuednoticetoboththepartiesintheabovementioned
casesthathearingwillbeheldintheCentralinformationCommissionunder
section19(3)oftheActon11January2013at12:45PM.Earlyhearingwas
granted as the Commission, after going through the contents of the
applications concluded thatthe issues raisedthereinrelate tolargerpublic
interest.
5. Matterwasheardtoday.Bothpartiesasaboveappearedinpersonandmade
submissions.CPIOstatedthatherepresentedtheNorthDelhiMunicipalCorporation
whereas the Ferozeshah Kotla cricket grounds fell within the jurisdiction of
CPIO/ExecutiveEngineer(Bldg),Centralzone,LajpatNagar,SouthDelhiMunicipal
Corporation.Therefore,theywerenotinapositiontoprovideanyinformationtothe
appellantsinresponsetotheirRTIapplications.Appellantscounteredbystatingthat
theyhadpreferredtheirrespectiveRTIapplicationsafterascertainingthejurisdiction
oftheFerozeshahKotlaStadiumfromthewebsiteoftheMCD.

6. After hearing both parties, Commission directs the CPIO/Executive

Engineer (Bldg), Central zone, South Delhi Municipal Corporation, Lajpat
Nagartoprovidefullandcompleteinformationasheldbythepublicauthority
to the appellants by Monday, 14 January 2013. Commission will review
compliance of this order and all parties are directed to appear before the
CommissiononTuesday,15January2013at10:30AM.Itisplacedonrecord

thattheCPIOwhohasappearedbeforeustodayhastakennoteoftheoral
orderpassedtodayinopencourtandwillforwardtheRTIapplicationtothe

itselftotheconcernedCPIOasrecordedhereinabove.
7. Respondentisalsodirectedtoupdatetheirwebsitesoastoreflectthecorrect
informationregardingthejurisdictionofthe3trifurcatedMunicipalCorporations.
